The above is not applicable to a CR1 or IR1 visa holder. Also, there is not I-130 filed EVER in the case of a K1 visa holder UNLESS they marry AFTER the 90 days allowed. An I-131 is NOT applicable in CR1 or IR1 case either. Your post is entirely off topic for a spouse visa and only serves to confuse an already resolved issue.

I've been thread ban by the moderators for disclosing this because they consider this as aiding fraud. I see it as giving people knowledge about conflicting laws.
US laws are full of contradictions and exceptions because it's made up by many different people over many years.
It's illegal to enter the US on a visitor visa with the intent to immigrate. Tell CBP your intention and you will be denied entry. Don't offer to disclose and if not asked, then most likely the person will be allowed into the US.
Case law also state that the preconceived intent to immigrate alone is not a valid reason to deny the AOS of a spouse of a US citizen. This is why preconceived intent to immigrate is NEVER EVER an issue when the spouse of a USC who enters on the VWP or a non-immigrant visa seeks to adjust status.

Preconceived intent to immigrate alone is not a valid reason for USCIS to deny the AOS of a spouse of a USC. There is case law on this.

My response was correct and accurate - just not in relation to CR-1- My bad! I have the whole K1 going on in my head and missed the CR1 part. If you read I-134 form, its instructions - it says that if you're a conditional resident you do not need to apply for any reentry permit(I-134) (unless you're planning to stay abroad for more than a year). It says all you need is your resident's card. Therefore pushbrk's reply was not only accurate but also very relevant in this case. Mine - wasn't. Cheers!

    Hi,
    1. Yes, you should be getting a welcome letter in the mail within a few weeks.
    2. Yes again, the green card will arrive a few weeks after the welcome letter. And yes, it will be the conditional permanent resident card (if you've been married for less than two years)
    3. If you checked off 'yes' on the DS-230 to get a SSN, then it MAY arrive in the mail. If it doesn't, wait 3 weeks from POE, then go apply at a local SSA office. He doesn't need the green card to apply for the SSN. He just needs his passport as that acts as a temporary green card until your actual, plastic green card arrives. When I had to go apply at a local office (since 3 weeks had passed from POE and I hadn't gotten it in the mail), I actually had my green card at the time, but I just used my passport instead.
And if you want to put your steps and dates, then follow these steps: scroll up to the top right. Next to your picture, there's a link that says 'Settings', click that. Then click on the profile tab and then click on 'Change Signature'. Then add whatever you want in the textbox

We had our interview today and were approved! It was only five minutes long with very simple questions.
One piece of information that might be valuable (or at least was until yesterday): We had our expedite request approved AFTER went sent our original documents. We were worried that the NVC would not send them because, as we know, they are incompetent. However, they were there. So, sometimes the NVC does send all of the documents they have when cases are expedited (as opposed to some of the horror stories that I've read on here).
But, from what I'm reading with the policy change that the NVC will not longer collect original documents, this story may not prove too useful for those in the future.

    http://travel.state.gov/content/dam/visas/policy_updates/National%20_Visa_Center_No_Longer_Collecting_Original_Civil_Documents_November_2014.pdf
UNCLASSIFIED 14 STATE 130716 Subject: National Visa Center No Longer Collecting Original Civil Documents 1. Summary. The National Visa Center (NVC) will cease collecting original civil documents in support of immigrant visa (IV) applications as of November 12, 2014. Most applicants will be required to submit photocopies of supporting documents (such as birth, marriage, and police certificates) and will be instructed to take their original documents to their interviews for review. This does not include Affidavit of Support forms, which petitioners will still submit to NVC for initial evaluation. End Summary. New Instructions to Applicants 2. After applicants and petitioners collect the Affidavit of Support form(s), financial evidence, and supporting civil documents, they are instructed to submit all of the documents to NVC. As of November 12, 2014, applicants at non-electronic processing posts will be instructed to submit photocopies of their civil documents by mail. NVC will review the copies and, when the case is documentarily complete, will place the copies into the file, which will be sent to post, increasing the number of cases that are documentarily qualified. When the appointment is scheduled, NVC will instruct applicants to bring their original documents to the interview for evaluation and final case processing. Original Affidavit of Support forms will still be submitted to NVC for initial evaluation. Applicants at designated electronic processing posts will continue to submit their documents via email. 3. NVC anticipates this change will maintain the integrity of the IV process, reduce customer wait times, and improve the customer experience overall. UNCLASSIFIED 14 STATE 130716

Several posts have been removed for contributing nothing to the thread. Because the OP has gotten all the advice that there is to give, the thread will be closed. It is not to be restarted, and its drama is not to be carried into any other thread.
To those who objected to posts in this thread: Hit the "report" button next time. It does no good to complain within a thread if the thread might not be seen. Thanks.

OP, the only correction to information given is that, once your status ends, you must leave the U.S. -- it isn't necessary that you specifically return to your country of origin. Good luck to you.

This is the only accurate post in here - I am sorry for your situation, and for the unbelievable judgment that has gone on in his post - It's amazing what people infer - Did he say he was visiting the US to see his now wife and got someone else pregnant? Ummm.... no - He clearly had a visitor or a work visa and met his wife on one of the trips - and probably dated others prior to that - For all anyone reading this knows - the baby could have been born before he even met his wife - Or it could be a lie by someone who was jilted and is trying to hurt him - The man was upfront with his wife about the situation - he came here asking for help - so if you can't provide it, why bother judging?
Follow the steps above - If you can't reschedule, and manage to patch things up with your wife, you will have to start over with immigration - Hope it works for you

Hey folks, some lovely news this morning!!
As of yesterday, November 12th, NVC will no longer collect ORIGINAL CIVIL DOCUMENTS for the IV package. That is correct, you read that right. From now on, photocopies of the civil documents (birth, marriage, police, military, etc) will be accepted. Originals of those documents will be brought to the interview instead!
Information found here (2nd link): http://travel.state.gov/content/visas/english/law-and-policy/visa-policy-update.html
    Direct link to update: http://travel.state.gov/content/dam/visas/policy_updates/National%20_Visa_Center_No_Longer_Collecting_Original_Civil_Documents_November_2014.pdf
I encourage you all to read the update. For those that haven't sent your packages yet, time to make photocopies of the civil documents and put the originals in a safe place in time for the interview!!
Please note, this does NOT mean you can send photocopies of the AOS form. The form still has to be an original, with the original signature. As should the employment letter, with an original signature. The optional cover letters should be original as well. Besides that, everything else can be photocopies now.
I'm going to guess that this new change will reduce the amount of checklists stating a document isn't an original (when in most cases it is). Not to mention, the scrutiny of civil documents will be less (I'm guessing), thus speeding up the review process. So, good news everywhere

Which is why it's important to show ties to your country. I always travel with a letter from my employer a recent pay stub, and a copy of my lease for my apartment. Up to now they never asked for anything. However when I go through preclearance at the Montreal airport, I saw a difference between my first trips when I said I was going to visit my boyfriend and the last one when I said my Fiance because we had gotten engaged. The CO was very nice and actually funny, but he asked more questions, specifically asked if I was planning to get married and stamped my passport which they usually never did.
My suggestion is to show ties to home, maybe bring an upcoming contract you may have for work, and if you're renting a place, you could ask for a lease or contract as proof.
    Good luck!

Just called NVC. We have an interview date of 23rd December.
Now, I wonder how long it will take them to issue the Visa and get it to us. Mmmmmm. Am super excited. Once they get my file I might email and see if I can bring it forward although I am sure they won't. Still, worth a try.
    Guess they are still scheduling.
dwheels, can you add me to the spreadsheet please?

    Absolutely.
Nowhere does it say that you can't visit. You just might be asked to show ties to your home country. They do have the power to deny your entry if they don't think you're convincing, but it seems that most people are successful in that.
If you're still in doubt, simply call USCIS
    Good luck!

I don't think it counts because you have your interview date and for some 13 is a bad luck number so, I say you made a mistake .
OMG I would be crying also, so happy it all worked out Phewwwwwwwwwwwww, great news today and two big scares!
I almost fell off my chair reading this phewwwwwwwwwwww, I'll let someone that knows more about this answer but I would say you'll be just fine. Anyone want to say I'm full of it hahahahaaa . If not mistaken they consider an e-mail like a package but you should be able to call a supervisor with the date of the e-mail sent and have them look into it. Praying I'm right and nothing will come of this. And boy do we understand!

Packet 3 (issued by the embassy/consulate) only applies to K-people and asks them to submit the civil docs, for example, which you already did during the NVC process. So don't worry about it Good luck!
