    it's not clear. Are you going to the interview in your country embassy? If all documents are approved, they may issue your visa with all this situation. If you are going to the interview in US, your husband needs to go with you, you could be denied or delayed if he is not present.
    But the most important, you and your kids, do you really wish to go to another country and be on your own when he is in jail??? I know America looks like a promised land from outside but, believe me, the woman with kids and no family support has a very hard life here and as a foreigner much harder. I would recommend to research what is his sentence and for how long he will go to jail? How do you imagine the life without him? How CO will think you go on a marriage visa to your husband, to be with him and he is not with you???

    You guys are awesome , thank you so much for the valuable informations as of my mother yes she lived 25 years in the US and moved to Morocco with my dad and had me born in Morocco , I have couple photos plus her infos, unfortunately i don't know much about her since she married this other dude but the good thing is i have my Moroccan birth certificate which has her infos plus 3 or 4 childhood photos. Idk if it's good proof or not but I will definitely reach out to the USCIS and see what they say. OMG I'm so EXCITED LOOOOL
    Maybe this thread was a way to find out that I am actually a USC hahaha , and for those who told me to pack my stuff and go back i sincerely tell you thank you for your comments, they made my day, I will serve and protect your rights and the land ur on. Peace and love

    I have to agree here. There is age difference and then there is a ridiculous age difference. She is old enough to be his GRANDMOTHER. Something is not right in this scenario. I would recommend consulting with an attorney.

    This may be controversial but I am going to say it anyway-

    You can go to court and request to either become your mothers guardian or have someone else appointed her guardian.

    You have to go to court to have the person declared incompetent based on expert findings. Does being in love with a 29yr old and wanting to move across the world mean she is incompetent? I dunno. Is she making responsible choices? Is a 1 month in person meeting enough to say she is love or is her thought process clouded? Does she have other things in her life where she is showing clouded judgement and not being able to care for herself or is this just the child disagreeing with the parents choices of a mate? Again I dont know. A court would evaluate it.
    The court transfers the responsibility for managing finances, living arrangements, and medical decisions to the guardian.
    This procedure can take some time. If family members disagree about the need for guardianship or who should act as a guardian, it will be a painful, prolonged, and costly process that will leave everyone involved feeling angry, guilty, or both.

    We can only step in when we are told something is wrong, by members using the "report" button at the bottom of every post. Until this evening, no-one did so. Please remember all the mods on this site are volunteers, and we cannot read every post/ thread on the forums. If you see something against the TOS, please report it and the next moderator online will action it.

    I'm just gonna hire an attorney give him all the documents i have, and on another note my mom talked to me secretly when i came to the US and told me that i remind her of my dad and that's why she doesn't want anything to do with me. I guess that can be a good proof too don't you think ?

    You just filed in October and are losing your patience? Your ROC will take a minimum of 5 months, but could take a year or more.

    Find out the correct way to go about it. I suggest speak to the recruiters in the marines they may be able to help you speedy things along

    Was your mother married at the time you were born? And, prior to your birth, did she have a minimum of 5 years of physical presence in the US, 2 of which occurred after she was 14 years old?
    IF the answer to both of those questions is "yes", then apply for a US passport, with all of your supporting evidence, and see if you have sufficient evidence to show your mother transmitted US citizenship to you.

    I would've expected moderators to have stepped in by now.

    OP you really need to look into your situation again as you may be in an application process that ultimately is futile.
    I too think it's odd that having a parent who's a USC wasn't disclosed earlier to USCIS as I would hope they would steer you into the right direction.

    Good luck with your next course of action and your dream of joining the military. Good to see you keeping calm with some of the abusive posts in my opinion, you'll need it out on the front!

    OP.. my suggestion is to read more of the threads, guidelines and timelines. You need to have a better understanding of the process. I understand that you are frustrated. There are many people here who have waited as long or longer than you. It's OK to vent but you need to be more informed and realistic in your expectations.

    People can complain if they want too, it isn't a matter of respect or not.
    It won't change the fact that the petition will sit in a box for anywhere from 4 months to 14 or more just waiting to get some action.
    ROC is basically a money grab by USCIS since almost everyone is approved.

    DO NOT leave the country with an expired green card and expired extension letter. Get an info pass appointment to get your passport stamped, they'll give a one-year stamp on your passport while your I-751 is still pending. I'm on the same boat as you, I had to get my passport stamped on Nov 3rd, cuz my I-751 has been pending since Nov 2015.
    Hopefully you can get an Info Pass appointment before your trip, otherwise you may need to reschedule your flight. Once again, DO NOT leave the country if BOTH the GC and the extension letter are expired, you don't have a valid reentry, and you may find yourself stuck out of the US. I'm not sure if leaving in these circumstances also quality as forfeiting your case, only an experienced lawyer would be able to advise you there. Just make sure to get that stamp on your passport and you'll be fine.

    At the point of two years from issuance of your 2-year GC, you will have to reapply. At that time you will have to show that you entered the marriage with a good faith intention of establishing a bona fide marital relationship.
    There are no absolute rules for this, but two things USCIS looks heavily at are cohabitation and comingling of finances.
    You will definitely not get immediately deported because you move out. However, at the time your reapplication (Petition for Removal of Conditions) is adjudicated, USCIS will be considering whether your separation was indeed temporary and an attempt to maintain some balance in the marriage so it could move forward, or evidence that the marriage overall was a sham just to get a green card.
    It would be far more persuasive if, while having different residences, you continue to see each other and continue to combine finances. Even if you don't get back together and are in divorce proceedings by the time of the petition, it will look better if you were clearly trying to maintain the marriage.

    As to your greencard question - no, she can not physically remove your greencard from your possession. If you have a 10 year greencard, there is nothing further you need to prove to USCIS in order to keep it. You can divorce tomorrow if you are so unhappy.
    For what it is worth, my husband is the only one working and he does pay off my previous student loans from his salary. Neither of us has a problem with that, are you expecting some sort of sympathy about having joint finances?
