When you get an AOS denial the 1st thing you need to do is talk to an attourney. I really think this is the best thing you can do right now. I know this is an awful situation, I really feel for you. I hope it can get cleared up soon, as it is not your fault. Talk to an immigration lawyer. And whatever you do...never for one second give up hope.

You can say with 100% honesty that you have never been deported. It isn't the same thing.

like the other person said, you'll need to have that green card before leaving with AOS pending. you should--and probably have tried to--talk to someone official about this situation. good luck!

They said it would be here within 7-10 days and it came on the 10th day. No more immigration for 10 years!!! I hardly even believe it.

Hi we need urgent advice on tax income. My husband doesn't have any income for the past year (2005) and 2004 was only 7000 because he was only 6 months in the Army. 2003 is also zero because he was deployed in Iraq for a year. We got a joint sponsor who is actually my husband's uncle. Now the problem is that we found out today that his taxes income is respectively for the 3 years:
2003 17,984
2004 18,311
2005 17,361
He is single, he's not married and he has never been married. Does not have any kids or anything like that; He still live with his parents but they DON'T depend on him. he is basically a TOTAL SINGLE person.
Do you think his income his sufficient? Do you think are we gonna have any problem with the USCIS? We need an advice ASAP!!!!!!!!! Thank you!!!!

Go to www.uscis.gov and look at the current poverty guidelines for 2006. It's under "forms fees and fingerprints" and the Affidavit of Support section. If your husband does not make the amount for 2 people, you will need a co-sponsor. How many people are in your co-sponsor's household? I will go try to find the link for you.

You prolly read my post from our interview on April 11th, but I will state here that it was just fine.
The whole not having a passport or a stamp in the passport thing almost shot it, but it was approved.
I simply explained to the officer that I had looked on travel.gov and saw Canadians were NOT required to have passports to enter the US at the time we came through, which was 2003.
Anyway...it was easy. He said he could tell just by looking at us that we are a real couple, so he didn't even want to see pictures! It lasted like 10-15 minutes. Easy.

Interview was April 11th, got the welcome letter in the mail on April 15th in case anyone is interested in a time frame for the Des Moines office we used....or in general.
Green card should be here soon. I'll let you know when that comes, too.

Yeah, I'd check "other" and then just put you know, the truth. Just write K-1 with AOS pending, or something.
Also, I would just like to tell you that when we moved we just called and changed our address over the phone. The lady said she could do that and it worked out just fine. My husband was out of status at that time, but we weren't asked about it.
I don't know. That is just my experience. I think it is probably best to file the AR-11. And I guess you'll just have to put the date it expired. You've filed the AOS application, so you are fine with the fact that it's expired.

Inspected just means like...did the person see an immigration officer, talk to him/her, etc. before entering the US or before entering the main bit of the airport, in your case. As said before, pick yes!

Jeez. Our officer was kinda weird, too. He didn't wanna see any of our photos or scrapbook or anything and it made me mad! I had worked so hard....grrr.
Oh well.
Anyway, glad you got to go to Canada. We'll be up there in September for a wedding. Happy Easter!

For I-864 you will need to submit copies of your last 3 years of taxes and last 2 months, I believe of pay stubs. Good luck!

Yeah, I think you should just submit the 2004 taxes and a copy of the notice that you have an extension on the 2005 ones. If your extension deadline has passed before you file AOS, I think you should get a co-sponsor. Co-sponsor is no big deal, I used my mom, it's just a matter of filling out another form.
Then when the interview comes around, be sure to take whatever taxes you have for the last 3 years at that time and a letter from your husband's employer stating how many hours per week he works and what salary, etc. I think you should be fine.

You know, I was thinking about this case today, and I have decided that the officer you had did not have enough authority to approve your case. I have heard of that happening before, now that I think of it. Even our officer had to go talk to his supervisor before approving us. Maybe your guy's supervisor wasn't in or something. I'm not sure...but I think this could be the case.
