    Does your dad make a salary and has overtime added to that if he works over 44 hours per week? 
    For example  
    My husband makes XX in salary. He is also paid a differential for night work, Saturday work and Sunday work.  He also makes overtime above 40 hours.  So even though he is salary, he can still earn overtime.  
    Im paid 50k in salary. It doesnt matter if I work 60 hours or 30 hours in a week.  My gross salary remains the same. Im supposed to work 86 hours per 15 day period according to my pay check. Lol

    Is you dad paid every two weeks, or twice a month?
     
    If twice a month, some pay periods will cover more than 10 working days.

    Sounds like he worked 8 hours overtime.  This is pretty simple stuff.  Have you thought of petitioning Webster's to put your photo next to the definition of "overthinking"?  😉😉

    Not current year pay.  Calculate a year going forward from now at the base pay rate.  Current income is not, "current year income" or "2019 income".  It's "current income".  If you took a job today for 49k, then 49k is your current income.  If you lost your job yesterday, then zero is your current income.

    Ok, but that's not 3x current income.  It's current income for each of three people.  For Dad, no, it is not YTD gross excluding overtime.  It's his gross pay, at his base pay rate for a full pay period, times the number of pay periods in a full year going forward.
     
    Think of it this way.  If you start the year making $10 an hour working 40 hours a week, AND NOTHING CHANGED during the year, your current income is $20,800.  But if you go a raise to $11 an hour last month, your current income would be $22,880.  YTD income has nothing to do with it.

    You should be good.  Domicile issues don't come up until the NVC stage, a year or so after filing.  It would be good to use a US mailing address, and your physical address abroad.  The I-130 is set up for that already.

    I would say you are better off to start over and do it right this time.  Why was there a "preparer" shown on your I-130a form to begin with?

    Nevertheless, if you have a ban, marriage does not cancel it.

    You cannot enter of with a TN visa with intent to adjust status. A requirement of a TN visa is non-immigrant intent.
     
    H-1B allows immigrant intent so that one is fine for AOS. But they are very hard to get and you have to apply to even be selected during the annual open period. These are not prioritized by skill - everybody that meets the required criteria is equally treated and then there is a lottery element for who gets selected since the number of visas is very limited. It’s not really faster and certainly not easier IMO.

    And to clarify, this foreign spouse never intends to immigrate to the US.  The plan is for the US Citizen to immigrate to the wife's country.  Geowrian knows that.  Just reminding other readers.

    No, she can't.  First, they've been married a while, so it would be IR1, not CR1.  People with green cards must maintain permanent resident status.  The simple version of that is to stay more in the US than outside the US, and have the US be your primary residence.  She does not want to do that yet.  Only when she does, will an immigrant visa be the solution.

    She can apply for a B1B2 visitor visa that allows six month stays, but must still spend more time outside the US than inside, and is still subject to the same entry requirements.

    The only way this can be done is if the USC spouse has sufficient ties to the US to prove US domicile, and sufficient US-based income or assets to sponsor you or you have a qualified US-based joint sponsor.  Do lots more research on the spousal visa process.  Sometimes a period of separation is unavoidable.  Good luck!

    Actually says, "can't sign they are work permit holders".  Which either means they are NOT work permit holders or that they cannot do I-864a forms because they are ONLY work permit holders, NOT LPR's.  Either way, there is no more household income to add, SOOOO....they need a qualified joint sponsor.

    Yes, all correct, if you cannot get papers from your mother.  However, why is that a problem?  Perhaps the answer is private, but unless she is incapacitated, I would do all I could to get it done, if I were in your shoes.

    I told you what to enter, no matter who you are "using".  I"m also advising that since your parents file taxes jointly, you DO state your mother's current income and provide an I-864 from her.  She is person 1.  The PDF will combine their incomes.  If you don't do it this way, expect the Consular Officer to request it at the interview, causing a delay of a month or so while you do what I"m telling you to do now.
     
    How to enter information in the prior tax section is confirmed for you in the I-864 instructions, that you have only become a D student of, at best.  It is BECAUSE of those instructions, it is best practice to "use" both the married couples' incomes.

    This would only be accurate if employed in a salaried position.  For hourly employees, it can vary widely.
