    I've searched the forums and can't find a topic quite similar to mine.

    My mother has TPS (since 2010) and I, her US citizen daughter, want to adjust her status to a permanent resident. But I'm not quite sure what I'm filing in regards to the i-130 and the i-485.

    Back story: I've filed a i-130 (and I believe an i-485) for her prior to 2010. The i-130 was approved but at the time I was using a lawyer and I told that she wasn't eligible for a green card because she didn't have a port of entry (POE) on file. At the time, I wasn't as knowledgeable or confident in doing her paperwork myself. So nothing happened. And given how much time has passed on the approved i-130, I figured I'd start a whole new process for her.

    Jump to 2010, the earthquake happened in Haiti and she filed/received her TPS. She was able to travel with an advanced parole visa because of her TPS; thus I assume would now give her a POE and allow me to finally adjust her status. We've had no issues renewing her TPS and EAD since she's had it. She is married to my dad who has had his GC since 2012.

    So ultimately my question is should I file for her or would it be easier/faster if my dad does? I'll be preparing the paperwork and I just want to make sure I do it right. Any help would be greatly appreicated!

  2. Just checking in to see if there were any NY filers who are still waiting to hear about their 485 cases. Our status online still says it's in the acceptance stage and hasn't been touched since 7/11.

    I had called the customer service line about 3wks ago and was told that the possible reason why our case hadn't been touched was because they were waiting for my husband's biometrics... which he had completed since August 1st and has had he's EAD since early/ mid September.

    Our case was transfered to Nebraska on 7/10. And we're just waiting...

    Just curious as who else is waiting also.

  3. Got the email that EAD was approved! AOS is still in acceptance stage according to website and hasn't been "touched" since 7/11. Glad things are starting to pick up.

    It would so awesome if AOS would be approved also without the whole interview process. You would think that if everything was in order to obtain visas, EADs, and every other eligible document needed; it should be a easy and simple transition. Without all the obstacles and WAITING.

    But I guess it is what it is. Half way done at least. Best wishes and good luck to everyone in this waiting struggle.

    He won't legally be able to work until you guys file for his EAD (working authorization). Traveling requires an advanced parole visa( its optional if he isnt in a rush to go back home to visit; No rush= no need to file , just wait for green card). You can file these and his I-485 AOS aka green card after y'all are married with the marriage certificate. Its best you file all three together. I-485 is most important. And I believe that most people recieve their EAD before they even have their interviews for the i-485. In the the mean time he can go to school or take classes to keep him busy.

    And sorry to say it just a waiting game all over again ( currently go through it) Good luck with everything.

  5. Hey everyone, the online system is not working. I got interview letter and I did not receive any notification and I did sign up. last time it was updated was July 11. My i485 is still in acceptance while the i765, i131 is in initial review.

    Thanks for sharing. Been sitting here, feeling frustrated. Went and did the biometrics on Aug 1 and it's been quiet ever since. And the last update was on July 11 also.

  6. It was mailed to us. It doesn't show anything new online other than it is under review.

    Ok good to know. I'll be stalking my postal worker lol

    Out of curiosity, once one completes to bio part; do we wait for a interview appt letter also or can we schedule the interview? Because I saw on the uscis site where it states something about scheduling an appt.

    I assume the answer is to wait for a letter and that the appt. scheduler thing is for going into the local office for inquiries but I just want to be sure.

    Congrats to those who are moving on to the biometrics btw. And hoping that those of us who are still waiting do not get hit with RFEs :no:

    As of October 24, 2013, the DS160 replaces the forms: DS-156,DS-156K, DS-230, and DS-260 at the Embassy in Haiti. If you submitted your Packet 3 before then, you are fine..."

    This is a note about the DS-160. When you remove the quote you basically have the cover page for packet 3.

  8. Yes to both questions. He needs the DS-160. I completed it for my husband and sent him the confirmation page. Below is the list of what we submitted back to the embassy with the visa packet. Good Luck!!
