It wouldn't hurt to just circle NO for each one... And if someone in USCIS is being a literalist, it might delay your application if you leave it blank.

nightingalejules got a reaction from mogiftney in Letter Explaining why I didn't file taxes
    Try this:
    To Whom It May Concern:

My name is [your name] and I am writing to address the fact that I have no income tax returns to include with my Affidavit of Support for my wife, [wife's name]. I am [whatever your situation is - example: I am a student, currently attending the University of __________, or I recently graduated from______________, or what have you]. I have lived with my parents as their dependent throughout my life to this point, and have never made enough money to be required to file an income tax return, so at this point, I have none to attach.
I am aware that this means I have insufficient income to qualify to sponsor my spouse on my own, and as such I am including an Affidavit of Support form from my joint sponsor [or co-sponsor, depending on your situation], [co/joint sponsor's name], which is also attached to this petition.
If you have any further questions regarding this or any other aspect of my petition, feel free to contact me at: [your contact information]. Thank you so much for your consideration in this matter, and my wife and I look forward to taking this next step in our lives together.

    Yours Sincerely
    [your name]

Be careful to use the best, most coherent English you can - have someone proofread it for you before you send it. Honestly, it doesn't look great that you have never held a job, but you're trying to support a wife, so make yourself look as responsible as possible. If you have any job at all now, or are looking for one, you might mention that, and talk about the fact that you take your responsibilities seriously.  You could file a tax return for 2016 - even one that has a big 0 for income, and says that you are listed as a dependent on your parents' tax return.  You don't need to include the "penalty of perjury" part. You're not in court and you've already signed that sort of oath as part of your petition. This is not, strictly speaking, a legal document, it's just a letter of explanation. Very best of luck to you!

nightingalejules got a reaction from wbeem in Is it true that all I-751s now have interviews?
I don't think the thread needs to be deleted - just clarified. Here's a great article that spells it out:

    https://www.politico.com/story/2017/08/25/trump-administration-green-card-hurdle-242050

In theory, an in-person interview is "required" for any process that results in the issuance of a green card. However, in most processes where a green card comes after another process that also requires an interview (like ROCs and AOSs - where there was a visa interview at some point) the USCIS has waived the  interview requirement in most cases.

45's administration, as part of their "extreme vetting" mandate, is trying to cut back on the waivers, so they've made it against the rules to waive the interview for:
People moving from an employment-based visa to permanent residency Family members of refugees and asylum seekers who are applying for "provisional status" (the step before permanent residency) Removal of Conditions applicants are not included in this new rule. But some people don't read the whole story before they jump to conclusions.

It's not "fake news" - it's an incomplete understanding of "real news". Of course my favorite part of the article is where they admit that those waivers started happening because another in person interview was "a colossal waste of time". And look, here we are, a year behind in processing ROCs.

nightingalejules got a reaction from Larm in new form i751 . confused about N/A, none and leaving blank. please help.
You can type NA instead of N/A, or print out the form and write N/A on the paper with a black pen. In all of our paperwork so far I-130, etc, I put "none" on the first set of blanks under children and then left the rest blank and didn't have a problem. N/A on the A# for my USC spouse, etc.

Yes, you can continue to use your green card to exit and reenter the US while your Naturalization is processing.
However, when you are approved and take your oath, you will not be able to travel overseas until you apply for and receive your new US passport (because you surrender your green card at your oath ceremony.)
This may be where the confusion was.

nightingalejules got a reaction from NYPeach in Has anyone rescheduled their oath ceremony? Please advice
I see you’re not getting any responses... A lot of people probably stop coming to VJ after they’ve done their oath. Maybe try searching “rescheduled oath” in the search bar and private message other people who may not be active on the page anymore but might still get an email notification if they get a private message.
I should be getting my oath letter soon and hope I don’t need to reschedule! I’ve waited too long!

The ceremony was very nice... 51 people naturalizing - they asked for a volunteer to lead the pledge of allegiance and I volunteered, so that was pretty cool! After we'd all taken the oath and said the pledge, the judge asked if anyone would like to speak. A couple of the new citizens spoke, and it was nice... but the best were the family members saying how proud they were. My hubby spoke (and made me cry a little), and so did some other husbands, but then a little girl whose grandfather had to lift her up to reach the podium said how happy and proud she was of her "nana," and there was no topping that.
    The 45 video didn't have a chance.
And then they played the video for God Bless the USA by Lee Greenwood. I would have MUCH preferred America the Beautiful, but whatever. Then we got our certificates and a flag pin (from the local "Daughters of the American Revolution")

Then hubby and I went for BBQ.

    A good day!

However, when you are approved and take your oath, you will not be able to travel overseas until you apply for and receive your new US passport (because you surrender your green card at your oath ceremony.)
This may be where the confusion was.

Oath Ceremony scheduled! It will be on December 14th - so it will be a race to get my passport in time to go home for Christmas, but since there's an actual passport office in Tucson and a protocol to get an appointment even though it's within 2 weeks of travel, I should be ok! Thank goodness! So glad to be able to get this done and be a citizen and not have to reschedule! Very good day here in Tucson!

Remember that you can always amend your taxes later. File something on January  first (you still don’t need to pay anything until April) with your 2018 income. Send in the entire package as a response to the rfe with a cover letter that explains that you now qualify to sponsor alone.
Then, later, amend your tax filing with more info as required. If your rfe is still being processed you will have another opportunity to send in the amended taxes.
Right now, the priority is to keep your current application alive so you don’t lose your application fees. USCIS gets enough of our money already!

Hugs from a fellow Canadian! I'm so sorry that all the backups at USCIS are making things hard for you. I mean, it does for everybody, but especially for those who are depending on AP to be able to travel. It didn't used to take so long. And the first Christmas away from home and family is always tough - especially when you didn't actively choose to do something else.
For now, try to come up with some fun things for your new family (ie you and your husband) to do that will establish some new Christmas traditions. Last year, hubby and I threw a Boxing Day party - since Boxing Day isn't really a thing here in the US, it was a cool way to bring some of my traditions to my new home!

They look at multiple years, but they’re most concerned with whether you make enough at the time of interview. So you might be in trouble.
The amount is (as I recall) a minimum of 125% of the poverty line. (For you plus your wife plus any other dependents) You can do a google search for that.
If you don’t make enough, you can use savings but you need 5x the difference in savings. So if you need 25000 income and you only make 20000 the difference is 5000... You’d need 25000 in savings (5k x 5) to use assets.
You might want to look for a joint sponsor.

Well, it looks as though my oath is scheduled- got the notification this afternoon and it showed up on the egov website but it hasn’t updated on the USCIS site. Hopefully tomorrow! Seems like the computers update over the weekend.

Yes. As long as the marriage is legal, it’s enough. Pictures of any kind are considered secondary evidence so don’t worry too much. Traditional wedding photos are good because they show other people too, (thus less likely to be fake) but just send a selection of photos of the two of you throughout your relationship. It looks like you’ve got lots of evidence- more than a lot of people! Good luck!

Hello - I wanted to provide an update on my Oath ceremony experience that I had yesterday, the 8th November 2018. On the oath schedule we were asked to reach there at 8.30 am. This location was almost an hour drive from our home in Queens, NY and we reached right about 8.30 am, went in and seated ourselves in the hall. There were 103 people from 19 or so countries and in the first 1.5 hour we went about submitting our green cards and reviewed/signed our Naturalization Certificates.
At around 10.45 am the judge walked in and gave a brief speech, had us go through the oath and the pledge of allegiance. After that he gave a moving speech about his family history which I believe was very appropriate. At this point he left and the rest of the staff started to hand out the Certificates. Each one of us would get up when our name was called and then take the certificate and walk out.
We were done at 11.45 am and at that point my wife and I went to a Chipotle nearby to celebrate with a Burrito bowl.
We are now happy Citizens and proud of this honor. Thank you to this forum for the help with all my queries and for all the support. Of course some members in the forum are more involved and a few only like to get information but not share or update their information. However, remember knowledge expands by sharing and it also encourages us to do bigger better things.
    regards,
    psg052813.

I wouldn't worry about it. If they're looking for more documentation, they'll open the files and see what's there.

Hard to say, as with any USCIS process - the dates are not terribly accurate, but hopefully your time will come soon! Good luck!

You can probably use your US address as your home address throughout as long as you still "lived there" (paid rent or mortgage). Your trip was a long vacation, but still a vacation not a move.

Generally speaking, it’s better to answer “yes”and then explain. If you say no to prison and they disagree, then the petition will be denied.
