    I-864 or I-864A?

    Hello Friends,

    My wife is LPR and I-130 Petitioner. We have to submit AOS forms now. She doesn't have sufficient income to be the sole sponsor for AOS and her father (my father in law) has agreed to co-sponsor. Can you please help me out on which forms they have to fill? I know my wife must have to submit I-864 but I am not sure whether my father-in-law should submit another I-864 or submit a I-864A? please help me out.

    Help Regarding DS260 and Child immigration

    Hi,

    My wife is LPR and she filed I-130 for me. It was approved and I am filling in DS260.

    Our Child was born last month after I-130 got approved and outside US. My father in law is going to be joint sponsor for Affidavit of Support. Now there is a question in DS260 asking about child details in which it asks whether my Son will immigrate along with me?

    How Should I answer it. If I select Yes, does it imply a separate petition is needed for him and AOS should also cover him? If I select No, it asks whether he will immigrate at a different date than mine.

    I was under impression that my LPR wife can bring my son to US within a year of his birth and he can get the process started at POE provided he travels with my wife's first visit to US within 2 years of birth of child.

    I am bit confused now. My lawyer suggests to get the process started for child along with my application. I am thinking of getting it done after reaching US if he can get his GC filed at POE.

    Please help me regarding this.
