  1. Dear VJ members,

I'm writing to request for some of your helpful insights on an issue with my K-1 Fiancee Visa application.

Specifically, it has to do with the delay between my receiving my NOA2 and the petition arriving at NVC. There

are plenty of similar posts on this sight but I think there might be a subtle difference or two in my case.

Here's the story: I received an electronic notice of my NOA2 on June 20th. I'm currently overseas in Greece visiting my fiancee

and have activated mail-forwarding to a friend's house. For this reason, the hard-copy of NOA2 that was sent to me in the mail

was returned to USCIS. I did call them last week and changed my mailing address to that of my friend until I return to the U.S. in

mid-August. They said they'd said the NOA2 w/i 2-3 weeks. Nevertheless, my understanding is that I primarily need the NOA2 for my fiancee's

interview and that this delay in the mail shouldn't impact USCIS sending the material to NVC.

According to the K-1 Visa flowchart on VisaJourney, it is advised that 2 weeks after approval I should start contacting the NVC

to see if they've received the application. I tried a week ago but they had received nothing. The employee was really nice and helpful

and recommended I call once a week.

Now, on July 11th, I received the following email notice:

"On July 11, 2013, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly. "

Maybe I was too ambitious but I called NVC again yesterday and got this rather not-so-intelligent employee who indicated nothing

had been received. She insisted I call back 8 weeks after my NOA2 date.

I know I may have rushed a bit but I do notice that the time between NOA2 and NVC reception is much faster for some other folks on this site.

So I have a couple of questions for you:

    a) Has anyone received a notice like the one I got on 7/11 ? If yes how soon after that does NVC acknowledge reception ?

    b) I understand that telephone is the only way to check with NVC. At some point, would it be good to give them my email ?

    c) They request a receipt number. I give them the one assigned to us by USCIS (i.e. EAC**** ; we were processed by VSC).

Is there some other number I should give them ? My fiancee has been assigned an Alien Reg. number which I have.

    d) Also, are we assigned some other number by NVC once they've processed our petition and sent it to the embassy ?

Since I'm overseas and I'd have to wait for the forwarded mail to reach my friend, can I ask NVC to give me that number over the phone ?

Any feedback you might have is hugely appreciated !

They notification you got on the 11th is perfectly normal. Everybody gets it and it means nothing but that they sent it to NVC.

The 8 weeks story is what people get that have been transferred to TSC. Any chance you was transferred as well?

You will get a new case number by the NVC and as far as I know by phone is the ONLY way to receive it. So keep calling :)

You're good by giving them the EAC number you got along with your NOA1.

Your NOA2 hardcopy has no effect on uscis forwarding your petition to NVC. But for the interview you will need it.

  2. Hi guys!! I am assembling my packet for the petition for a K-1 visa for my fiance. I'm almost done, but I'm not sure what I have to put on the outside envelope. I think I read something about writing 'ORIGINAL SUBMISSION' on the outside, but what else besides the obvious address. Thanks!

We didn't write anything on the envelope but addresses. The 'original submission' part was on our cover letter for the petition.

  3. Does anyone if there is a standard time or estimated time it takes after submitting a RFE. I mailed mine last week. Does the status on the site changes once they get it or does it remain the same. Any ideas??

We just sent our RFE response yesterday so I was interested in the same subject. From what I read it depends on what service center you're at. Your status should change to RFE response review. But keep in mind this is uscis so it might never change even tho it should.

I was reading about people that got approved in as little as 4 days after the uscis received the response, but I also heard other people took way longer. So yea with uscis there's really no telling what you get. Hang in there, they'll get to you soon. The longest wait is over

  4. who all is left in our group waiting for approval?????

Congratulations to all who got approved!!!!!!!! Doing a happy dance with you!!

We're still waiting to get approved. But we just sent back our RFE response yesterday. I hope they get it today or tomorrow.

But even when we get approved it means waiting again to get sent to NVC lol or did they fix that issue by now? Anybody got their new case number already??

  5. How can i not be out of the 5 month posted processing time when on the USCIS website it says five months....???? They cant even explain this to me when i call they just keep saying that im within the processing time frame... What is this????? My senaotor office keeps telling me they havent responded to them either.. Or they lying to me and never sent in my congressional inquiry???

Were you in one of the batches that was transferred to Texas?

  6. Thanks for responding Vanessa. So now I'm really confused. I was under the impression that I would have to be interviewed as well to show things like evidence of support etc... Am I off basis?

You're very welcome and no you as the USC don't have to go to an interview. Only the foreign fiancé. This will be your last final step. You will have to provide supporting documents that your fiancé either has to send to the embassy before the interview or has to bring those along to the interview. That depends on the country your fiancé is from. Every country handles things different. But you definitely don't go to an interview when you filed a K1 ;)

  7. Simple question. I've filed the I129f and I'm just curious to know where my interview will take place when the time comes. I live in San Antonio, Texas. I was curious because I couldn't find any K1 interview reviews for San Antonio. I mostly saw AOS interviews and a few naturalization interviews. Any ideas anyone? I'm curious to see K1 interview reviews from those who live in San Antonio.

    Thanks in advance everyone!

The interview will be held in the embassy of the country your foreign fiancé lives in. That's y you couldn't find an interview review for Texas

  8. They are supposed to list everything they need on the first RFE, and usually that is what they do There have been a few instances, though, when a second RFE was sent requesting something else. That is rare, though, and only happens if the adjuctator missed it the first time only to see a need for it upon a second review.

Honestly, considering the things I read about how Texas handles our files, I would NOT be surprised if something like that happened lol

  9. So we got our RFE email on July 11th and today it was already in the mail. We were in the second batch that got transferred to Texas on June 21st. As I expected they didn't like it that I forgot to say yes or no to question 2, part c in the petition regarding my fiancées criminal history. So that's an easy fix right?

If there were more issues it would have been mentioned as well right? They don't send an RFE now and later another one cuz they noticed something else is missing?

Also they sent the official RFE letter and the page of the petition itself where the question that isn't answered is marked by them. Do we fill out the RFE sheet only or do we also make the correction on the petition sheet? I don't wanna make any mistakes again

  10. I organized the petition in a binder with multiple sections that I labeled with what's in each section. Since my fiancé put one dollar too much on the check they sent it ALL back and told us to put the correct amount on the check.. And... All of our documents were taken out of the binder and just put on top of each other. Doesn't seem like they care for it

  11. Ok I've been reading in the forum a lot for about a month now (I wish I would have known about it before we filed in February!) anyways we got an RFE on July 11th. Now I'm preparing for what possibly could be the reason for the RFE. I know we didn't answer the question about his criminal background which was my fault so that could be it.

But after reading a lot of threads here it's also possible that they want more primary evidence of meeting in the past two years. I only sent copies of the plane tickets plus the itinerary from last October plus pictures and a receipt from the grocery store that was paid with my credit card (I'm the beneficiary) so I read a lot of people had to resubmit a copy of the stamps in the passport. Now I wanted to do that..and I saw that the stamp from this April is right above the stamp from October, and so covering the 2012 part. it's very light too and only seen if looked very closely. Can that be a problem?? All my other stamps are olser than 2 years. I only can submit a credit card statement that shows all the transaction from October in New York. I'm a bit worried now. Just wanna be prepared.

  12. i'm sorry but i failed to follow. how do you get to a tier 2 rep again?

my fiance had been calling uscis several times already to follow up our case status as it is near 1 year already and we still havent received a noa2. We only saw it showing that our address changed on june 15 but since then, nothing else. (and my fiance never changed his address!!!!) Some told us this means we would receive the noa 2 soon but its been almost a month and still nothing. whenever my fiance tries to ask a tier 1 to transfer him to a tier 2 to find out what is up, they only tell him they would say the same thing and have him wait further. we are so helpless.....:(

Mh we didn't have a problem with getting a tier 2 IO on the phone. If they tell you it's pointless to talk to a tier 2 cuz he would tell you the same and you'll only wait then politely tell them that you gladly will wait for an hour to hear the same thing from a tier 2 and that you don't mind waiting. Those people aren't known for being very friendly so stay persistent and insist on talking to a tier 2. But always stay friendly (I know it's hard sometimes!) I wish you the best of luck!
