  1. Hi VJ members,

    A friend of mine came to US about 5 months ago under CR1 visa and now she has 2 years green card. She has problem with her husband such as that he keeps bringing some random girls home to sleep with. She is now living at her husband's sister house.

    She wants to ask what happen if she divorces her current husband and get married to new USC person. She is awared that she has to do ROC. Will it cause any trouble for her at all? If it will, then what it is?.

    I filled the form from the Ombudsman on May 30th 2015, they said it takes 45 business days. does it really take that long ? its almost 45 days for me but there is still no updated from them. My case has not even assigned to an analysis yet. Should I worry ? And how do I contact my Congressman ? Sorry if I have too many questions.

    It is 45 business day not including weekends. You can also call Ombudsman office to ask for your submission's status. For your congressman, I assume you are living in Santa Ana, CA, hence you would go to this website https://lorettasanchez.house.gov/services, and then click on Serving you> Request Help. You will need to fill out some info and explain why you need help. You are then printing out, signing, and including any copy documents related to your I-485 such as I-485 receipt and Interview Waiver Notice letter before sending to the office address. Good luck.

    I applied for a K1 visa which was accepted and am now living in the US and have gotten married. I am now trying to fill out the next set of forms. Can someone please help as i have the following questions;

    1. I am filling out Form I-485. Do i also need to fill out I-485A? (I am confused to whether i need the additional form)

    2. I never recieved a i-94 form at the airport. I was able to access their online copy. Will a print out of that be enough?

    3. I have to provide a copy of Form I-129F. Is this the 1st page or should i provide all 9 pages?

    4. Is there a clear step by step guide for filling out Form I-485?

    5. My K1 entry visa expires on 21 July 2015. I am trying to fill out form I-485 as quickly as possible, but my spouse is currently at sea with the navy. I am still waiting on my SS number which can take a month. I am waiting on getting a military ID so I can get the rest of my vaccinations. I doubt it will, but if it came to it and my K1 visa expired before i sent out the forms, how does that affect my being in the USA?

    1) You need to fill I-485 ( I-485A is for petition before 2001, which does not apply to you).

    2) Printing your I-94 online is enough.

    3) You need to copy your I-129F approval notice, I-797, which people usually call NOA2. It has only one page.

    4) You can look on Example forms tab above.

    5) You dont need SSN to fill out I-485.

  4. My I-94 was Middle First name in the Given Name blank. However, my SSN is the same as the social security application that I filled out.

    I-485 and I-765 would not affect by this mistakes because you dont even need SSN to fill out those applications or showing the card to USCIS unless they want to see SSN at interview.

    However, I would go to SSN to correct the name if the I-94 is still valid within 14 days.

  5. Morning ,eveyone .I need some help here .I received the RFE letter this morning ,but I don't understand what the letter ask for .

    It asked for the ''supplement FORM I-693 immunizations performed by a doctor on the list of USCIS authorized physicians ,which is listed on the USCIS web site.USCIS .GOV with this request for documents .Evidence of follow up medical examination regarding the positive class B Latent TB infection ,ie:x-rays ,medical statement from the examining Dr." Is this means just a new medical FORM I-693 done by a civil surgeon without any more vaccinations?

    Then "For any and all convictions of the applicant within the UNITED STATES and abroad at any time ,the applicant MUST submit a certified copy of the following COURT records (a ) Disposition ©JUDGEMENT and SENTENCE .The applicant must also submit these court records for every alias under which he/she has been convicted.If no court records are found ,then submit a notice from the felony and misdemeanor divisions of each court ."

    I don't know what this is at all. I submitted a no crime record when I filed for AOS last year .Should I just resubmit that no crime record again for them ? I have never been sentenced at court in my life .Is this one wanting my husband court record ? But the letter has my name on it .Any advice would be appreciated :crying: :crying: :crying::crying::crying::crying:

    I think they are asking for I-693 that relates to positive TB and it could be some treatments that had been done after your surgeon marked positive TB. I am not sure whether you had completed your vaccinations. MMR, Td or TDap, Varicella, and flu shot ( depending on flu season) are required by CDC.

    Police record is weird, but can you check again whether you accidently check the criminal section in the form?

    If not, then you can submit a copy of police record from China even it had been expired. You can also go to police station in your city ( USA ) and ask for police record. However, I dont know how long will it take to obtain it.

    The automatic email said if they can help, then they will let me know within 45 days. Ombudsman contacted USCIS about 40 days later and they said it could take up another 60 days to hear back from USCIS. Indeed, my case was approved about 40 days after Ombudsman contacted USCIS. So, it is 80 days from the day I submitted the request to Ombudsman to get approved.

  9. They are ordering my card. This is awesome.

    How long does it take to get it after they send you the we are ordering your card email?

    Am I a permanent resident yet? Or is it only when I recieve it?

    I got my GC under 10 days, however, it could take longer depending on USCIS lol.

    The date of resident is the date that they approve your I-485 which will show on your GC. You are permanent resident officially when you receive it to prove your status.

  10. It was a nightmare to me. I came back to Department of Justice to ask my police record after 1 month. Surprisingly, they told me that my request was never filed in their system. Then, They told me that if I give coffee money to her, then I can get it in 3 days. So with a 50 dolllars, I got it in 3 days instead they threw my application away like last time.

    So I think my wife's I485 got approved? Wondering cause you all seem to got a different case status update. I must have missed the "Welcome notice" case status update. Anyways, it's been a long 363 days wait.

    Yes, it is an approval. They will update the status again after that which is " We registered your permanent resident status and mailed your Welcome Notice....".
