  1. I am not selfish person or dont like children, but this is horrible situation that US needs to stop it. I agree that US was allowed VietNamese people to come to US in the past. However, it does not give the reader more info why US did it. My grandpa was one of military person who worked for South VietNam that was supported by US. While US military left Vietnam around 1975, the North Vietnam took over which they punished whoever working for US at that time. They arrested my grandpa and he was in jail for 9 years. I think how long you have to live in jail depending on your military level. That is the reason why US came out with a law to let Vietnamese people to come to US. But the law only applied to who was in jail more than 3 years.

    In my opinion, US should change their law which applies to all countries rather than Mexico. Because of criminal in Honduras, etc, US will allow people to stay from illegal to legal.? If US allows illegal people to stay now, then we have to accept the new incomming people in the same country with the same reason, and it could be the whole country. They should focus on blocking the new illegal people.

  2. Hmm that is interesting. Do you know where I can find this on the USCIS website? I looked myself and the most up-to-date information I could find was from 2011 and didn't mention at 75 day benchmark.

    Most of us called after 75 days and got approved. You need to count exactly how many days after you filed because the customer service will tell you that your application is not pending more than 75 days even it is.

  3. Ok, so what makes one eligible for an interview waiver? and how many more months do we have to wait? do we just receive it in the mail right away or would there be an update online? I was just worried that they forgot about our AOS since it never changed its status from acceptance lol

    There is 50/50 chance to get interview waiver for who came to US under K-1 visa. If you are the one that gets interview waiver, then you will receive letter by mail ( no status changing online, no text or email). As far as I seen, if the case status was not changing to Testing and Interview after biometric about 2 months, then this case will be interview waiver ( not 100 % sure).

  4. I would wait the GC in hand before traveling outside of US because she has no AP card now.

    You are assuming that everything will go fine and she will receive her GC within 7-10 days. What if that is not the case such as :

    1) GC is lost on the way to your US- resident address.

    2) GC is lost on the way to her home country.

    3) GC has error like her name, dob, etc.

    I hope she will not have any problem with her GC, but there is bad scenario she might have.

  5. I think your petition is now at HCM Consulate. You can send them an email to ask whether they receive it or not.

    NVC received your case on 6/30 and the last update was 7/7 which I assumed HCM received it before/ on 7/7/2014.

    The status on ceac website should be " At NVC " and then changed to " In Transit" when they ship to HCM Consulate. The last update should be " Ready", which they receive it and stay at " Ready" for long time. The status will change to " Administrative Processing" right after interview. It might change again to " Ready" before " Issued".

    From now on, if the Status Updated Date changes, it means they either send package to your fiancee or they receive the paperwork from her, or they review her file.

  6. If you want to file I-129F ( K-1 visa), then please dont get marriage certificate in Vietnam. If the consulate knows that you get married in Vietnam, then they will deny your petition and recommend to file I-130. However, if they wont figure that you already married, then you still create a big mess at AOS stage when she arrives to US.

    The consulate does mention that they will decide whether accepting co-sponsor for K-1 at interview day in Vietnam. I had heard they accepted few cases recently.

    I assumed you came to US under K-1 visa which mean you will have 50/50 chance of getting interview waiver. As far as I see from VJ's members, you might get interview waiver if your case is still acceptance for more than 2 months after biometric. It is not 100% sure but that applies for many cases I have seen.

    I'm renewing my passport. Do I get the old one back?

    "Yes, we will return the old, cancelled passport to you. It may be sent separately from your new passport. It is a good idea to keep your old passport in a safe place as it is considered proof of your U.S. citizenship".

    I am not sure if USCIS will use that statement as a whole.
