I had another question. How do they know that Patrick is filing for the K-1 Visa? I mean we were JUST given our NOA2, our petition hasn't even made it to the NVC yet. How do they know to ask him about all this?

It looks like your CBP record may be marked now, so additional visits in the near future may well result in you being refused entry and returned to the UK.

If you decide to stay here and get married and then try to adjust status, you might find yourself in a jam, because you'll have a hard job convincing an AOS interviewer that your decision to marry was spontaneous (you've spent a lot of time here and given up your job, hence you have no real ties to the UK).

I think your best option would be to put all the papers together for a K-1 fiance visa, send them off to the service center and then return to the UK and wait out the process. From your original post, I'm assuming that you are still in LA.

As you can see from my signature, the processing time from start to finish through London is about 4 to 6 months. This is not a long time to wait, and it ensures that you do things the right way and avoid any bans. Whatever else you do, don't overstay your current visa!!

Perhaps your fiancee could visit you in the UK while you wait out the process.

Actually, it is taking a little longer than that now, especially going through the CSC or TSC. I would say that your wait will be closer to the 6 month timeline, total.

I'll check and see if I can fax the NOA2 to his workplace. He has his contract for his work which shows his proof of employment. He doesn't really have any bills. Would he be able to bring his car title or something to show that he has the auto and he has to pay yearly taxes and such? I'm not sure how strongly that ties him, but it is something isn't it? Would existing bank account help too? I mean it shows that he still has his finances in Scotland. Any other suggestions would be helpful because seriously he has no bills except for that car of his (not a car payment, just the tax).

Lucky you're going by air. If anyone is crossing the CDN/USA border through Buffalo beware of "supervisor" Gary. He will lose your return ticket home and deny that he took it from you.

Unless your destination is close to Buffalo AND your starting point between Chatham and Ottawa (highly improbably for a VWP visitor), that's really an out-of-the-way approach.

Make sure he's not going through Atlanta!!!!!!! Have almost been sent back by Officer Butler there last month.

Your NoA 2 should be enough evidence and a VERY good reason that he wants to leave the USA again to attend his interview and proof that he DOES NOT want to stay in the US illegally.

Be careful with other evidence,they've tried to use that against me last month!!!!!!

Do you think that the printed e-mail of the NOA2 will do? He's coming Saturday or Sunday and I won't have time to mail it to him.

Can you FAX it to him?

(admittedly, Kinko's and others will charge you royally to fax internationally)

I don't think he knows where to go to get a fax. Where are some places in Scotland? He's not as resourceful as I am, he'll just say he doesn't know and never think to call a place lol.

Patrick is coming for a visit soon. He's only going to stay in the US for 2 weeks or so, then he will go back. What causes the immigration officials to turn you away? We NEED this visit and I am teaching right now so I can't go. What can we do to ensure that he will not be turned away at the gates?

About how long should it take for my K-1 application to go from the CSC to the NVC? I'm just wondering because my case was approved on March 9 and I have called and they still haven't recieved it. Maybe I'm jumping the gun, but I just felt like a weel was long enough for it to be posted there already.

Thanks for all the help guys. No wonder I wasn't really getting what was being said under the pinned guide. It seemed to be talking all about the AOS. It would be nice if someone included a pinned guide about the NVC. Maybe it's really not necessary except for silly people like me since the NVC doesn't really do anything with the K-1 visa except give it a case number.

I checked the guides under the NVC heading and tried to find what I was looking for, but couldn't. I have a hard time understanding all this, so I may be asking something that was covered, but I didn't understand. When my petition arrives at the NVC are they going to send something to me? Do I need to send anything back to them?

I'm at day 76. It's feeling quite eternal here. I think the fact that my day took a rather unfortunate turn when one of my students stood up and screamed at me at the top of her lungs didn't help this feeling. I'm very bah right now.
