    Look, they can't touch you nor do they seem to understand the parameters of sponsorship. They would be liable to repay the government if you receive means-tested aid. (If the government bothered to seek repayment). They are not responsible for your rent, clothes, food, tuition, or any other "bills" so to speak. She doesn't have to support you literally. The scheme to try hurt your immigration path is futile and speaks volumes to their character. Sit back and laugh at these childish games as you distance yourself from these fools.

    Yes, the lawyer is misinformed. It happens. Even if intent is discovered AFTER the immigrant becomes an immediate relative, the AOS cannot be denied. And in the OP's case, this is irrelevant. Please let your lawyer know the precedent that USCIS follows Per Matter of Cavazos, etc.

    I think you are at your husband's mercy for lying to you and USCIS. NO ONE, I repeat, NO ONE "forgets" that they were previously married and divorced. NO ONE. No one does not know when their spouse was born. No one, when asked if they had children, does not claim children from past relationships. You may have married for love but there are lots of red flags here. Why did your husband jeopardize your relationship and immigration status like this? Look inward, not outward, for solutions.
    Honestly, if I were the Immigration Officer (IO), I would have reacted in the same way. Good luck!

    Yes. The one removing conditions is the one petitioning for the removal of those conditions. The US citizen is the spouse.
    That question 8 really is a doozy since it is the conditional resident whose fingerprints and photos will be taken. What a headache!

    Please reread your NOA letter. If states right there on the letter that you have to wait for the biometrics form and enter the number from the biometrics form.

    No, not "pro-life". Those people are PRO-BIRTH. Majority of those people don't give a single fu... eh... about what will happen to living babies.
    They only scream "GIVE BIRTH" and then walk away because the rest is not their problem.

    The rules haven't changed - they are being more strictly enforced now. Just as Trump said he would do during all of his pre-election speeches. People are now realizing he meant it. 
     
    I have to say I have no sympathy for your father. People in capped categories (F4, for example) wait years and years for an immigrant visa (which leads to a green card) to become available because the numbers are limited and then there are people who are using them as tourist visas. If your dad cannot or will not live here, what does he need a green card for anyway? I don't understand your comment that he cannot risk losing it. Why not? He never used it for its intended purpose so why should he keep it?

    The rules weren't changed...he has been acting not in accordance with them for a long time. Maybe enforcement is up, but he has been extremely fortunate to have gone that long with only minimal questioning. A green card is proof of legal permanent resident (LPR) status. It sounds like his permanent residence is not actually in the US, and as such they can revoke his LPR status.

    well if he can't afford to live in the us then he should give up his green card and just get a b2 visa. the green card is ment to let you live in the us not visit it. the rules have not changed he was never allowed to do as you described they are just being more strict with the enforcement of the rules now. he should either flip it so he spends more time in the us than out of it or plan on losing his green card at some point.

    Your father has always been in violation of his greencard then and abusing it.  Greencard is to be a permanent resident...not a temporary visitor.  If he cannot afford to live here full time it's time to go.

    I am sorry for your loss. 
     
    You should immediately file for RoC using an I-751 on the basis that your US citizen spouse is deceased. 
     
    You are required to provide evidence of a good faith marriage, and need to enclose a photocopy of a certified copy of your spouse's death certificate. 
     
    After you've been an LPR for five years (minus 90 days) you can file for citizenship.

    Generally, certain lawful permanent residents married to a U.S. citizen may file for naturalization after residing continuously in the United States for three years if immediately preceding the filing of the application: the applicant has been married to and living in a valid marital union with the same U.S. citizen spouse for all three years; 
         the U.S. spouse has been a citizen for all three years and meets all physical presence and residence requirements; and 
          the applicant meets all other naturalization requirements. OP states they were married 2 1/2 years.

    The length of the marriage is actually irrelevant if the US citizen spouse is deceased. 
     
    Even if they had been married for three years, or longer, the fact that they have passed away means that the three year filing option is no longer available. 
     
    I know because I'm in the same situation.

    Donald Trump isn’t the only one in full meltdown mode today over the latest revelations in the Russia scandal. Former Trump campaign adviser and longtime Trump friend Roger Stone, who according to the New York Times is being investigated by the FBI for having allegedly colluded with with Russian officials during the election, went nuts tonight on Twitter and began calling various female political pundits “fat” and “ugly” and worse.
    Roger Stone is one of four former Donald Trump advisers who are alleged to have been caught on a wiretap regularly colluding with Russian government representatives during the course of the campaign, along with Michael Flynn, Carter Page, and Paul Manafort. Trump went nuts this morning and randomly (and falsely) accused President Obama of having wiretapped Trump Tower. But then Roger Stone went equally nuts and began attacking pretty much every woman he could think of.
