Re-reading this thread, I think some of us are trying to answer the question “how can at least one of the parents be with the child to take care of them and not lose any more precious time with them” (per the post about how children are best gifts etc) when all OP actually wants to know is “what is the fastest we can get this child to the US because no-one is prepared to stick around and be with her if they can get a green card”.

Why on EARTH would you cancel an approved immigrant petition in the (probably futile) hope she can get a B visa? All her real ties seem to be in the US, as others have said, she is very unlikely to get a B. I suggest one of the parents gets a re-entry permit and goes home to take care of their dependent daughter until she can move permanently to the US.

It’s confusing to me why her parents would have chose to leave her in the first place given how you have described the situation. Surely at least one can stay with her till she gets her visa?

You’re going to be waiting AT LEAST five years. Possibly longer.  I honestly don’t understand why one parent can’t get a re-entry permit so that they don’t lose their green card, and look after this dependent daughter in the meantime. They can even take turns doing it. Or something, because she is not going to get to the US any time soon. Your “solution” is just wishful thinking.  You need to face the reality, which is that this kid is not going to be in the US for years, so the family of responsible adults needs to figure out how to get her appropriate care in the Philippines in the meanwhile.

I do understand your opinion and saying..  as I said, I wish I can solve it . But I think all we need is wait for more queue so F2B turn current.

It covers a lot! Being able to just fly back to France for expensive surgery or any other high-cost care is a great advantage!
I'll let you know if my mom gets selected, or me, or my brother 😉

Yep, as you said, first step is to get selected😉 If it happens, they won't have to worry about their French health insurance, they know exactly their rights!

No interference. It is obviously very low probability to be selected, but if you are the DV route will be much easier for both you and your spouse. Good luck.

Just to update the situation, I both emailed and called the embassy. I was finally able to speak to someone who assured me the situation had been brought to the attention of the head of the visa department. They also instructed me to send a notarized letter to officially request that the application be withdrawn, which I will do tomorrow.

Facial recognition software is not fooled by beards or clothes. The chances of someone having used it are small, it wasn’t up long. Don’t overthink every tiny detail of the photo like you did last time, just follow the photo instructions on the website.

For completeness, the UK has one embassy as is usual. The other locations are all consulates (or a “virtual presence”) in one instance).

Curious why elderly, retired, not-rich parents want to move to the US. Have you looked at how expensive medical care for the elderly is? As they have already retired they will not be able to do any contributions for social security /Medicare (much less max them, requires 10 years) - Medicare funds the vast majority of elderly medical expenses in the US and not having it can be financially crippling if things go wrong. Things went pretty wrong with my dad and his medical /hospital expenses are somewhere in the upper 6 figures by now, thankfully all paid by Medicare + gap insurance. He certainly didn’t have $600-700k lying around to pay it all.

Another option if more financial support from the current school is not forthcoming - if the student transfers to a college where average grades are lower than the current one, they may be luckier finding merit scholarships. Many US students follow this route of hunting merit to get funding, and although funding is always more scarce both for foreign students and transfers it might be worth looking into as a possibility if nothing else pans out.  Good luck.

It is technically, but no one ever suffers consequences when they are married to a US citizen.  Unfortunately you will be prejudiced by the many others who do this.
