What is the problem you are having and more importantly what steps did you take for the problem to arise? Unfortunately, I don't think I could help you find a solution to your issue but VJ members can benefit from your experience.

Hello everyone, I called nvc today and the rep said my case is approved! :-D
One thing I had on my mind is that I didn't get any checklist nor any "false" checklist. I'm wondering if I should've received maybe a false one? Anyone else get case complete without any checklists. Or I'm just paranoid ;-)

So I read that post but the last piece confuses me. It says
All three of the following are true:
- You filed a Form I-130 petition, for your relative - This is true in our case
- There is only one applicant on the Form I-130 petition, and - This is also true in our case
- All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive - This one confuses us, it says all your qualifying income, we have i864 for my wife and i864a for her sister filled. Again my wife just got a job, so we have her offer letter, recent paystub copy. But does this stand true to us. My wife does not has any W2 form and does not had any salary and got pension,
Therefore I'm not sure if the third one is TRUE for us. Any inputs ?
The way I interpret that is your wife's qualifying income is what you show to be within their required guidelines. In your case, your sister-in-law is being added to the AOS to show enough income (for the last 3 years). In that case, your wife can't file the i864EZ because "ALL your qualifying income" is not received by your wife alone. Her sister received part of the income that you are showing to meet the guideline. And furthermore, did your wife earn any income she earns now from her job in the 2012 tax year (or any of the 3 previous years)? Since your wife just got a job (assuming recently in 2013), it wouldn't even show in the last 3 tax years. That's more of a reason to not qualify your wife for that 3rd condition of i864EZ.Since only 2 conditons are true for you case, your wife can't file the i864EZ.I'm not an expert in this matter, so hopefully someone smarter can give you a better answer. If you don't get a satifactory answer, it's always a good idea to consult with an immigration attorney if you have any doubts.Good luck. -
SEe I sent my CR1 IN FEB the last week.. and i got Approved in March (1 month) for USCIS. They even said wait 60 days for any info and i got approved wayy quicker than that.
But then NVC got my file in like a week from uscis .. and nvc took almost a month to put my in there system.. then took like a week for them to send out a aos fee... then after i finished that.. IT took them almost a month to approve my AOS cause they where giving me this ####### about they switched aos forms and they couldnt approve mine til the got some guidelines for the new form... then i send my ds form took them about 3 weeks to check then the RFE me then it took them 1 month to finally aprove me and here i am... I called yesterday 7/15/2013 saying my case was done and im just wating for a interview scedual
Sorry for your luck with the NVC. But at least you got through the USCIS process really quickly I guess you were part of the new I864 application the USCIS released but didn't give instructions to NVC on how to process it, sucks. Oh well...it all evens out in the end..you got your case approved! Congrats.

My experience was the other way around. My USCIS i130 app took 5 months (Nov 23 - April 24) to approve. My NVC process took less than a month to get approved. Submitted AOS package on June 24 and IV package on June 28. Got approved today, July 16. All the NVC reps I talked so far have been nice. Had a couple of bad USCIS reps who refused to transfer me to Tier 2 rep. I hope you have better luck

Thanks, alos we are super confused about which form to use for i864.
Just a background information, my wife just graduated from medical school so she did not file taxes for the past 3-4 years. She just got an internship that will pay her for the next 3 years. Therefore, we asked her sister (my sister in law) to be an additional household sponsor. She provided us with tax papers and everything.
Now - (Correct me if I'm wrong) - My wife fills i864 (NOT EZ), and we are also getting i864A filled by her sister (who lives at the same address). along with her tax papers
the additional documents we are submitting are, a copy of publication from IRS (501) that states, since there was low income for my wife, and she was a student, she did not file taxes
is that correct. We are also super confused about 864, 864A or 864 EZ. Please advise
Go to this page which has the criteria for which i864 needs to used.Read through all the boxes and see which applies to you. -
I am the petitioner so I sent the AOS package as a PDF attachment from my email address. I originally sent the OPTIN email from my email address. I sent the IV package (again as a PDF attachment) from my beneficiary's email address. But I don't think it really matters if you send it from the petitioner's or the beneficiary's if you gave them both correct email addresses at the beginning of the NVC process. They should have both your addresses on file. You can also call them and ask them to make sure they have both your email addresses on file before submitting the email - if you want. I just got my case approval today (called them).
I will be going to the interview with my wife (beneficiary) so I will basically take originals (as well as a copy of the originals) of everything I submitted just in case. That includes i130, AOS package, IV package, medical results, etc. May be overkill but worst case scenario, I just bring them back with me. Hope for the best, plan for the worst.

I'm not an expert but I think you may receive a checklist. If you submitted transcripts of those returns and your amount doesn't match what you put (or didn't put) on the i864ez, then you're likely to get a checklist for it. I say this not from experience, but from what I've been reading on the forums about other people who got a checklist for this issue.

Ya, we're well aware of that, but we're hoping for one in August. In fact, it was brought to our attention by a supervisor that they are currently booking interview dates for August and we could be in that batch. Due to their incompetence, our case was delayed for a couple of weeks.

We got a PCC from our local police station and it didn't annotate CPIC but rather the 'National Criminal Record Repository' and NVC is saying they won't accept it. But their own website gives the following instructions which we meet:
Applicants may obtain a certificate of no conviction issued by any Canadian police service so long as it notes that Canadian Police Information Centre (CPIC) or the national criminal records repository was searched using the applicant's name and date of birth."

For this reason we requested a supervisor review the our PCC again because according to the Toronto Police, the PCC they issued to us is standard for immigration purposes. They said that CPIC is a database that National Criminal Record Repository uses, so their one entity.
Hey girumg, I'm interested to see how that turns out for your. My spouse also got a PCC from her local police station but didn't get it annotated for CPIC. Did you get a checklist from NVC saying they won't accept the PCC? Any update from the supervisor review? I'm afraid I might have to go through the same thing.

It means they have your paperwork in process. So wait a few days and you should be able to access the system. Check saylin's FAQs, she has a post for this message.

Hello, I am the petioner USC. I filled out and submitted the ds260 application on my wife's (the beneficiary) behalf. Now i'm ready to send the supporting scanned documents packet. Whose email address should this be sent from, mine's or my spouse's? Or does it even matter? I originally sent the optin email from my email address and of couse sent the i864 packet from my email address. So if i send the IV packet from my wife's email, would that matter?

Sorry, one more question reagarding the 864ez form. There are some sections that say "if applicable". Since I determined they don't apply to me, is it ok to leave them blank? Or do I have to put "NONE" or "N/A"? For example, the question 5, question 9, part 7, etc.

Considering I've never done taxes in the USA, I haven't a clue, I'm going off of what another respected member has told me. But KDH said she didn't send everything and her husband has an interview so I guess it would work out!
Yeah, at this point, I think I will follow KDH's advice and just sign the 1040 and try to guess dates as close as possible to what they were on the actual form that I sent to the IRS. Hopefully my 2012 tax transcript becomes available soon, so I can have that by intervew time. If they complain about the dates later on, I'll just explain the situation to them but hopefully they won't

Oh one more question (not about tax stuff though), on the 864ez form in Part 6, question 20 it says to print sponsor's name. Can I type that or does that mean print it by hand with black pen?

Also if you send the tax return you have to send everything not just the 1040, you need to send the workbooks, etc... everything you used to do the taxes. (I have asked Saylin this question and this is her answer.)
That sounds like a LOT of scanning!
Can you explain this a bit more? What do you mean by workbooks, etc? I would think they only want 1040 and W2 since if you order a transcript it doesn't include much more than what's on your 1040 and W2, right?

I don't think you would be creating the bar code sheet yourself. You get the barcode sheet from the online payment portal after paying the fee. When I paid my AOS fee, I got a link on that website that allow me print the bar code sheet. I filled out the DS-261 (similar to DS-3032) online and I suppose when my IV fee becomes available and I pay it, it will allow me to print another (or same?) bar code sheet. Anyway, hopefully someone smarter here can give you a definite answer but I hope the info I provided was of some help.

NVC just received your application this month so you will not be having an interview for a while still.
Sign your 1040 copy.
You send scanned copies anyway, it's not like they can tell.
As soon as your refund transcript becomes available, get it and bring it to interview (as you have to bring all originals to interview anyways.

My only concern with signing it now and sending it is that the 1040 also asks for a date when signed. I don't recall the exact date I put on the 1040 when I sent it. So I'm not sure what date I would put on it now. And I signed the orginal 1040 on one date and my wife signed it on another date since I emailed her the 1040 to her Canadian residence and then she sent the signed/dates papers back to me via snail mail. So if I were to sign it now and put some made up dates, there could be issues if they were to compare the copy I sent to them versus what I orignally sent to the IRS? That's basically why I'm shying away from just signing the 1040 now and sending it.
uggghhhh...why didn't I remember to make a copy after I signed it....
Hmm now I'm not sure what I should do...

I would imagine the unsigned copy would generate the checklist. How long ago did you file? I was able to order my tax transcript as soon as my return was processed. Have you checked your status on
Thank, I appreciate your input. I sent my application near the of march or beginning of april. However they sent me a letter asking to provide a certified copy of my wife's passport for the W7. Originally i had sent a notorized copy. I sent them the certified copy on june 12. Also their check status system doesn't show any status for my return yet. Same with the transcript order page. When i try to order my 2012 transcript, it basically says it's not available.
I'm thinking i'll send my i864 packet as it is right now with the unsigned 1040. If it generates a checklist then so be it. Atleast that way my i864 will be in process and just wait later on when my 2012 transcript becomes available. Then i'll send them the transcript if they generate a checklist or i'll at least have the transcript when me and my wife go for the interview. Any ceavats in that plan?

Ok so i've got a couple more questions regarding my 2012 taxes. The copy i have of my 2012 form is not signed and dated. Unfortunately, when i submitted my tax forms, i forgot to make a copy of the signed form. Would the unsigned tax form generate a checklist? Also my 2012 1040 form had along with it my foreign spouse's W7 application as well some forms for my HSA account (8889 i think). Do i need to include these forms with my 1040 form or just the 1040 is enough along with my w2?

Visa Approved - A Review of Montreal

Maybe you can answer this for me. When I went to Montreal, all the signs and everything were in French. However, in Ontario, everything generally has an English/French translation. Even the food labels. So how come there's no English translations in Montreal (or Quebec in general)? I can't remember if all the signs and things in Quebec were French only (Last time I was in Montreal/Quebec was around 5-6 years ago). Sorry, I'm not trying to be a smart ###, I actually would like to find out the reason for this.
