    its going to look like u are celebrating the marriage although a  Nikah marriage is done with IMAM, all that is required for a marriage certificate is the signing of the contract
    if u satisfy family traditions by signing the contract , it is a marriage even if u  think not registering it
    Muslims celebrate after the marriage 
    If you push this celebration,   u r tempting fate
    and by definition of a Nikah,  it is formal marriage
     
    Nowadays, it’s also common to have the Nikah ceremony either at a venue or at the bride’s house, and depending on the family, the event can become quite glamorous as people tend to mix Islamic and Western traditions.

    It absolutely impacts the k-1. In Islam, signing the marriage contract and having an Islamic marriage "ceremony" makes you married in the eyes of U.S. immigration. My husband is Muslim and we were engaged and married in Jordan, been there, done that. It does not matter if anything was registered or not. You will be married after the ceremony. Period. Don't do it.

    Preconceived intent to AOS from VWP is illegal.
     
    At POE, she must be honest with the CBP officer and the officer will deny her entry as inadmissible for being an intending immigrant without a visa that permits immigrant intent; see INA 212(a)(7)(A)(i)(I).

    if you marry in Morocco,  you must do CR1
    and even if you do not register (as you put it ) and have one thru signing the documents,  you must do CR1/  hiding something of this nature would be considered lying on your petition with a lifetime bar
     
    on the CR1 she could return to Morocco in before the last 3 months of delivery and have babies there giving them both US and Moroccan citizenship
    i don't recommend this as i stood out hospital in Agadir while niece gave birth

    I understand......but, besides the issue of fraud, adjusting status is a long process in itself.  People who adjust status can not work or leave the US for as long as 10 months after applying.  Getting a Social Security number is sometimes a lengthy process, and adjusting status is expensive. Many people don't actually receive a green card for more than a year after applying.  At this stage, I honestly don't think adjusting status is a good idea, anyway.  Stay the course......Good luck.  Hopefully, your spouse will enter the US as a legal immigrant soon.

    As the consul officer said, a traditional marriage is recognized as a valid marriage in certain cultures.  You're very lucky to have encountered such a tolerant CO who granted you a K1 visa anyway despite knowing that you had a traditional marriage.
     
    In any case, for those who have already done a traditional marriage before coming to VJ, the more appropriate advice would be to drop the K1 and pursue CR1 instead.  Married applicants are not eligible for a K1 visa.  Telling people to not disclose the traditional marriage would be condoning fraud.  That is prohibited here.

    These two points contradict each other. Not disclosing that you are married after having done a traditional marriage is lying. The better advice would be not to do any kind of marriage ceremony outside of the US; a K1 is for marrying in the US. If a traditional marriage in the home country is important, the only correct option is to apply for a spousal visa.

    Tell the neighbor to go ahead and call ICE.
    When the neighbor informs you of the time ICE is expected to arrive, wait with a jar of lemonade and extra glasses for the "all would be visitors" at the door. Some people are just miserable and they need to be called off at their bluff.

    Seems like some lying was involved. In any way visitor visa is the only visa she could try for now but based on your post, approval is u likely.
     
    One note, not sure what sort of mess was involved, but if she had listed herself as married during any of those four visa applications, it will haunt her even when you two plan to immigrate in the future using spousal visa.

    Sadly the father does not get a choice. It's time for him to step up he is their father and legal guardian. 
    With him being alive it will be next to impossible to get immigration benefits for the children even if you adopt them.

    The paperwork you submitted shows the common law marriage was dissolved but if he checked yes he was married on the 160, only a divorce decree will be sufficient. That is going to be your real issue. He can’t simply state he was never lawfully married if he checked that he was on the application.
     
    It doesn’t matter who completed the paperwork or whether they informed him. It was his application and he signed it saying the information submitted was the truth.

    Someone just has to rip those off.   Talk about slowing it down.  It will get processed.   A few years ago I went on a tour of the contractor that scanned the petitions in Phoenix.   There was a stack that had to be done by hand.  USCIS literally provides instructions.  If you tab, they go at the bottom so docs can be auto fed.

    You need to provide the urdu nikah nama, English nikah nama, and the nadra registration certificate. The English copy does not need to be signed. Just provide copies of what you have.

    It does not matter whose approval will come first. 
     
    In the US biological fathers have legal rights over stepfathers.  Since neither of them have establilshed custody, If he does not agree for the children to come and live with your sister he has the right to contest it.  
     
    Your sister will need to get a family lawyer to address this issue.  It sounds like the courts will have to decide what is in the best interest of the children.

    Who has legal custody of the children?  The biological father can file for his children, just as the biological mother can file.  Your sister needs to have her court order to show who has sole or joint custody.

    1.  You can't upload videos.
    2.  Don't send bedroom pictures.  Try to be professional.  Would you show these pictures to a potential employer?  No, then don't send them in.
    3.  You don't need weekly photos.  A picture is not worth a thousand words.  Send in max 10 pictures.  You and your wife in different settings.  Pictures from different periods in your relationship.  Print single pictures on a 8x11 page with names, dates, place, and the setting (i.e., Sam Jones (petitioner) and Sara Smith (beneficiary) visiting Paris on Nov. 11, 2019,)

    You have two separate issues here. The divorce is one thing and immigration is another. One is more in your control than the other. 
     
    Get a good divorce lawyer to help you with protecting your assets and to guide you through the process of getting divorced from him as easily and quickly as you can. Whatever his reasons for filing for divorce, whether they are true or not, has nothing to do with his immigration status. That’s for the divorce judge to rule on. Good luck with that part. 
     
    I know you think the embassy was suspicious but obviously they were not suspicious enough to deny his immigrant visa application. You were obviously convinced this was the real deal in that you moved overseas to be with him and spent many months and a few thousand dollars to get him here. You provided evidence that the marriage was genuine so you must have had something with him. At one point he was everything you wanted. 
     
    Relationships fail. People change. People turn out to be not who you thought they were. But now that he has a permanent green card there’s nothing you can do. You don’t own or control his immigration status. The best you can hope for now is that he works and supports himself and that he becomes a USC as soon as possible so that you are not sued by the government under the terms of the I-864.

    1.  Protect yourself, physically, and legally through an attorney.
    2.  Let it go, and find happiness for yourself.
     
    I don't mean to sound insensitive (I really think you likely got played), but what do you plan to report?  Remember, you have already provided a great deal of evidence showing that the marriage was genuine. Unfortunately, it sounds like he knows he is in no danger of losing his GC.  I hope you find peace and happiness.  If you have solid proof of fraud, report it.  Good Luck.

    Ok.  She's desperate to stay in the US and filed for Change of Status (COS) to tourist and F-1.  She is aware that leaving the US means abandoning her COS, and she will need another visa to come back to the US.
     
    There is NO WAY that she is going to be successful in getting a COS to tourist or F-1.  
     
    Do you love her enough to marry her and adjust her status for a green card?  Is she using you to get a green card?

    I am now totally lost. I believe AU-PAIR and Student visas are different categories. As I said to OP, something is amiss here.
    However, in my replies to OP I covered both AU-PAIR and F-1 visa categories. Nonetheless, in both, I do not understand why she may have trouble re-entering, unless she has overstayed, of course.
