Last year i have filed for a Declaration of Pressumptive Death and it was a success. The court order contains this.
She likewise said that she filed this petition for the purpose of contracting another marriage in the future considering that she is still young and still dreaming of having a family.
WHEREFORE, in view of foregoing and pursuent to the last paragraph of Article 41 of the Family code of the Philippines, a DECREE is hereby issued declaring RODOLFO VALDEZ, pressumed dead for the purpose of enabling petitioner to contract a subsiquent marriage. This is without prejudice to provisions of article 42 and 43 of the Family Code of the Philippines.
I Got the Annotated Mariage contract authenticated by the DFA and Norwegian embassy in the philippines. I resently apply for a marriage here in Norway but they did not approve the annotated MC. They requested that i will provide a Certificate of Legal capacity to Marry or a prove that i am single again and is allowed to marry again. The Philippine embassy here and the NSO cannot issue a CENOMAR because i am merried before. That even if i will get a CENOMAR (Certificate of No Marriage) i will be indicated there that i am married and that the annotated marriage contract will be the prove that my marriage is now null and void. As well as they are asking for a death cert of my ex-husband, but i can never provide that because he was pressume dead and not dead. Now i only have a very short time to get the approval to get married. What will i do about this.
Thank you so much and God bless you.
With love and prayers,
reyjilin
Are you a Filipino? If you are then, this is difficult to do as Philippine Law is conservative. And there is no way you can do in just a short time. I don't know how and what to tell you. Sorry but, you definitely need a lawyer and I guess you have to wait and postpone your plan of getting married.
Yes I am a filipino and I understand what you mean as well as thank you for your reply. The case were done in a right way but it's not recognised here. Now we will be going back to the philippines to get married. Will they question this again when i apply for an entry visa here to be reunited with then husband? I am going home first by July & i will be changing my passport name as well back to single name or will be my then husband surname. Thank you and God bless you.
with regards,
reyjilin
Your case is very compllicated. However, you are right ... best thing to do is to go home to PI and process your papers from there, because the US immigration in PI will honor your annotated MC and a copy of your presumptive death of your ex-husband. If you want to change your passport into single you can. Just be esure of what you are going to tell to the US immigration in PI because your record may be in the system. I hope this helps.

I got a call from our Congresswoman's immigration liason this morning saying that my husbands Green Card was approved. When we got home the approval notice was in the mailbox. YAY!!!!
Approved 5/7/2009.
So after 16 months of waiting we finally don't have to be jerked around by USCIS anymore!!
That is great!!!! Congratulations....

SENKA, thanks, however my passport expired ages ago and I can't renew it quickly either (Russian govt is even slower than USCIS). Screwed.
I pray that ayou receivec your green card soon.
-
Also, for those who received the stamp, did they keep and destroy the greencard? (I mean, it's expired so it's useless, but it felt weird seeing it cut up after working so hard to receive it!)
They did not ask for my green card when I had my infopass. They just asked for my passport and stamped it. So I have my old green card for me to keep.

My category is now IR1. In my conditional green card is CR2. Does the category mean something?
CR means you're a CONDITIONAL RESIDENT.
....and what does IR1 mean?
IR means you're not a conditional resident
i.e your card is fine, and Italian_in_NYC's card is screwed up.

Here is my timeline
September 2007 - jointly filed I-751 sent to VSC
November 2007 - fingerprints
August 2008 - RFE
November 2008 - got stamp in the passport
March 2009 - divorce is final
Apr 6, 2009 - divorce waiver I-751 sent to VSC
Apr 16, 2009 - interview for jointly filed I-751. The IO tells me that the rules has recently changed, now if someone files jointly but get divorce finalized before his/her I-751 interview, an IO may amend his/her case at the time of the interview and approve it. He also tells me I will receive a decision letter by mail.
Apr 16, 2009 - fingerprints
Apr 22, 2009 - divorce waiver I-751 returned by VSC because I forgot to sign the check.
Apr 30, 2009 - decision letter received. It says:
"Conditions removed as of: 4/23/2009.
Your request for the removal of the conditional basis of your permanent resident status has been approved."
Congratulations. That was very stressful, good thing you handled it. Now, enjoy and relax.

Witih these kind of reply to your RFE? You are fine.

The reason in the letter was that our petition Did not span the entire period of our marriage in sufficient detail. When reading the documents we sent them i.e. Travel documents of when we went to visit his family together (why would I take a vacation with someone I don't have a relationship with?!?!) Copy of our Auto Insurance with him listed as a named insured (he had just recently gotten his license in 2006) I sent copies of my 2007 policies, Affadvaits from my family members certifing we have an ongoing loving relationship, my pay stub claiming my status as single (only so we can have the max taxes taken out when we file for our refunds, which we included copies of our tax returns) and an old lease. The main problem we will most likely come across is we cannot provide proof except leases from we first got married in 2004. We never had joint bank account until just recently, the same with utilities they have always been in my name....
Send them the recent documents. Also send a history of your documents form the time your husband/wife was here. Make everything in detail for them to avoid asking the question WHY? Goodluck

Hello guys... we submitted our application to remove conditional status back in December 2007 but have not received a decision - it's been 16 months.
We went to USCIS Newark to get the stamp on the passport to prove legal status. We got that... but no one there could tell us what is going on.
In January 2009, we received a fingerprint request for our son - 12 months after submission of application. Our son is only 5 years old so I don't think they'd need to do FBI background check on him. I think the delay was because they did not have our son's fingerprint. I hope it won't take another 12 months from January 2009.
Anyway, the officer there told us that my wife can apply for citizenship even if she doesn't have her permanent green card. The only problem with this is that it will further delay the green card process. Of course, if she gets the citizenship then they'll save money on not having to produce her green card, so they want the green card to wait for citizenship result.
Should I contact my senator? How do you do this?
Thank you!
DNALERI
I am on the same boat with you, until now we are still waiting. I called USCIS but the woman said that there is no 60 days yet since USCIS received our RFE. I don't understand
