    Disease organisms don't care about your religious beliefs, and prayer won't help you avoid potentially carrying a disease to someone who can't be vaccinated for legitimate medical reasons like a compromised immune system. I hope you understand why you can't refuse to be vaccinated for "moral" reasons, unless your morality stretches to ignoring sensible public health measures. What next, morally object to washing your hands after using the toilet?
    I'm sorry if I sound angry. I am angry. I lost a friend who was taking immunosuppressant drugs for rheumatoid arthritis to a rare complication of measles. Before this crazy vaccination resistance started, measles was practically eradicated in her town.

    Four pounds? Ridiculous and false. I know you are proud of yourself for having overwhelmed the USCIS with your generosity (and what else did you send, a box of rocks?), but that is not true for every submission. Yes, the OP needs to submit as much information as they can. No, you should not go about scaring people to death who really did send all the information they could. Because we were new at this and confused, we sent in our I-130 without one single piece of supporting information. To our complete surprise, it was approved; we surely expected an RFE if not an outright denial.
    Yes, OP, do make triple sure to send in a complete file and take time to do your research and provide everything you can; the Philippines is a difficult nation to immigrate from.

    Folks, I wanted to clear up some confusion about how a USC must file taxes with a non-resident alien spouse. I just paid a CPA a lot of money to do my taxes, and part of the reason he was so expensive was he knew what he was about when it came to immigrant issues. I learned the following things:
    0. You may not file married for tax year 2012 if you were unmarried on December 31, 2012, even if you got your final divorce decree the day before.
    1. You MUST file married if you are married on December 31, 2012. Don't believe H&R Block! There is ONE exception, according to the IRS: if the NRA (non-resident alien) has not lived or made income in the US for the tax year, AND the USC (citizen/permanent resident/resident alien) has dependents (children, parents, others they will claim on their tax forms), the USC is permitted to file as Head of Household, even though it is technically a single status. If you think this applies to you, go to the IRS site and do your research and make sure you qualify. Filing as Single without Head of Household will not apply to anyone who is married.
    2. Married filing joint will usually reduce your tax burden or get you a bigger refund. If you do this, and your NRA spouse does not have a tax ID number (SSN or ITIN), then you must submit a W-7 with appropriate documentation on paper along with your paper tax filing to the special Austin address for ITIN filings. The NRA will be treated as a resident for tax purposes and write a letter to that effect to attach to the tax filing (PM me if you want the wording my CPA used). Their income will fall under a Foreign Income Exclusion of 95K USD for year 2012, meaning that they will be taxed on all income over that amount they made overseas, as well as on all their US income. Documentation for the W-7 must be ORIGINAL or a copy CERTIFIED BY THE ISSUING AGENCY, not certified by a notary public. UK residents may legally hold two passports at the same time, so it may be worth getting one and sending the other. Dual citizens may send the passport that they aren't using for Immigration. Others should examine the instructions for the W-7 to see what documentation is acceptable.
    3. Use married filing separately if you don't qualify for single head of household and you don't want to bother with an ITIN, or if other circumstances make it necessary for you to file separately. This is the easiest. Put your own information as if you were filing taxes by yourself. You must do two things: add your spouse's name in the appropriate field, and write NRA in the field for the SSN/ITIN. Be careful because there are many circumstances that may make it necessary for the NRA to also file a US tax return in their own right: substantial presence in the US, work or doing business in the US, investment or other income in the US, providing more than half the support for a US dependent, and so forth. The NRA will still need to file taxes in their home country if required.

    as to 'expiration date of visa' - apologies - that's a single use visa. now that you have an endorsement stamp, you should learn a bit more about I-551 documents and why you have one in your hands already with a 1 year validity.

    DirtyHarry, you can add your wife as a non-driver to your car insurance, or have her added to your lease, or add her to your other insurance policies, or show that she is listed as your spouse on your personnel records at work. You can show receipts for things that you bought her. You can show copies of plane tickets and itineraries for visits you made to her and that she made to you. You have more than you think.

    Hey, don't worry about it. I had my interview today and everything went great and I was approved. After I read what you said about your online status I checked mine to see what it says and it also says: "Administrative Processing".. though I'm sure I am NOT in AP. I was very clearly told I was approved and to expect the visa at my house within the next 7 days. I'm sure your husband was approved too, don't worry

    On the I-130, you will specify every name that you have used up to that point. They know about people getting married and will understand that your birth certificate is in your maiden name and your marriage certificate is proof of your new name.
    Change your name when you want to. Arrange your employer tax withholding the way you want to. The important thing is that the US citizen files married beginning the tax year you were married in (since this is 2013, you will file married for 2013). Whether you choose joint or separate filing depends on things like whether the non-citizen made any money or spent significant time in the US.
    It's not naive. This process would confuse a guru. Keep asking.

    I think the overstay law is quite clear, both in general terms and with regards to this specific case.
    Try arguing with ICE about whether an overstay is or is not subject to detention and deportation at any time and see where that gets you.
    This isn't directly related to the OP's issue, but we should try to have accurate information on this site wherever possible, and posters stating that overstays are not considered illegally present are factually in error.

    Hey Bumble. I don't think you have as much to worry about as you think. They don't just arrest someone on someone's say-so. They do an investigation. It is not difficult to tell when someone has in-laws from hell.
    There's only one thing that concerns me, and that is that she could be accused of coming in to marry and stay to adjust status. This is illegal and if there is an investigation it might look bad. It might be better for her to fly back to South Africa before her visa expires and before there is an investigation to show that she did not have immigrant intent when she entered. Then you will file an I-130. It takes a while but it is more sure. You might also get a lot of friends and respected people (engineers, clergymen, important people you may know, your landlord maybe) to write affidavits in support of your relationship. You CAN add her to your lease since you are married. I did so with my foreign spouse no problem and I also live in Texas. You can add her to your car insurance as a non-driver: call them, they'll do it. Go to a bank and start a joint bank account immediately. They can and will do it; my husband and I did it through Wells Fargo. There are things you can do. Just do not risk her being deported. It could result in a permanent ban.
    I do absolutely think you should get a good lawyer familiar with immigration issues. ASK them if they have dealt with a case of malicious reporting before.

    I hate to break it to you, but there is nothing "Christian" about your family... No Christian would ever act like that towards another human being, let alone black mail them.
    On a related note, you can apply for a copy of your birth certificate as if you lost it.
