    You do realize that until a year ago USC living overseas could file with the embassy in that country and get a visa for their spouse in as little as 1-2 months? USCIS changed that and now all files are sent to the states for adjudication. Maybe that's why.
    Whatever the reason it's really the least thing you should be worried and/or complaining about. What is it your business why people get approved faster, concentrate on your own petition b/c trust me these bad vibes aren't going to get you anywhere. Karma's a B!&%h, don't ever forget that.

    I agree that the whole mess started when Nola changed her address to a US one (and then the idiot USCIS rep went and changed her husband's address too) but there is one huge point that you're wrong about capri and that's this:
    If the form had been left alone it would have stayed at NBC to be processed it would NOT have been sent to London. The only time that I-130s are being processed overseas is if the petitioner is lucky enough to reside in a country where USCIS has a field office. Meaning there is no way that Nola could have her case be adjudicated unless she actually lived in London for the past 6 months and can prove it.
    The file also would NOT have been sent to Hartford to be processed since, as stated by the Hartford office, they don't have jurisdiction over it since the petitioner does not live in the boundaries of the Hartford office.
    My whole point out of all of this is that the reason that London is taking a hand in this case is b/c it's been so screwed up that SOMEONE needs to take care of it and right now they are the closest USCIS office to where the case physically is (Denmark). So I don't think any of the normal rules apply. From their email it seems that the London office is VERY aware of the cluster f**k that is this case and will do everything in their power to get it processed, I don't think they will nitpick about any details from here on out!

    AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAND we have Case and Invoice ID Numbers!!! yaaaaaaay!!
    Now I just need to hope and pray that my taxes have been processed on Monday! Which is what I'm worried about, I called the IRS a couple of days ago and they said that they still haven't processed it and that they need 4-6 weeks, maybe longer. What would happen if I sent in my returns with the AOS before the IRS finished processing? Keep in mind that financially we're totally relying on my father as joint sponsor since I'm overseas and therefore don't have any income that can be used to sponsor. Has anyone come across this problem?

    If you've got a decent internet connection try Skype. I pay about $5 a month to get unlimited minutes to call any US phone line from my computer. You can subscribe for minutes for less money if you don't need unlimited minutes. It's very clear and very easy to use, I subscribed specifically for this process, international calling is toooo expensive!

    Well, it DOES help that I'm not working right now and get to sit at home and research the **** out of this process and whine at him to get his butt moving! You'd think he'd be interested in moving quick too since if he doesn't have his visa by August I'll be leaving anyway with our son and the new baby! *sigh* Is it just me or do women just do better with this kind of detailed stuff? (no offense to the guys on here )

    My comment wasn’t meant as a dig at anyone. I think the visa process is slow and painful, and I understand the need to vent sometimes.
    However, you’ve posted many times about how much you hate Denmark.
    Please don’t take this as an attack...it’s just - if my husband hated my home country (USA) as much as you seem to dislike his, I would feel crushed, as it’s a part of me, it’s where my family are, and it’s part of what made me who I am. But maybe he doesn’t care and hates it just as much, so what do I know.
    Anyway, I wish you a speedy approval.

    Not all. Not even most I don't think. The simple answer to that question is "we don't know" There are a lot of cases on here where the USC is in the US and the beneficiary abroad and yet their case never seems to have left NBC. So I'm not sure what the criteria is that would keep the file at NBC instead of transferring to a field office, but there's seems to be one.

    I think that once you've explained the situation to the CO and showed him the different birth certificates and translations, it'll be understood. This isn't such a bad thing, people here in the middle east don't always have accurate records and while it's not normal, it's also not unheard of.
    My first reaction when reading your thread yesterday was that you should follow your lawyers advice. But now that you've explained it more, there's really no reason not to be honest. I'd wait and see how the interview goes though, don't be nervous and immediately launch into the explanation right at the beginning of the interview, wait until there's an opening; or even just wait until the end of the interview and mention it.

    Remember that VisaJourney is here to help, that also includes moral support and allowing members to vent their frustrations. Moral support throughout this process can be very benificial, the VJ comunity allows us to relate/connect and help each other out. So please remember that the person making their post might have had a bad day. Their thread/tittle may not have come out right, allow them time to clear things up or in this case edit the tittle. If you feel you cannot offer advice/support/or words of wisdom it is better to not post anything at all.

    I have learned a valuable lesson after having read the book "The Millionaire Next Door" -- twice, albeit rather late in life: it doesn't matter how much money you make; what matters is how much money you have left after you paid the bills. Smart people, people who got smart earlier than I put away 10 to 15% of their income since they had their first paper route. These guys now own several homes and don't have to worry about not being able to survive when they retire.
    In contrast, there are people who make silly money, yet they all p*ss it away like there's no end to it. Those who show up with a brand new car and a shiny gold watch or a big rock on their finger are those who often spend more than they make, and they are in debt over the eyeballs.
    I make good money, yet with a wife who doesn't work and a daughter in college, unfortunately I spend more money than I'd like to, but I am working on spending even less and putting away more into my retirement account.
    Now to the interesting part. I have a friend who's 58, although he looks 10 years younger. He worked for decades for a local newspaper and is as thrifty a guy as it gets. He was once married to a girl from Thailand and she outright told him that she was poor in Thailand and wouldn't want to be poor in America. She wanted to enjoy life, have a nice car, do things that cost money. So eventually they got divorced, she found another guy, this time a rather wealthy fellow, and she's as happy as it gets.
    My friend, however, the thrifty one, quit his job in 2008 when the paper moved to a town about 20 miles away. He never looked for another job. He had rented a fabulous house in a fabulous location at only $1,000 per month, but when the owners' heirs wanted to raise the rent, he purchased a midtown home close to mine for $330K, cash. All cash. He has still about 300K in savings invested, and he lives off the interest. He has a car, but doesn't drive it very often. He rides his 3 bicycles almost ever day, and he walks about 3,000 miles a year. In fact, he's my walking buddy. He picks me up 3 times a week, and we do some power walking for an hour and a half, and when I am ready to vomit and hop in the shower, he walks a few hours more, sometimes a total of 6 hours a day. Just because. He purchases his groceries at the dollars store, clothing mostly at the thrift store, and he's extremely happy with his life. When I first met him and he told me that he lives off $700 a month, I tough he was kidding, as that doesn't even cover my grocery bill. Not even close. But it's true.
    We all have different ways of enjoying life, and while he's as extreme as the guy who buys a new car every year, there must be a golden middle somewhere. The secret is to find a spouse who's on the same page, and apparently, that's not the case with the O.P.

    Ok according to your original post you're describing that your husband has a job and makes enough to meet the poverty guideline but you're getting a co-sponsor b/c the tax return don't reflect that? If this is true, then you don't need a co-sponsor. It's current income that matters, not past income. If your husband has been working for a good amount of time at his job and his annual salary meets the guidelines then you don't need your father in law to co-sponsor.

    If anything I can only offer one piece of advice.
    Immigration process = time, money and time away from those we love. It sucks but it's what we go through to be with the people we love. The thing that helped me get through a year of waiting after we were married (CR-1 Visa) was realizing it was 1 year of the rest of my life it put things into perspective in terms of the sacrifices we were making.
    You're not alone in this frustration but what can you do? Blaming Obama isn't really the way to go about things though. I realize it was perhaps a knee jerk reaction to what you perceive to be a longer waiting time (and perhaps you do have to wait that long). But trust me it's not just 'one' person who is to 'blame' if you do have to wait longer. I applaud Obama and others for passing what they did on the illegal immigrants children. Do I have sympathy for Illegal immigrants who knowingly broke the law? NO. But I do for those who by no choice of their own was essentially forced/ brought into this country unknowingly illegal. I can't blame them they're not at fault. It's those who all of those years ago (and still now) came here illegally that ruin it for those of use who come here honestly and put our time in.
    In the mean time I'd look to plan visits to your fiance (if you can or vis versa). I know it's more money but at least it will help make up for the time apart.
    I'm sorry you're having a hard time with this. I just would try to redirect just who you're angry at. I'd be more or less upset with the situation. But in the end it is what it is and many were in the same shoes you were in and are in the same shoes.

    Not ITIN, my son's SSN will take 6 months. If I had that then I could file as Head of Household, no questions asked. But I don't know if I even have 3 months for the ITIN. I don't want to get caught waiting for tax transcripts when it's time to submit AOS packet.
    To everyone else: I don't really see why I would get in trouble for filing as single when I could get a better return if I was filing under any other status. Who's going to punish me for NOT taking tax breaks that I might be entitled to? The fact of the matter is that I've tried all the different filing statuses and my return is the same exact thing each time. Not only that, but I will amend everything to Head of Household status once I move back home and am able to get my son's SSN in a timely manner. Won't make a difference in the numbers thought. My return will stay the same.
    KDH if I file for ITIN with 2012 return can I do efile for 2012 and then paper file for 2010 and 2011? If I'm going to have to paper file all three years I might as well start working on 2012 so that I can send them all at once!

    You know, the reason coolguy thinks this is probably b/c most people haven't changed their service center in their timeline. The way a lot of us check what's going on with our service center is by checking Igor's List here: http://www.visajourney.com/timeline/monthly_filers.php?form=2&visa=3&scenter=4&option=3&sortby=2 if you scroll down to August you'll see that all August filers have been approved except for abezyo! So change the service center on your timelines, it'll give everyone a better picture of what's going on!

    Half of this information is wrong.
    Pictures do not need to be dated, you need to add a caption for each one stating the date, place, and names of people in the picture.
    Tax returns are needed late for the Affidavit of support NOT the I-130 petition
    Same with letter of employment - needed for AOS not I-130
    You do not need to notarize any documents.
    An evolution of relationship letter is good to have, but not a must.
    OP: Read the guides, there's lots of good information and ideas there.

    The hard copy is not important it doesn't really matter if you receive it as long as you got the receipt number. The person who filed the I-130 will receive the hard copy in the states.

    Is it wise to relocate? No. I mean unless you have plenty of money in the bank or will have continuous income or have parents willing to support you and your husband when you eventually move back to the states. If you can afford an extended visit, go for it. If you can afford a short visit only then do that. Keep in mind that once you get back to the states (if you relocate) things will be difficult in the beginning. You will have a husband to support before he can find work, you will have yourself to support, you will have to find a place to stay, etc. This all requires income of some kind. Don't put yourself in an awful position just because you're feeling emotional right now. I understand how you must feel but you have to use your head not your heart right now.

    Your evidence is more than enough, I'd send the petition in asap so that you can try to take advantage of maybe getting fast processing from NBC!

    He's saying he thinks USCIS has made a mistake and labelled your file as one that is adjusting their status instead of one that is petitioning for a visa. So therefore your case got sent to NRC instead of NVC. So you need to call USCIS and get transferred to an ISO (not the first person who answers the phone) and get this straightened out.
    Read carefully and you'll get all the information you need.
