  1. Hi!

    My Father-in-Law's application was approved by the NVC and we believe it's in the queue to be sent to the consulate in Manila for appointment scheduling. NVC informed her mid April that this was the next step. So far, radio silence.

     

    So, I have a few questions that I hope you can help us with!

     

    First, what is a typical, current, timeline from NVC approval to scheduling?

     

    Second, I remember scheduling my wife's appointment after receiving the MNL case number to speed up the process from the typical scheduling timeline. We've created an account to TRY, but so far no luck. The message keeps saying there is no case# currently at the consulate. Is this "work a around" still a thing or do we HAVE to wait for them to schedule?

     

    Third, I know they do not send out any "snail mail" to us regarding the scheduling, but do they send both the applicant and petitioner an email saying they scheduled the interview appointment?

     

    Any help is greatly appreciated!

  2. Are you asking how long it takes for them to update your status about receiving the RFE and reviewing? It only took a week after they received our response to change the online status to Evidence being reviewed. It took almost 4 months to finally schedule an interview. With their new case status online check they may not have a Evidence Under Review status anymore and it may go straight to interview to be scheduled OR you may not even have an interview. Good luck!

  3. I am filling out the I-485 for a green card for my wife. We were married last year using a K-1 Visa here in the US.

    On the I-485 form page 2 under "Part 3" they ask for "Marital Status" Would the answer be based on when the K-1 Visa was issued or the current status when filing the I-485 ?

    I am confused because in the filled out "I-485 example form" from this site, the box under "Marital Status" is checked as "Married" and the example person entered the US on a K-1 Visa.

    I don't want to make a mistake here......

  4. Seems that the folks at USCIS don't know what a tax transcript it...send in the 1040 and W2 from the most recent year...unless the instructions say for the last three years. I think that the I-864 wants 3 years...the I-134 (not applicable to you) is only the most recent.

    Thanks for the reply! I agree with you. I think I'll just send the 1040s and W2s just for CYA. Makes me wonder if they lost my tax info. Oh well! Thanks again!

  5. Someone can correct me, but I think affidavit of support is more about your current income.

    So you need to send in proof for that...such as...

    Current job's Paycheck stubs, and employment letter with your salary stated.

    But I think they also ask for most recent year's (2013) tax filing (not tax transcript) and W2s.

    If you don't meet the 125% guideline, then you will have to submit

    additional asset info to make up any income shortage or get a co-sponsor.

    The bad news is you got RFE, but on the bright side,

    this is not like the K1 visa delay that keeps your fiancée away longer,

    you have your spouse next to you.

    Thanks for the reply! We are through with the visa process thank GOD. Now the demon is Adjustment of Status :) it was an RFE for my wife's status adjustment :)

  6. So, I am one of the silly people who sent my wife's AOS packets in without proof of current income and received the RFE today. Yup, I messed up and I'm getting my employment letters together as we speak. :)

    So my questions are:

    The RFE also said to send in tax documentation for recent tax year, W2s ,etc. I sent in tax transcripts I printed off the IRS website for the last 3 tax years. Should I still send in my recent tax info, 1040s and W2s, or is the current employment information enough to satisfy what they are asking for? As in the RFE letter is generic and this request pops up when they need proof of current income. May seem like a DUH question but I want to make sure I am 100% confident in what I send them in. I thought transcripts were just fine or does it make a difference they were printed off the IRS website?

    Also, the RFE said I do not make 125% of the poverty guidelines. This isn't true either as I am well over it. Is this also because i did not provide proof of current income? I read another post from earlier this week asking the same question BUT like I said I don't want to mess anything up.

  7. Hi Daleandlorelie! Unfortunately, yes, she needs an NBI Clearance for her US Embassy interview.

    It is best that she settles this the soonest with her ex and better yet if they can settle this amicably without going through the court procedure, which might take years to get processed. I am actually not sure how quick the NBI updates their database to include new people with police records (Philippines National Police and NBI are separate entity here). But if her ex reported this through NBI directly, then she will get a 'hit" in her name.

    For her clearance, it has to show: NO DEROGATORY RECORD or NO CRIMINAL RECORD or NO PENDING CASE (Check out item d) and her clearance purpose should indicate:Visa USA.

    Hope this helps.

    NO CRIMINAL RECORD and NO CASE PENDING require a letter of explanation from the NBI. NO RECORD ON FILE and NO DEROGATORY RECORD do not require a letter of explaination.

  8. Maybe your case is just taking a little longer to review for some UNKNOWN reason. NOBODY knows what goes on inside the IV Dept at USEM. Even when you think you understand their procedures, they throw you a curveball. I'm sure you will be fine, just take a deep breath and relax. They kept the passport and no 221(g) form was given. Those are two good signs.

  9. Hi guys. Another question here. My fiance forwarded me both a hard copy and soft copy of his Form 1040 for the years 2010, 2011 and 2012. However, there is a grayed text in caps in the middle of the forms saying "COPY ONLY DO NOT FILE". Is this an acceptable format for my USEM interview? unsure.png Or is this really how a Form 1040 copy looks like for all USC taxpayers? innocent.gif

  10. Thanks to the factors in our lives, my wife and I were very fortunate to meet up with Bumbero and his beautiful fiancée over here in the PI before they fly home. It was really an honor to meet you guys and share your happiness. Having friends who have made the same journey is really unique

    It was so cute to hear how she's more nervous about the flight home than the rest of the VJ process. I know she will do just fine.

    We had a great time with you guys as well! It was nice for Rossel to meet Roxy and hear her first hand experience of immigration. It took away some of the nervousness. So I'm thankful for that as well. Those four hours flew by and we had some awesome conversations.

    Keep us posted on your plans and hopefully we can do it all over again in the Seattle area when I will feel a little better! Take care and enjoy your time in the PI!!
