    Possibly (indirectly) but it can be complicated. As mentioned above, through the grandchild's parent so they can come as a derivative assuming the parent is alive. Sort of in the same situation regarding your question, my mum is a US citizen, petitioned for me and my brother before she became a citizen (f2b) but she recently became a citizen. Unfortunately my widower brother died leaving 2 lovely daughters while we were almost there (at NVC and DQ). Crushed our hearts knowing his daughters US dream may also be over. Even thought going the adoption route which i understand is a possibility but really really complicated (navigating through adoption and immigration law). So to your question, i guess its possible but will be very complex.

    How does a nephew qualify for an immigrant visa???  Without a qualified petitioner, you can't do much.

    you cannot sponsor extended family whether you are a citizen or green card holder. she can apply for student visa on her own. Visa will be granted based on merits of the application and financial resources ( you can play a role there )

    She can apply for a student visa (you will play no part in this - the visa will be granted based on her own merits). But one of the requirements of a student visa is no immigration intent. It’s for students who plan to return their home country once the studies are complete. 
     
    I would recommend she trains and qualifies as a nurse in her home country and then  looks into an EB-3 visa in the future. See it as a long-term goal.

    Sorry, no one can file for a niece.  There is no path to a green card through her uncle.

    She's an adult.  You can't be the legal guardians for an adult.  Furthermore, legal guardianship would not qualify her for any immigrant benefits such as living, working, or going to school in the US.
     
    She can get a student visa if she is accepted by a US college.  She would need to show she or her family is capable for paying international student tuition and living expenses (living with a relative does not reduce the amount for living expenses).  She would also need to show a legitimate educational path towards a degree and show a foreign home that she intends to return to upon completion of her education and that she is using her schooling as a pretext to later immigrate to the US.   An F1 student visa is a non-immigrant visa, so she has to overcome the legal presumption that all non-immigrant visa applicants intend to immigrate by showing ties to her home country to indicate she would leave after finishing her education.

    It's always useful to have another passport, for travel purposes. 
    He may also be required to renew passport if he ever needs to travel to his home country.

    The passport doesn't need to be valid, but you will need it for future travel. Remember that it's taking some time to get US citizenship. He wont be able to leave for any reason the US with just a green card.

    Unless he has travel plans then he doesn’t need a passport. It’s useful to renew it in case he needs to travel somewhere urgently (for work or a family emergency).

    Hi all! 
    Just wanted to stop by and say, don't lose heart! We've been waiting for GC since July of last year, and two weeks ago, we got a letter in the mail saying the card was on its way. Two days later, it arrived! We were approved one day after the anniversary of my beloved's arrival in the US. We can do this! Continuing to hold us all in prayer and in Light during this LONG waiting process.

    Just wanted to stop by and say, don't lose heart! We've been waiting for GC since July of last year, and two weeks ago, we got a letter in the mail saying the card was on its way. Two days later, it arrived! We were approved one day after the anniversary of my beloved's arrival in the US. We can do this! Continuing to hold us all in prayer and in Light during this LONG waiting process.

    Oo! Thanks all. I guess I didn't think it through that way.  I wasn't sure we had to change our residency right away if we moved because lots of people from MN live in Fargo and keep their Minnesota plates and driver's licenses. I already filed the AR-11 when we moved, so that is taken care of. So what I'm hearing ya'll say is we need to:
    1. Change our address on EVERYTHING and our residency to reflect our move to North Dakota
    2. Wait three months to be eligible for citizenship. 
     
    Thanks for thinking this through with me! My brain is a little scrambled from the move!

    CPT is the way to go. However, CPT does not necessarily affect OPT. A friend of mine had similar opportunity and the response she got from the ISO is and I quote "Students who have completed 12 or more months of full-time CPT are ineligible for OPT.  Part-time CPT or CPT which totals less than 12 months does not affect OPT." CPT is much simpler than OPT and do not require an EAD card (I interned at a national company and I-20 with CPT is all they need). However, her school might have concerns about working on an internship while being a full time student, but that really depends on the school.

    I just called and was allowed to file a request on my missing ASC Bio metrics (I called on 9/1 and was not given option to do so). It's very frustrating to not have tracking on this! I know there are waits on everything, but anxiety goes up when you aren't sure if they letter was lost in the mail or just delayed. Hoping I get the letter soon!

    I am waiting too. Received my NOA1 at the end of July. I recently called and asked them to open an investigation on my missing letter. I don't know if it helps or not, but I figure at least there is a history of me asking about the letter in case it got lost in the mail and I miss the appointment date.

    Probably not, if it is a position this is not normally paid may pass muster.

    It really depends on your univeristy and the exact type of internship/volunteer work. My university required us to talk to the international advisors before we accepted to do any kind of work, they are there to help you and they can tell you if an OPT will be necessary.
     
    I did an unpaid internship during my F-1 but it was very unofficial, I wasn't considered an employee, I was merely shadowing people around to learn about what they were doing. There is no paper trail that indicates I was there at all. I also volunteered for marathons and some events, but I never went through any HR process for any of this.
     
    If you get an internship in a large company, they process you like an employee and then you'd need an EAD regardless of pay.

    I agree. She cannot do anything without asking her international advisor.
     
    I think she cannot do the internship even if it is unpaid because if this is a serious company, she will still have to go through HR for liability issues, and they could ask her to do an i-9. Basically, not getting paid does not mean she is not an employee. 
     
    Moreover, for an F-1 you have to be a full-time student and there are restrictions to the amount of hours you can work. You can work in campus without any paperwork. But to work off-campus she would have to get CPT (which is like OPT but before graduation), but the time on CPT is taken from her OPT time. So basically, it is not a good idea to take time out of OPT.

    It depends. This is a question for the university's DSO in the international students office. She should already know these people who are there to assist international students on problems and being successful in their studies.

    No, the i-20 is all the same. The issue is that the "updated" i-20 will reflect she graduated while the current i-20 says she is a student. 
     
    She won't have to go back to India for a new F-1 because it is all the same i-20 in the sense that it is the same SEVIS number/ academic program.

    What matters is the i-20, not the F1 stamp.
     
    The i-20 is not renewed at the embassy. The i-20 is extended by the university. She has to go to the office of international students and get an appointment with her advisor. They take care of all that.
     
    The reason why it expires May 2018 is because that your friend graduates May 2018. Then, they do the OPT paperwork and she gets a new i-20 changes once she graduates. But it is perfect that the F-1 does not expire until August 2019 because it means she can have OPT and leave/get back to the US with the F-1 stamp.
     
    Basically, she does not have to go back to her country. Everything will be done in the U.S.
