Hawaii1 got a reaction from Dan&Loren in Sputum Test at SLMC
For those of you who are getting a Philippine immigrant visa from your spouse...be aware...SLMC is really cracking down on x-rays and making a lot of spouse's go through sputum culture testing (which takes 2 MONTHS to get the results back).  My wife just went in for her physical at SLMC yesterday (she had a visa interview appointment with the U.S. Embassy scheduled for 21 Sep 2020).  They said they saw "some thickening on the lining of one of her lungs" .....whatever that means!  She has no symptoms at all....no coughing, fever, wait gain, etc, etc that indicates TB.  She has had many x-rays done over the past couple of years....with no issues.  Now she must go in for the next 3 days and do sputum testing....then wait 8 weeks for the results to come back.  I will be cancelling her visa interview appointment today.

She saw "several" people yesterday with the same story at St Luke's.  These tests are to detect any bacteria in the lungs... (to include COVID-19)....not just TB  The doctor at SLMC indicated  yesterday that they were just concerned about TB....but i think the U.S. Embassy is telling SLMC to do this to slow down immigrants from going from Manila to the US because of COVID-19...and using the "we are just focusing on detecting TB" as an excuse.

I do not need to file with USCIS or NVC...I must go directly to the U.S. Embassy in Manila (per NVC guidance).  Since he was on my wife's original immigrant visa petition as her son (DS Form 260)  which was approved and issued to my wife by USEM, and he is under the age of 18, I can use the Follow-On To Join benefit provisions.  I just don't know what forms and procedures the US Embassy in Manila is using.

Very interesting!  I was not aware of this change.  I understand the logic to change from "Administrative Processing" because of 221g issues....but using the term "Refused" is almost the same as "Denied"....it gives the impression to the applicant that the Embassy needs something to process the visa or something happened during the interview where the CO "refuses" the applicant's visa.....which, in my case, and the case of many others...is not accurate.  If the CO indicates that he/she will be "recommending approval"....which is what was told to my wife....then they should use  better term ("pending processing"??)......

Thanks for sending to me.....now I know why my status is "Refused".....even though, in reality, its not.

Ok folks.....update on my case....yesterday, my wife's visa CEAC status changed from "Read" to "Refused"....I was expecting it to go to "Issued".  I really don't understand what the U.S. Embassy in Manila is doing.  On 16 Dec, case went from "Refused" to "Ready:"(10 days after my wife's interview on 7 Dec), then from "Ready" back to "Refused" yesterday. Ugggggg!!!!!!!!!!!!!  Crazy!!!!!!!!!

If your wife goes to the visa interview without 2019 tax transcripts, she will get  221g letter from them and her visa will be put on "hold" until they receive that transcript.  As soon as your 2019 tax return is processed, you will be able to download your 2019 tax return transcript from their (IRS) website...then submit that to the Embassy.  See if you can get some help from and IRS Tax Advocate....I did that and they helped me a lot.

Hawaii1 got a reaction from Chancy in Advisory of Marriage Needed?
To All - I just spoke to the U.S Embassy Manila folks....a Advisory of Marriage for the US born petitioner is NOT required.  CFOs may be asking the beneficiaries during their interviews if they have one....nd they will accept it, however, they will not be given a 221g if they don't have (since it is not a mandatory requirement based on their documents checklist).

Hawaii1 got a reaction from BlinkerFluid in Is NVC Working?
I am sorry...but I disagree.  For them to not move forward in 2 weeks in processing/reviewing documents is not unrealistic or normal.  NVC has gone from processing/reviewing documents from just over 1 month in Jan/Feb  to almost 3 months now...which means that something is going on at NVC (or NOT going on)...especially given the fact that all of these reviews can be done virtually by NVC personnel.
