Thank you Ontarkie! Yeah I think he may have just gotten confused while he was typing up stuff. Because the interviewer even told us he didnt think we would have any problem getting a waiver with just the 2 summary offences. On my husbands police check and on the court records it is very clear he was charged with Theft Under $5000, summary offence.
I will just keep on bugging Montreal (wonder if we can just walk back up there or if they would turn us away).

We do not have a lawyer, but I am returning to Minnesota here in the next 2 weeks. I do have signifigant hardship arguments so I know his approval will not be an issue when it comes to that and even the interviewer said with just his 2 convictions that were summary convictions from 11 and 12 years ago we should be fine. I will just keep bugging Montreal to have them corerct things before we file. We cant file right away anyway because of the costs

just on a side note, not making any excuses, it was a joyride it is clearly stated in the court documents as that. But the charge was theft. I'm not disputing that. When bothers me is in the report the interviewer gave us it says 2 counts of auto theft. That is not the case. Had he put 2 counts of theft I would be OK with that, had he said 1 count of auto theft and theft of gasoline, I would be OK with that too. I just dont like the fact that it says 2 counts of auto theft when that is not what the charges were, like I said I know it was just a mistake in typing on his part. And as long as that report is only for our reference then it is fine. I just dont want husband to explain his charges in the application and then have whoever reviews waivers come back and say thats not what the interviewer said.

So I just now took a close look at the paper the Consular Officer gave us at my husbands interview yesterday. My hubby needs a waiver for criminal inadmissibility.
On the paperwork the officer checked the right box but the typed in explanation is incorrect. He typed in that my husband has 2 counts of auto theft. That is not what his charges are (well actually I guess technically 1 is so thats fine) but the other was theft of gasoline.
I assume he just made a mistake while typing it out but will that effect us in anyway? When we go to apply for the waiver and we have to put in his own words on the application why he was denied and he puts in something different will that cause a problem?
I emailed Montreal to see if we could have it corrected but they tend to be painfully slow in responding.
Do you think that paper is JUST for our reference and it won't matter or is this something I should have them correct ASAP?

I did send off an email to the consulate yesterday (unfortunatly Montreal tends to be VERYYYYYYY slow responding sometimes) I will see what they say

My husband had his interview yesterday and the original marriage certificate that we received at our wedding ceremony was fine for them. I don't know if maybe ours was somehow different then allot get at their weddings but ours was fine for the interviewer.

Well my husband had his interview today and he does need a waiver (2 stupid summary offences from when he was 19 grrrrr). Anyway, what I am wondering since we don't have the $585 right now to submit the waiver application - does anyone know how long you have to turn in the waiver packet? Is there a timeline after the interview?

We didn't turn in the waiver at the interview (we don't have close to the $585 needed) but the interviewer was very nice to us, I held back my tears the best I could and I could tell he felt really bad for me. But we shoudl be able to get it figure out

Well domicile was no issue thankfully. But my husband does need a waiver for other issues (stupid criminal issues from 11 YEARS ago, summary offences no less). But otherwise the interview went well, all paperwork was in order and looked good he said (he was surprised that I had put it all together myself and not with a lawyers help).

I wonder if at my husbands interview tomorrow now if they will ask for something different and maybe USCIS and NVC just kinda dropped the ball when looking through our documents ugh. All we have is our original thing from the ceremony (there is the raised stamp imprint thingy on it) and our original application for our marriage license. Oh well I will just pray they dont ask for something more at his interview:)

Well after running around everywhere around us I FINALLY found a place to print out the lease (my mom just signed it and scanned it back to me) so now finally I feel all prepared for hubbys interview tomorrow

the thing you sign at the wedding is not what the NVC wants.. they want the certificate you are supposed to get in the mail a few weeks after your wedding.. it looks something like this.. although other province's certificates might look a little different..
Now I'm a little bit jealous, we never received anything in the mail after our marriage (in Alberta). We had to go to the registry to get another copy of our marriage license. (I will say though USCIS and NVC accepted the marriage license we received at the ceremony with our signatures and the witnesses and the guy performing the wedding, I wonder if it was just a fluke for us).

I was able to find a standard lease online also. I will send it to her in the morning and have her send back
I hope between the lease and my bank acct it will be enough. -
OK I will have my mom do up the lease for starting July 1st then

Oh also - does it matter that where I live is with my mother? (Its the same address where my husband will be living too which was put on paperwork) do they look at leases from relatives or joint sponsors as hogwash (for lack of a better word)

Actually I never thought of fax (why I have no idea) I will make sure a lease is done up for me ASAP tomorrow and have it sent over so I can get it and bring it on Monday - that should be good enough I think
Now the lease for my MN address will my new lease be ok (the one starting in July) or will I need to show previous as well? Thanks for any input

Yes I do have a co-sponsor for my husband who also lives at my same address in Minnesota. Unfortunately, his interview is Monday so as far as getting a letter/contract/lease for my place in MN will be impossible by then. I guess I will just have to go in with my bank statement and my MN driver's licence and hope for the best

I'm not sure what you mean byu how am I dealing with the sponsorship issue. I do have my domicile in the US. My perm address and mailing address and bank are all in the US which is what they ask of for domicile. Saying we are heading back to MN once he's approved is not a lie either, that is what we fully intend on doing. In fact once he is approved (and if) then we will be flying back as soon as he receives his visa packet.
Basically if I understand correctly it is better if I do not go with him? Is that correct?
And on a side note, I don't expect anyone to lie that I have been living in the US. I fully expect them to know I have been staying with my husband in Canada, just did not know until now that that would be an issue so now I'm thinking abotu staying home while he goes to his interview.

Maybe I should add that I do also have a perm. residence in Minnesota and my mailing address is in MN my bank account is also for Minnesota - will these things help?

So when I go with my husband to his interview on Monday they will want to know when I am going home? I can't just say that I am there with him for his interview and as long as all goes well we will both be heading back to MN in 2 weeks?
Now I'm starting to doubt if I should go with or not. I know it looks good if the spouse is there but will me being up here with him hurt more then help??

Because we do not want to be separated. I am staying in Canada until his CR1 is approved. In the future worst case scenario they dont let me back into Canada not a huge deal. He can still come up and visit family and return to me in the US

My husband just had his interview on Monday in Montreal and to be honest the officer interviewing us did not ask for any proof of our relationship (which I found odd). He asked about our wedding and I mentioned I had a couple of pictures, he said he would love to see them, looked at them and then gave them back and that was it. I don't know if normally they ask for more proof or maybe just after speaking with us he just could tell our marriage was real.
I think with everything you have should be more then enough
