    At most, not at least. The filing window opens 90 days before the expiration date, and closes at the expiration date, so you have a 90-day window to file.

    US citizens and LPRs are treated differently for public benefits.
    You are a US citizen who is entitled to all benefits.
    An LPR is sponsored with an I-864 where the sponsors take financial responsibility to reverse the government if the LPR receives certain benefits - one of which is Medicaid.
    An LpR is also barred from receiving certain benefits - including regular Medicaid - for the first five years.
    You cannot take the rules that apply to US citizens like yourself and apply them to an LPR. LPRs have their own rules.

    First of all, You're adjusting from K1 visa, So you might not have interview.
    Even if you are lucky enough to have an interview, Los Angeles office is very busy, so the wait it's gonna be a little longer than other people.

    Simply being married gives you zero immigration benefit. Your husband is wrong on that.
    You came to the US, quit your J1 program after one day of work but you didn't leave, then you met someone and married 3 months later. I don't think you should push it any more.

    If you leave you will not be allowed back in without a CR/IR visa, which may take up to 12 months to complete.
    IMHO, if you suspect your relationship can't survive a three-week separation, you need to reconsider your marriage altogether. I do not mean this in any other way than a simple observation. If both of you have vowed to stay together for the rest of your lives, three weeks are a walk in the park...

    Love-sickness is a survivable malady. If a 3 week period apart will destroy your marriage, then there are underlying weaknesses.
    With an iPhone he ought to be able to communicate with you using a wireless internet connection as well and one of the many communication apps (skype, messenger, etc.).

    So your plan is: take the risk and leave the country, apply tourist visa to come back, apply for AOS after you back here?
    That's called visa fraud.

    Not much you can do. Since you're not a citizen, there's a long wait for her to become eligible for AOS. Overstay is only forgiven for spouses of US citizens - not spouses of LPRs - so she has to either maintain a valid visa status in the US until she is eligible for AOS, or once her status expires, she would have to leave, return home, and wait for her PD to become current abroad.
    The only way for her to stay in the US with you from now until you can file the I-485 is to maintain some non-immigrant visa status. She cannot just stay here. So her options are basically to either stick it out with the school and F-1, for as long as her F-1 is valid, or try to get another type of a visa, such as H1-B, that will allow her to remain in the US.

    This is the worst part of your whole story. No man is worth giving up your child for. I saw someone the other day who casually mentioned her teenage son wasn't immigrating with her. That's something I can never support or understand.

    If my husband had changed after I immigrated to US, I'd leave him and go back to my home country. The purpose of the petition is to be re-united with family. I just find it hard to believe that immigrants are willing to stay over here at all cost after being subjected to abuse shortly after arriving in US claiming the marriage wasn't entered for immigration purposes.

    You said you got the NOA's but then you said you didn't get the email NOAs. Then you said the hard copies are on their way. So what exactly did you get? I'm confused.

    So it was a misunderstanding. It doesn't need to be a big deal. People who come in here screaming that AOS from a tourist visa is illegal or wrong really piss me off. I just wanted to clarify that Linda is not one of "them."
    Just one comment here - It's correct that overstay is not usually an issue when you file for AOS. But, as someone whose husband overstayed for nearly two years, I don't recommend it as a plan of action. It means he'd be here out of status, and that severely limits your life. Not to mention that he would constantly be subject to deportation, even though it's not likely. And, if for some reason, your relationship didn't work out and he left without the AOS completed, he'd suffer consequences in the future. His chances of getting a tourist visa again would be really low. I think having him overstay for any length of time is the last thing you should do.

    I'm sorry you felt I was accusing you of fraud, I at no point suggested such a thing, and instead was trying to show you what the IO seemed to be saying from their constant questions about Laura, and their comments about your financial situation.
    I said it before and I'll say it again, this Laura person is very important. It would not be the first time someone didn't know the full truth about someone else. I'm not accusing her of anything, but maybe she has the same name as someone who has done something, maybe she looks like someone who has. I'd say it's name related though, especially as they referred to her as her maiden rather than married name.
    But that's all moot because, as you said, you simply posted to tell people that they can request the interview end and speak with someone higher up the chain. You don't want help with your case, you have a lawyer. May I suggest then, if I may, that you report this thread to be closed by a mod as you have succeeded in your purpose to alert people.

    You know "felt" isn't fact. The officer, by the writings of the OP, never mentioned race at any point in the interview.
    I've said this before, but when someone is self-conscious about something they tend to see what might not be there. Take, for example, getting your hair cut. If it's some new radical change and you're not 100% sure about it, you might hear someone laughing behind you and wonder if it was about you, you might see your friends and they don't say anything about it so you think "well if they liked it they'd say right?". If you saw them whispering as you walked up you'd assume it was about your hair and it's just so awful.
    The OP needs to stop looking at his race and her race as an issue. Look instead at the other things the officer did or said. Stop being indignant about what they THOUGHT she was implying and instead look at what she said.
    From the OP its obvious there's a red flag somewhere. The OP hasn't posted what information they mailed with the application, only what information they brought with them to the interview. From the IO's point of view... 4 months after meeting a illegal alien (with around 2 years of overstay), the OP married her and then they filed AOS. They have 30 affidavits attesting to relationship but they don't really mean anything, especially if the IO believes the marriage was arranged so the illegal alien was able to remain in the US, because of COURSE the OP's wife's friends would say the marriage is legit, they don't want her to leave, and the OP's friends would lie so he gets money.
    This Laura person seems to be a bit of a trip up so I'm wondering if this Laura person has ALSO filed some form of paperwork and is suspected of marrying simply to remain. It would make sense if they believe you're part of some immigration ring... in fact, in re-reading your OP this is what I think is happening. This Laura person seems to be important, then she mentions how is the OP supposed to support a kid which implies that she thinks money has changed hands, or the OP's wife is working illegally or something else. I believe they think this marriage is fraud, you're unable to work so you accepted the chance to marry an illegal alien and get paid to help her AOS. Perhaps you should also find out what's going on with the 30 people who did affidavits. If they are in the middle of a process, there could be something you don't know and the age old saying "be careful who your friends are" might be playing a part here...

    I just stated the fact. You didn't even get my point, It's not about adjusting from Visitor visa. It's just not a lot of people got married after only knowing each other for 6 weeks. I am not attacking the OP, If I were, I wouldn't even answer her question! What's wrong with telling her be more prepared? And this is a public forum, I can say whatever I want as long as I am not violated any rules. So can you please leave me alone? The point is helping the OP not attacking other member's comments.

    OP - I am sorry you had a bad interview. But, it is not because the officer didn't want you to be together, or had a problem with mixed race couples or disabled people. They see that every day.
    Clearly the officer thought that your file indicated fraud. I am not sure why the first post says "my wife" and the second says "my husband." Did you guys both write here? I can't really gather the details of your case from the post because it is confusing. Can you tell us who Laura is?
    From what I can gather, male USC, 29 years old, disabled. Female immigrant, from T&T. How old are you? How did you come to the US? You have kids? Their ages and where are they?
    I ask this to try to get at the facts of your interview, to see it from their prospective, and see if anyone can offer some help.
