Your hope now relies on the asylum filing. Apparently USCIS are convinced your marriage either wasn’t bonafide or your husband pulled the 130 or 864 so adjusting by marriage is dead in the water.
You may now have a VAWA opportunity however note that trying to adjust by many routes sometimes casts the applicant in a negative hue of desperado who will do anything to stay legal.
A competent immigration attorney is would be well worth it. As someone already explained the letter asking you to leave is automatic and didn’t take note of your pending asylum application.
An update on this issue for anyone else that has this problem. Apparently, this mistake has happened a few times over the years for international students with my sister in laws university. The international student coordinator said it was an easy fix. All that panic for nothing!
As long as the error is a USCIS error you can work. She must provide the current card to the place of employment, keep copies of the card, then send the original EAD in for correction to the issuing center with an explanation letter and proof the error was the fault of USCIS. No fees are needed. They will simply reissue the card. Even if we had not caught this now, it could have been corrected when she applied for OPT (though it may cause a delay at that time). Anyways, hopefully this information can help someone down the line.

Have you submitted an I-864? If so, you might want to consider withdrawing it....before the Green Card is approved.
I am no expert, but I believe It isn't that simple for a K-1 entrant. An applicant who entered via a K-1 has very limited options.....such as VAWA, I think.
Why did she not add a ds260 for her child after it was born? Or send kcc the birth certificate when she emailed the documents ahead of interview scheduling? Had she updated her own DS260 to include the child after it was born?
Well- this is a difficult case because it seems she shouldn’t have been denied (if indeed that was the only reason) but there is no path of appeal for a consular decision. It seems to me the only thing she can do is write to the embassy explaining the situation and hope they reopen the case for her.
They need to check with German rules because if they don’t live there it’s not sure they are still covered by medical there. At least that’s how it is in DK but don’t know about Germany just saying they can’t assume they can just get it paid for there when they don’t live there.
Well, hardly. Predicting due dates is not an exact science and there are many reasons not to induce labor. I don’t see it as an error, just an incredibly unfortunate timing issue.

@confusedmama When did he naturalized? They'll not be qualified for CRBA if they are born before he's naturalized. But they can derived citizenship since they are minors.
If you're US citizen, you have to file your taxes. Your dad can be a joint-sponsor, but as a main sponsor, you need to show your tax returns. Doesn't matter that you don't work in the US.

Only you and your husband know all the details of your children's circumstances. But based on what you said above, it seems that these particular requirements will be problematic --
To be eligible for U.S. citizenship the child must:
Be residing outside the United States in the legal and physical custody of the U.S. citizen parent
Be temporarily present in the United States in accordance with lawful admission to complete the Form N-600K process and is maintaining that lawful status
How will the father satisfy the custody requirement if he lives in California? Will he move to the Philippines, then move back to the US later to fulfill the domicile requirement for your CR1/IR1?
Also, the official site does not mention anything about a B2 visa being automatically granted to the children to be able to fulfill the temporary presence requirement. What USCIS says about this is:
It is the responsibility of the individual seeking the child’s Certificate of Citizenship under INA section 322 to secure any visa or other document necessary for lawful admission to the United States. USCIS cannot assist in obtaining any necessary visa or other document.
I strongly recommend that you and your husband carefully go over the detailed Instructions for Form N-600K as there are many more requirements. I haven't seen many cases here on VJ of parents filing that, so I have no idea if it can be done successfully without a lawyer. It's up to you to decide if it will be worth the effort and expense to pursue that route versus the straightforward path to immigration for your children via the CR2/IR2 process.
You didn't provide the requested information in the RFE (a full and complete copy of your husband's tax return or a tax transcript, that you can get for free from the IRS in a few days) so you were properly denied.
You can apply again as a fresh filing, but would need to pay all of the fees again.
Just make sure to use tax transcripts this time around. And as already stated, fire that lawyer. This was a very elementary mistake that an immigration attorney should not be making.

Umm no. Lots of people these days file N400 while I751 is pending. This action by itself does not lead to more scrutiny. Most IO's will not care. If you have other issues like criminal history or a suspiciously timed divorce, then that provokes scrutiny. I751 denial rates are pretty low to begin with anyways. Please don't be giving people incorrect info about this process.
