Hypnos reacted to CJKylie in Selective service registration (merged)
Because it’s a generic letter. Mine had the same and my interview was today.
It says “any evidence of selective service registration” - you don’t have any evidence of selective service registration, as you were not within the age range

Hypnos reacted to azblk in 30/60 Day Rule & questions perhaps regarding forms!
There is NO such rule but the USCIS is now claiming that they can deny you for misrepresentation if you do something inconsistent with the terms of your non immigrant status within 90 days of entering the USA. Court and EOIR precedent is that intent is determined at the border and that immediate family of a US citizen can not be denied AOS solely for that. I personally think it is being used a scare tactic right now more than an adjudicative tool.

Delay the process until they are ready.

Hypnos reacted to SusieQQQ in Can a resident return after a year outside the United States?
Well, if he returned to his home country to live and work there then he abandoned residence.
He could apply for a replacement plastic card but he will definitely have been out longer than a year by the time he gets it. Shame he waited till the last minute to try regain his options.

Hypnos reacted to HRQX in C1/D VISA Ships seamans
In 2008, when OP was deported, it was 25 miles. It was extended to 55 miles on July 12, 2013: https://www.justice.gov/sites/default/files/eoir/legacy/2014/10/03/fr12jun13.pdf

Regardless, OP entered in TX.

The OP didn't have a paper I-94 permit issued at the border with Mexico when crossing by land.
Without it, BCC holders, can only stay up to 72 hours and within 25 miles from the border.

You can apply, with a prior deportation on your record it is probably unlikely you will be granted one though.

Hypnos got a reaction from Adam A in Conditional 2-year Green Card or 10-year Green Card for K1
It's not about how long they've been married at their interview, it's how long someone has been married on the day of their I-485 approval that determines whether or not they receive a 2 year conditional green card or a ten year unconditional green card. This is not always the same day as the interview, if their case has to be continued for supervisor review, or perhaps issue an RFE.
If, on the day of approval they have been married for less than two years then they will receive a two year conditional green card that they will then have to remove conditions from in almost two years time.
If, on the day of approval they have been married for two years or more then they will receive a ten year unconditional green card for which no RoC is required.
If someone should have received a two year green card but instead received a ten year green card then this can cause them serious issues down the line, despite it being a USCIS error. They will need to file for RoC, and by not doing so will go out of status once it all gets straightened out. Theoretically, they could wind up being deported over it.

Hypnos reacted to Ryan H in Tourist visa Denied for Myanmar wife of US citizen living in China
~~~Closed for review~~~
***Thread back open; several derailing posts removed; either post constructively and answers the OP's questions or do not post.***
**Moderator hat off**
For the record, that's not quite correct. While some USCIS international offices have closed, some of them are still in operation and no closure dates have been announced. As long as those field offices remain open and have not A) announced a closure date and B) not given a cutoff date as to when they'll accept I-130 petitions, DCF remains possible.
Your chances of receiving an expedite are slim to non-existent.
Hypnos reacted to geowrian in 2nd Nitpicky N400 Interview
They don’t verify residency before the interview as it’s a judgement call combined with the laws of the individual states. Hopefully they can verify the living situation this time and approve the application.
Making a scene would not have ended well for anybody.
They cannot deny based on not liking one’s lifestyle, but they do have to verify compliance with the INA and AFM/policy manual. It’s not just a matter of understanding the situation - I’m sure they see many others with similar situations - but they are bound by laws and policies and have to confirm compliance with them.
No. Pregnancy is not a reason to expedite.
They cannot give you what they do not have. They likely do not know themselves how long the AP will take since every case is different, even if they appear similar from the outside.
