    Hi. I am new in this site and I thank you in advance for your input. Here's my case:
    I came in the US in 2002 as a J1 visa holder. Fell out of status in 2004 (but acquired my J1 visa waiver). Married in 2006 and divorced in 2011(didn't file for adjustment). This year I remarry to a USC and we filed I-130, I-485 and I-765 all together. Got my biometrics sched for end of this month. My question is that I have been working without authorization since 2004, all through a paycheck and I had filed my taxes each year, I don't remember if I check on the 1-9 form if I was a USC or authorized to work when I got employed. Will this have a bad effect on my petition and adjustment of status? One more thing, how soon will I get an RFE(if they need one) after submitting our application?

    There is a J1 waiver for the 2 year home residency requirement. You can start that process now. The best way to find that info is through your consulate. I am sure they will help you. It takes time and a lot of paper work to get this done but you can do this on your own. When your get your waiver, you don't need to worry about returning to your home country.
    If you don't have a waiver, your visa application will be denied if he is going to petition for you.J1 waiver is one of the requirements when you file the petition. Goodluck.

    If you said you were a USC, then your Adjustment will be denied and you will be deported. No waiver. Banned for life.
