    They probably will advise you to file separately because you cannot claim a resident wife as non-reisdent.
    We had the same problem and we just filed under "resident" so that we ended up paying more taxes - at least IRS is happy if you pay more taxes.
    It's just what we did to be safe, you might want to consult an accountant, but they charge a fee which may be higher than what you could save on taxes. With 13K income, I think you won't be paying much taxes at all. We had around 12.5K and paid no tax after deductions and college credits.

    Yes, did you file an Advisory Opinion? My friend got "subject to 212(e) requirement" printed on her visa, and is actually not subject to it.
    Original DS-2019 says not subject, and the Advisory Opinion explained the mistake.

    Caryh really? I would not suggest to someone to take responsability for others wrong doings at all. YOU are responsible to recognize and apologize for your mistakes but not start the danger circle of apologizing for something you didn't cause, it's damn wrong.When you are wrong you are wrong and you should apologize for that,but when you are right you have to stand up for what you think is right and not to say sorry just to please the spouse,take this from someone married almost 10 years and we are damn happy.Unfortunetely she is in a terrible position here.If the guy is serious about her leaving the house OmG she will be out of status,risking to be deported and she won't be able to leave the Country with the child .It's a sad and danger situation tho.

    There are plenty of non-materialistic women who come to America and become materialistic. I gave up on American woman long ago, and years after my divorce I started dating and an odd thing happened. Seriously--I dated three women, one after another. Each was quite nice, I took each out to dinner and had a good time, there seemed to be a good connection. Each was our first date and we met at a restaurant. When we left and I walked each to her car--each one asked the same question: "Oh...which is your car." When I pointed to my 1992 small Toyota pickup the exact same look came over each one's face--and all they said was "Oh." Needless to say, none wanted another date.
    Not one was smart enough to say: "Why do you drive such an old vehicle?" Because if they did I'd have said: "because I prefer to not have any debt."
    I'm sad and embarrassed to say that materialism in America rules--even in the face of the financial crash. This is why I turned my sights to Asia, specifically to find a life partner who has similar values, and that's exactly what I've found.
    No, this guy is not trolling.... his choice of words may not have been the best but this is a story I've hard before.
    Perhaps if he had written more eloquently: "I hope someday to find a Filipina who has traditional values and who places love, family and God over flashy cars and Barbi Dollhouses and BMW's...." Well, that's what I read into what he wrote.

    I appreciate your opinion but in my case, I can not make it work anymore. My husband is the kind of person that anything wrong that he does is gonna blame it on someone else. He said he would not go online to look for women and he kept doing it on my back even after married! Besides he has gambling problems and he doesnt want to get help! I still love him but I can not keep with this anymore. Its not worth my time.
    Just want to divorce from him and go back to my country.

    As the first response stated, if he's willing to be reasonable (i.e. sign without problems) then you won't necessarily need a lawyer.
    I suggest you go to your local courthouse and ask about the forms required. Usually they'll give you the forms, or direct you to a website with the forms. You'll pay a filing fee to file the documents and not necessarily even need to get him served because if he's willing to co-operate, he'll just need to sign the forms.
    There will be a waiting period most like but the clerks at your courthouse will explain it to you.
    I know you said your GC stuff doesn't matter but I will mention a few things anyway. I would make an infopass appointment prior to leaving the country to withdraw your AOS application (take a written letter withdrawing) so that you tie up any loose ends. If you get your GC (without interview) prior to leaving then hand it over at the embassy in your home country on your arrival. Once you withdraw you will have about 30 days to leave. If you accrued any overstay prior to filing AOS and there was enough for a ban, then you will get a ban (only getting your GC approved with get rid of a ban), if there wasn't enough for a ban you may still have problems getting a visitor visa and if you are from a VWP country then you will most likely be unable to use that.

    OP didn't ask for you to give her your opinion about her marriage, its obvious from what she wrote that she isn't happy with her husband. Stick to the subject matter and give her the answer to her question not your opinion or advice on a marriage you know nothing about. It's amazing how she wrote details for her reasons why but somehow all one could get out of that was he was 'internet viewing".
    I don't think if you found your wife on the internet looking for casual sex , you would call it browsing..... ay?

    Hey guys,
    I want to make an InfoPass so that I can get a stamp on my passport. I will be travelling sometime in February and my green card will have expired then. I know I can use the extension letter but Im afraid some airlines do give problems while boarding with expired green card and the extension letter. My question is, if I make an InfoPass to get a stamp on my passport, will I be required to show my air ticket as evidence of travel? Thanks.

    I don't think so. The number of H-1, L-1 and EB visas issued each year is ridiculous. Half of those are issued to Indian. In many cases, companies claimed that they couldn't find a guy to do the job here is totally BS. They rather bring the guy from India here than make their US HR work harder to find the right candidate.

    As you may or may not know, California is officially the Golden State. As such California has attracted gold diggers for way over a Century. You'll feel right at home here. Weather is nice too.

    They won't pass it even if you got enough signatures... It just shows up on the desk for little attention. Lots of petitions like this got the signatures but they don't change anything.

    An update, I suppose: I spoke to someone in immigration at USCIS. Their answer was, as I suspected, a No. So we're moving to Canada.
    Either way, the co-sponsor did not sign the forms until he got the lawyer advice. Hence the waiting period. He said yes, then he said no. Husband has been applying every single place he can, unfortunately, work was not forthcoming. We live in a state where unemployment is very high. I will mention he already works one job, as much as his schooling will allow. He was fully willing to take on more than that.
    All I wanted to hear was a "No, it's not possible" or "Yes it is" basically. We've already started the reverse process, and it is much easier. Hubby will finish out the school year at university and we'll be moving in May. I don't want anyone to 'fix' the situation for me, I just wanted to make sure the answer was going to be 'No' before we dumped 1070 on the adjustment. It's a lot of money that can be put elsewhere. I have jobs lined up in Canada for both of us, and a living situation already figured out. I did this after I spoke to an IO about the whole ridiculous shebang.
    Easy peasy. Had I known Canadian Immigration was so simple, I would have done that from the start.

    I don't think you should even have a green card. You do not live with him, you are living in your home Country,the only connection here is that he is sending you money, and you want to pretend to Uscis you are a happily married couple, seriously???.We need better people living in this Country.

    A crime is a crime.
    The Pope protecting a sexual molester is not different from a wife protecting her husband after he molested their child or a goddam cop ignoring another cop's criminal behavior or a politician looking the other way. They all protect their own, and they are all wrong in doing so.
    There are some countries where it's a crime when a man inserts his ####### into the body opening where usually the body's waste exits, as they consider it a crime on nature. One of such countries is Uganda, and they had to deal with Idi Amin, so they are certainly not over-sensible to crazy sh*t.
    Other countries, such as Iran, allow a man to have sex with a 12-year-old, and we go gagga over this. So all of this has to be seen in a cultural context which is the basis for a society's moral standards and laws.
    I personally would not punish gays for being gay, ever, and would not object to them entering a legal union; but marriage has at least a small component of a union that goes beyond just the legal part, and if you want to allow gays and lesbians to get married, I would really want to legalize polygamy first. I am not a polygamist, but I feel that a man and two or more women who are all consenting adults over the age of 18 should be able to choose to get married if they so desire. Who are we to tell gays it's okay, but Mormons it's not okay? THAT, I think is a form of religious discrimination.

    You are so ridiculously out of line here it's not funny. It is HIS choice to cheat. She plays no part in that. She does not control him. He makes his own choices. A good man doesn't cheat, no matter what "she does to cause it".

    I had some very good instruction, Dr. George Simon being the best of them. I meant to comment that you held yourself well through an attacker with experience. He's done this three-step play many, many times before. It works when you get the person angry with the first provocation. It goes like this:
    1) Ask the rape victim if she deserved it because she was wearing shorts.
    2) When she responds in anger you blame her for being angry, or even for responding at all.
    3) Continue the attack, but make it look like you are only defending yourself
    What they do next depends on how successful they were in getting you angry. You did not respond in anger and he couldn't continue provoking you to higher levels of anger. So what the manipulator does next in that case is leave the field, pretending you are an unreasonable person who can't be dealt with. But if you do what they want then you will get worked up into a rage and then he'll turn that on you successfully: just look at you - an angry person.
    Despite being such a cliche' it is true that the biggest tragedy about this behavior is repeating itself in a cycle from parent to child to grandchild down through the generations. So yeah, break the cycle.
