Jen and Jon reacted to Inky in Having a baby in Canada??
No because you lose your Canadian health benefits when you moved to the USA. No free healthcare in Canada anymore.
-
Jen and Jon reacted to Inky in no residence's bill under my name and I received an RFE
Unfortunately even if you add your name to the bills they often do NOT come with your name on them! My name is on all our bills and they only come in my husbands name. We called to find out why and they claim it is a " space issue on the envelopes and bills " So even if you put your names on the bills you may not have any arrive with your name on it.
If you have Verizon phone plan shared / family plan you can go down to Verizon and ask them to put your name on the bill beside your phone number, this is something we did to show that I have been on the plan since I moved to the USA. My name shows up on every family plan bill but not on the address part because they cannot do that for some reason.

Jen and Jon reacted to Cathi in Stressed
although I wish you the best, time after time people are told both here in this forum, and at the consulate to never make plans until the visa in in hand. A least once a week we see people here upset because they made wedding plans and paid money for said weddings only to lose money and be disappointed. Good luck...

Jen and Jon reacted to Hugglebuggles in Going back in Canada
Not to be mean, but why on earth didn't you look into this before moving? The biggest downfall of the K-1 visa is you are "stuck" in the US and unable to work until you receive your AP and/or EAD. If you leave, you can't get back in unless you want to start over again. I hope your stuff isn't that important, because you won't be able to get it until you get married, apply for AOS and then wait about 3 months. Unless someone can go get it for you.

Jen and Jon reacted to Kathryn41 in Going back in Canada
That is for someone who has entered the US as a visitor. That doesn't apply for a K-1 visa. You are not a 'visitor' who expects to be leaving the US at the end of your visit. While the K-1 is a non-immigrant visa, it has immigrant intent. The purpose of the K-1 was to allow you a one time entry into the US in order to get married and then to request permission to remain in the US as a permanent resident. If you leave the US after having entered with a K-1 - unless it is for an absolute emergency when you can then throw yourself upon the mercy of the Montreal Consulate who 'may' re-validate (or may not if they do not deem the emergency sufficient) the K-1 Visa back to the same amount of time remaining on the I-94 - you will be denied re-entry and will have to start the immigration process all over again from the beginning.
Once you enter as a K-1, the only way you can safely leave and return to the US is after you have received one of two things - your green card or special travel permission called Advance Parole which you apply for at the same time you apply for your green card. Your boyfriend can go and get your belongings, but you can't. Not yet.

Jen and Jon reacted to Flames9_RN in Going back in Canada
Sure you can--Canada will let you back in no problems at all. BUT as the others have stated the USA will NOT, as the k1 is single use. Happened to 1 gal on here a few yrs back! She was then lucky to start the CR-1 process from Canada! One always has choices, lol All the best in 2013

Jen and Jon reacted to LIFE'SJOURNEY in 16 years old immigrant teen from colombia.
I have given this young man all the facts to give him the opportunity to do this the legal way with the chance that he would probably spend less than 30 days in Colombia , but since he can't comprehend and was more interested in being rude, let him figure out the puzzle, or try his luck at ways that lead him to being untruthful to the US government under oath to get a visa.
Time is not on his side to wait.

Jen and Jon reacted to aaron2020 in PLEASE SOMEONE HELP ME WITH THIS
LPRs cannot file for a fiancée. Only USC can file for a fiancée.
IT IS A CRIME TO MARRY ANOTHER WOMAN WHiLE ALREADY MARRIED - IT'S CALLED BIGAMY.. Your plan will create BIG problems for you.
If you got your green card through a marriage to US citizen, there is a five years prohibition on the LPR from divorcimg and bringing over a new spouse. There is an exception but you must prove your first marriage was bona fide. Read the I-130 instructions.

Jen and Jon reacted to del-2-5-2014 in Can my Fiance start working right when he arrives with his k1visa?
I have a concern that you haven't researched what you're embarking on thoroughly.
Instead of giving you an easy answer, my perogative, I ask that you go back and study the guides to make sure that you haven't skipped all the pertinent details that you need to know. This is such an easy but important question tha tyou should really no the answer.
Yes I know, I'm a grumpy old Man but helpful in my own way.

Jen and Jon reacted to keyshawn18 in SS Card Before AOS
You choose A, but when your card arrives the card would be marked authorized to work with only with DHS approval or something to that effect.

Jen and Jon reacted to Ivy. in Lawyer says to delete Facebook entirely...is that really necessary?
I think your lawyer is paranoid. I do not see how Facebook can be used against your case. Actually, many people use print screens of their Facebook interactions as proof of relationship.
I would ignore this particular advice and carefully think about any other ideas this lawyer might have in the future.
Good luck with your case.

Jen and Jon reacted to C-ma'am in Question about i-129f
I'm afraid you will have to wait the 60 days according to your State's law If not, you will, most likely, get the petition denied on grounds that you are not free to marry yet.

Jen and Jon reacted to QueenE in calling all March 2012 filers....
How rude... Its nice for some to talk to people in like situations. Also I dont think you own this website to be telling anyone what to do ( come with reasonable query).

Jen and Jon reacted to Pinkrlion in K1 Visa Requirement
That is not true, you only have to provide evidence of meeting within the past two years. (That is there cut-off) If you have met anytime from September 2010 - September 2012, then you are fine to apply. Your initial meeting and beginning a relationship has nothing to do with the two year period. I met my fiance in 2008.
You can complete this process without a lawyer. Thousands of us have.

Oh goodness don't get VAWA in their vocabulary. I'm now worried for the husband. Sigh.
-
Jen and Jon reacted to baron555 in Woman with K1 visa wants to divorce and marry me
I agree with the above; it's the cleanest and surest method.
She could stay with her husband and get the GC and then divorce and marry you but when it comes time to ROC and get her 10 year GC; the timelines will look fishy and a visa fraud decision could be rendered.
She could divorce her husband and then try to AOS on her own. If she is not sent back and is given the GC, then you two could get married and then a similar ROC attempt be made.
I will also refrain from commenting on why you would be engaging conversation that leads to "love" with a newly married woman?!!

Jen and Jon reacted to rocks in Return Transcripts or W-2s... or both???
If you have tax transcripts you do not need the W2 for that year. You would only need to send your W2 if you were sending them your tax returns, not transcripts. USCIS always prefers transcripts.

Jen and Jon reacted to Dana and Divine in Abusive relationship
How do you have or find friends if you cannot leave the hotel room all day while you are being held hostage and being followed to the bathroom?
-
Jen and Jon reacted to LIFE'SJOURNEY in Abusive relationship
There was nothing that was stated orginally that indicated that there was any kind of abuse happen. You wants to turn every situation ino your new found toy. If Mr. King wants out of his marriage it's quite simple, open the front/back door and leave. He is not being held hostage in his room.
What he doesn't want to do is leave without his newfound toys, or waiting for someone like you to offer him some new ones.
This is just a martial situation that should never have happen in the 1st place. He is the only one that will know if he would be safer and happy on the streets of US, or back a home on familiar grounds.
