By His grace we have been given our visa. My fiance called me at 1:30am and yelled into the phone, "WE HAVE MADE IT!" Nothing feels better than this victory in which, the outcome could have gone any other way. I have been so worried, so sick with worry. Thank you to all fellow VJer's for your prayers, for your words of comfort, and for your FAITH. God has done this for us, we tried to help HIM as much as we could with preparation, but God had the final say and I am so thankful.

Maybe thisis out of topic but I think you are such a great future husband. You are quitting everything you know to give her a chance to spend more time with her family, that is sosweet. Some people in this topic FORGETS that we ( the foreign fiances and spouse) have to quit everything we know to be with our loveone(US citizen). Nobody seems to care everything we have to deal with in order to be here. Maybe some our countries are mot perfect, compare to the US, but still that's our home. I truly love this country but I cant help missing my family, my friends, my culture. I think that's a gesture of true love and can stop thinking that your lady is a very lucky girl. Wishing you the best and tons if blessings in your journey together

No no. See here's the thing. one of the requirements of the visa is being "free to marry". In the Philippines you need to provide a CENOMAR which shows that they're single. Even if they divorced in another country, they wouldn't be divorced in the Philippines. Which means they're NOT "free to marry" by Philippine law. Which makes them ineligible for a visa.
The same can be said of EVERY country, they have their own laws. You can think it's unfair but you're asking for permission to bring her here, that includes permission from her government.
There is another country (Vietnam I think) that WILL NOT permit it's citizens to marry USC's who are older than a certain age, and who don't earn over a certain amount (a HIGH amount too). Other countries require their permission to leave the country, even just for visits.
In regards to your particular RFE, by Philippine law she is NOT free to marry you (same as if she wasn't actually divorced in her country). That means she CANNOT leave the country to marry you without her first fulfilling the requirements for someone of her age for her country.
You might not think it's fair, but it is the law of her country.

The service center made a mistake, the consulate caught it and CORRECTED it.
Meeting in person BEFORE filing the I-129f is a REQUIREMENT of the K-1 visa. If someone at the service center makes a mistake it is STILL a REQUIREMENT. Any benefits gained without meeting the requirements will be denied and revoked at any time it is discovered. You do not "get away" with it.
It would have been caught at some point as each step reviews the entire process. Especially citizenship and especially if the citizenship is gained in just 3 years because you are married to a US citizen. That was by far the most scrutinized procedure in our process.
Your friend(s) need to MEET in person and file a new petition and start over. They thought they "got away with it" but the fact is they never would have and it is better that it is corrected now than after she is here, married and maybe they have children or establish a life, a career and then find herself in deportation hearings.
Such could also be considered FRAUD and incur a lifetime ban because they knowingly filed a petition when they were not eligible for AND would have accepted benefits. Believe me, they would find a way to make this "your fault". I mean, how did they answer question 18? I am going to surmise they did not say "We have not met in person" and even if they did they are required to provide evidence of that.
DO NOT ATTEMPT TO SKIP STEPS AND REQUIREMENTS!

We recieved our NOA2 just yesterday. It took us 6 1/2 months! What a terrible feeling it is to have to sit and wait. My heart is with you! Idk why it takes VSC so long, but I definitely agree with the t-shirt idea! Lol!!Me and Mircea pass our time playing Facebook games. Ugh... I'm so sick of Facebook! I wish I had some better advice for you other than to just wait, but I don't. I guess that's all you can do. Try not to dwell too much on it. I guess that's my best advice. I know it's easier said than done though. It's all I can think about. And now we're waiting on the interview. It feels like a neverending wait, but I know this will be over in awhile. It's just very difficult. I feel your pain. Soon you'll have that approval though.

    Nathan&Elana,
You can be sure that you've stopped contributing and lost the debate when you stoop to the level of spell checking comments. The great irony is that his English is actually much better than yours. Anyway, I really do hope you can become a happier person who is capable of more kindness and understanding than you've shown today.

There's are so many things worst than waiting for a noa2 . My mom is fighting against cancer and she had being so close to death that she can barely touch it. I can not see myself bashing or complaining or mad at people cause their moms are happy and healthy and mine is sick, breast less and bald. Choose your battles wisely, is not worth it to fight about this. You all gonna get your approvals sooner or later and in the mid time try to be grateful with God for everything we have and being happy for others. As simpe as that

People seem to have the idea, however silly, that someone else getting approved quickly in some way slows them down. That there is some imaginary line we are all standing in, and these people who get quick approvals are somehow butting in ahead of others. Which is utter nonsense. There is no way to compare one persons case against another, every last one has it's own idiosyncrasies, and every last one gets dealt with in a singular way, sometimes it takes no time at all, and other cases take quite a lot of time indeed.
I remember being a K1 filer very well. We were last in our group, and that has followed me up til ROC. Always last in any queue. And after finally getting our NOA2 on the K1, we were yanked out of line and placed in 'random' AP at NVC, which was not before common practice. Held up there a further almost 2 months, and missed Christmas together, thank you very much. But I didn't feel that any of that gave me the right to moan about other people getting in some perceived line 'ahead' of me. I congratulated every last one of them, and meant it. It's what adult grown up people do.
I think what disturbs me most of all, is this desire to pour scorn and disapproval on the lucky few who whiz through the process with the rally cry of ' it's not fair!!!" "They filed after we did!' " They are lucky and got the faster service center!"
    Life isn't fair.
What also isn't fair is to try and subdue the joy of people who have successfully run the gauntlet, even if it appears that they started after you did. Why do we need to begrudge those people their happiness? Why do some think it is acceptable to ban posts like that, or warn the poster that they can be happy, just not too happy, and that they had better watch their words so as not of upset or annoy or provoke the ones who are still waiting?

i know where you going and sounds like a fair options for all of us. Bu t I keep thinking that we are all grown ups, is like if I get mad with someone who post her/his unhappiness cause thst person it's being waiting for 500 days. I read thousand of threats like that and people SUPPORTED them with blessing, good wishes, jokes and cheers up. NOONE complained about it. Then why if someone is very lucky to get her/his approval in 40 days why we cant be that supportive too? I support your idea, sounds fair, but some people needs to check themselves. Cause in real life there are people who always will luckier than you, in your personal life, your professional life etc etc and what are you going to do? Tell people not to be luckier, happier, skinnier, prettier, taller than you? Being in a bad spot of our journey of our life DOESNT give us the right to bash on other's people life and happiness....

This is not a kindergarden where kids cant manage their emotions. We are all adults and is really sad that BAN all the approvals post, is consider an option cause people here cant handle other's VJ happiness. I know its frustrating, I went through the same thing, but it really gave me hope every time I read an approval.
    Thats a fair option

What a bunch of haters. My husband waited a long time, and then was put into AP for 10 weeks. That didn't stop me from congratulating others. It isn't under our control how fast things get approved or not. I sat here and watched while hundreds of others were approved while we were in limbo, but that isn't a reason to rain on anyone's parade. How would you feel if it were you and everyone jumped all over you for being happy? Unreal how people here react, I feel like I'm in high school. If you can't say something nice...you know how the rest goes!!

Its fair to feel hurt, mad at USCIS and even jelous! Is normal we re ll human beings with feelings want it to be with our love one. Now, Im about to get my green card but I was a k1 visa holder a year ago and I know how it feels watch people here being approved faster than you. Its frustrating! But that didn't give me the right to bashed on other's happiness and approvals! If people here CANT help and manage their frustration over other's good moments, they shouldn't be here. This website is about to support and help everyone who is dealing with an immigration process in the bad and good times. I posted here when I got my NOA2, when I got my visa, when i got married and I will continued posting my successes cause I owe it to my vj fellows!

Is it just me or some seasoned members here are only up to humiliate the newbies?
I've noticed that there are quite a few members here that just like to call out other people who doesn't exactly answer OP's question and sadly they're the seasoned members. I understand that sometimes this could confuse the OP even more but it could not be avoided most of the time but was that even necessary? As a fairly new member and still learning the ins and outs of the process, it's intimidating to add comments sometimes. You'll never know who will pop up to humiliate you. We're all here to learn from each other and not to show who's smarter and point out who has no absolute idea what they're getting into. Just sayin'....

Remember you are not alone in this,we all understand your frustration and of course theres times when the relationship with your husband/fiance becomes strained. This is not a 'normal' courtship,we have to find ways to feel close through communication only. After disagreements theres no opportunity to hug and make up.....its hard,as humans we're programmed to need our SO physically. Dont allow this messed up system to break you. Everyday is a day closer.

meeting within 2 years & showing bonfide relationship is the mean requirement for this application, maybe you read it wrong. So if your applying today 9/14/2012 you could of had to have a face to face with your fiance 9/2010- 9/2012.
Im not even sure what you mean petition has to be filed within a less than 2 year period... Why would it take anyone 2 years to file a petition and what does uscis care when you send the application? Just make sure you have seen your fiance in the past 2 years and your relationship is real, that is there concern you have to prove that from the start of your application as well as during interview. Please study a little more before giving this kind of advice to someone. I think you may have completely misunderstood the instructions and requirements

SInce this involves another persons life also, I involved my Fiancee in every step of the journey.
On the day I mailed the petition I posted a copy of the USPS track thingie on her FaceBook. When I received NOA1 I did the same thing and also for NOA2.
I've always said that this is not just a romantic escapade, some of us who have been married before also knows that this is a business escapade and needs to be dealt with seriously.
OP, not sure what you decide to do but at the least you should request that your Fiance keeps you informed verbally and also by copies of all future hapenings in this journey.
There was another post like this about a month or two ago.
