    I am so sorry for what has happened to you.
    I have read so many of your posts and it seems a great injustice that you have been treated this way. You have been through so much already.
    I so badly wanted to respond to some of your early posts, especially the latest one about how your spouse had changed but I just did not know what to say or truly what I thought the right action was.
    I really do hope you followup and report him as commiting fraud. I hope he is deported and I truly hope he is banned from the US so that he may never do this to anyone else.
    Try to get as much evidence as you can to prove that is was a fraudulent marriage, keep a record of these forums and your posts these might help as you have documented his actions, keep a record of his family contacting you and offering you money to not report him, surely that is ILLEGAL as well. Call them, email them, get proof. Can you get any of his friends to sms you saying something to the effect of "he was just using you for the visa", it sounds like you already have that.
    Try not to be sad "knowing you will not wake up next to him" you now know what he is really like. You DO NOT want to wake up next to a liar, fraudster and someone so calous as to use someone as seemingly lovely as yourself!

    If you have been waiting over the expected period of time "5 months" then you can contact your congressmen to find out why your petition is taking so long. Most people say that they wont do anything till around 6 months.

    I am sorry I cannot provide any advice on the actual process, but what I can say is this seems complicated and I would seek the advice of a lawyer to make sure you cover all your bases and get the best advice before it becomes more of an issue.

    This site is wonderful and you will meet some wonderful people.
    I would definately head over to your countries "portal" where you will find lots of information pertaining to people moving from the UK.
    There are also so very active posters from the UK on these boards who always seem to be very helpful.
    1) Do you really have to have every box completed? I read somewhere that you should enter 'N/A' in any box that doesn't apply.
    Never leave anything blank. N/A or none if it does not apply to you.
    2) On question 10 of my info (USC was granted through..), I have birth in US selected. Do I need to complete anything in the box below.

    3) Its 2/28 and the form expires tomorrow. Should I scrap this and wait for a new version? Has this happened to anyone before? Does a new version post straight away?

    This is what you need, some of these things he needs to do
    Assembling the I-129F Package: Checklist

    2.Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
    3.Form I-129F: Petition for Alien Fiance(e) (see example)
    4.Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.
    5.Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)
    6.Proof of having met in past two years. (click here for examples)
    7.G-325A filled out by the US Citizen signed and dated (see example).
    8.One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.
    13.Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.
    14.In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

    I would not contact a lawyer at this stage to handle the visa. It is all relatively simple, if not time consuming unless some issues arise.
    That sucks about your accountant! I would get everything in order with your tax first, I am sure you want to anyway for piece of mind.
    I have NO idea about the divorce no idea how to check if you are divorced. Can you search public records for divorce? Presumably she would have filed where you lived? Start there, checking with the county clerk there first as the previous poster said, then if no luck, I would go to where she first lived (home town), then I would try to contact her, find her, try family, friends, try to find her. Then if no luck I would contact a lawyer or get some free legal aid advice. HELL, why not even do it all at the same time??
    As moomin said, people have been approved with less but, have more, protect yourselves, save yourselves for RFE's refilings and denials by having the utmost evidence!
    As I said no way to expedite unless you are actively serving - I know it sucks!
    My ultimate advice is , 1) fix tax, 2 ) find out about divorce and refile if needed , 3) once tax and divorce issues are settled, then file k1 as you cannot file for k1 if still married or not free to marry (well you can but it will be denied.

    If your partner wants to do some things so it does not feel like she is doing nothing while waiting she can; get her vaccinations that she will need during AOS; look into getting her police certificates for all the countries she lived in for 6 months or over after the age of 15-16 (not sure which), though with police certificates the Aus one is only valid for 1 year so it is time sensitive; gather evidence of your relationship; write her letter of intent; fill out the G325a and go over all the other things she may need to do for the process so at least on her end all she will need to do is give you the items or send when when the time comes and it is quick, quick, quick once your issues (tax/ divorce) are resolved.

    Firstly, welcome to VJ. These forums are great and I hope you get a lot out of them!
    I can't answer all your questions but I can give you a little advice from my own experiences/ what I know.
    One thing I will say is when / if my visa is approved I will not be an "Ex-Australian" people might get funny if you call them that. Though I am moving to the US to be with my partner, I am still an Australian, I hope to have dual citizenship and I will always consider myself Australian and or Australian/American
    1) I am currently working with my accountant to correct and bring my taxes up to date. Because of recent economic issues affecting my
    business, I will be filing at a loss. I do have my parents business to co-sponsor if I need to meet sufficient income. However, even
    operating at a loss, I still make more than the required income.
    I do not see a question here.
    In terms of income, all you need is to be above the threshold and prove that your fiance will not become a public charge. If you are above that threshold you will not need a co-sponsor. You will probably be asked to provide tax receipt for the last 2-5 years so make sure it is all up to date and above board.
    2) I cannot locate my ex to see if the divorce papers filed years ago went through or not. If it did I do not know where to file for an
    original copy of the divorce. If I have to file for separate divorce again do I need to file in the state I was married or can I file in
    current state?
    I believe you can file from anywhere. I would consult a lawyer to find out how to go about finding out if you are divorced or not.
    You both MUST be free to marry when you start the K1 process so you need to know BEFORE you start the petition.Or it WILL be denied
    3) Will the short amount of time we spent together affect their decision?
    You need to have proof of an on-going relationship with intent to marry. It may look suspicious if you have been together for a short period of time. I would say 6-12 months is a good place to start. You started seeing eachother in September of 2011? That is 5 months so considering you need to get your tax in order and find out about your divorce before you file, this should add time to your relationship and you should be fine. You need to provide lots of evidence of you relationship, so be prepared, emails, plane tickets, letters, cards, tickets, skype, photos of you two together. If you have been together for a short period of time I would get more evidence- it cannot hurt!
    4) Will her denials for student visa and recent travel visa affect their decision?
    They may want to know why she was denied but this petition should be seperate and evaluated seperately.
    ** Why does your partner still need a "travel visa"? I am curious as to why your fiancee cannot travel on the VWP?
    5) Does my veteran status help at all?
    Nope.
    Will writing to my congressmen help at all?
    You do not need to do this and they will probably tell you to start the process first. Congressmen generally step in after the fact, during denials, AP, long waits on NOA2's etc , I believe.

    Hi, as long as your answers are the same, whether or not you say you are part of a swingers club or not partaking in sex until marriage it doesn't matter. I consulted an immigration attorney on this matter recently actually and this is how I knew!!! A apart from being a prude, it is my belief that talking about ones sexual life is not appropriate with strangers, even an IO.
    As long as the answer are the same and streamlined that is all the matters.
    The OP was not going to be tested / examined to prove the validity of her statements as to whether or not she had had sex. If she and he partner had both stated they were waiting until marriage to have sex that would be that.
    If my partner and I walk into an interview and state we are waiting for marriage that would be the end of that line of questioning.
    It is not jeaopardising ones chance to be with a loved one to say that at all.

    Similarly, a friend of mine had a second interview (not in Australia) and due to religious reasons she stated she could and would answer said questions but it made her uncomfortable and was not inline with her religious beliefs, the IO then asked one for the less invasive sexual questions (lol) and moved on.

    You are always within your right to express how you feel and your discomfort. IO's are not there to make our lives harder but to protect USC's and the country as a whole.

    I think that is a terrible idea. Someone has left their home country, possibly made a life in the US, their marriage disolves and then it's like "OK, cya you have to go back". A lot of people who used the K1 get divorced. It would be cruel to make the beneficiary leave if they did not want to after a marriage breakdown.

    Hi, my partner and I just started our journey and this is a concern for me aswell.
    What we have been looking at:
    1) Volunteering opportunities for me in my future town, your husband can volunteer in his work field or try something new. This will help him make new friends, possible future work connects and make him feel like he is doing something worthwhile.
    2) Home improvements, I am not sure in what shape your home is in but your husband might like to do some improvements, gardening, projects like a new desk, table or something similar?
    3) Short courses, a lot of the time you can still study, at least a short course while waiting for AOS.

    1) Volunteering opportunities for me in my future town, your husband can volunteer in his work field or try something new. This will help him make new friends, possible future work connects and make him feel like he is doing something worthwhile.
    2) Home improvements, I am not sure in what shape your home is in but your husband might like to do some improvements, gardening, projects like a new desk, table or something similar?
    3) Short courses, a lot of the time you can still study, at least a short course while waiting for AOS.
