  1. She can travel up to 8 months I believe. How many months pregnant is she. She already has the K1 VISA in Hand? If so, and she is under 8 months pregnat, then I would buy her ticket asap, get her here, marry her and put her on your medical insurance immediately. If the baby is born there ou have addition paperwork to file for birth abroad and to get a passport for the baby. It may be more of a hassle if you waitt. Search the forums and you will find what you have to do for the birth abroad.

  2. I believe it is possible. there will be another visa apllication fee. as has been pointed out, if the baby is born in the Philippines, you'll need to file for CRBA and get a passport for the baby.

  3. This is incorrect. The household count only goes to 5 after the baby is born. While the baby is gestating, he/she is not counted. For the US government to count the unborn baby as part of the household, the US government would need to acknowledge the unborn as a person. And, I don't believe the US government is anywhere near to granting an unborn any status as a person.

    If the unborn is counted in the household, wouldn't the unborn need an immigration visa too? Seems ridiculous to say the unborn counts for the household, but doesn't need a visa or passport to enter the US while still inside of mom.

    The household count is 4; the US citizen petitioner, his two children, and his fiancee. When the baby is born, the household count will increase to 5.

  4. Yes you will now reference the poverty guidelines based on a family of 5.

    Her pregnancy will have no adverse affect on your K-1 petition/process, other than increased cost to do so now.

  5. so i went to the phil last 2weeks ago stayed for 5days the come back to the states.now im back

    and i think my fiance is preggy or think she is this is not going to affect the K1 visa?

    i got 2 kids by the way and us citizen which is good. does my income have to be more?and wat if

    she's preggy is that going to add 1 more for the poverty guide..which is going to be 5 ryt

  6. The CO has some discretion, and the closer the relation, the better. However, they would be joint sponsors, not co-sponsors. The joint sponsor would have to meet the income requirement on his/her own based on the joint sponsor's household size plus the immigrant.

    The I-134 is not enforceable, so unless the offer is credible, the CO is not likely to accept a joint sponsor.

  7. Do you earn above the poverty line for 4 in a house hold? Meaning yourself, wife and two children.

    Poverty Line for hould of 4 is $27,973.

    If you don't earn over this you will need a co-sponsor no if's and's or but's.

    This the income guideline issued by DOHS (Department of Homeland Security)

    us embassy accept co-sponsor ?

  8. my income is 24,000 and i have 2 kids which by the are us citizen but stayed with my fiance in the Philippines so my dependent would be 3 so is my income good right i have no problem on the poverty guidelines or im missing something ANY ADVICE ?? THANKS

  10. Once again I'm here to ask a question. My 2 daughter was born in saipan usa, Now i want to know if i can claim them on my tax return even if our daughter is living with my fiance outside US or my daughter needs to be there here. Hopefully there are someone who can give us good advice. Thanks and more power to all of the member of VJ. God Bless us all.

  11. I file 3 on my dependent but i got two kids since their us citzen but my 2 kids are in the phil with my fiance is that ok and im planning to bring all 3 once she got her visa? and claim on my tax ?
