OMG!!! So, my ex got his approval letter today!! I was definitely prepared for an RFE, interview, etc. since we're a divorce waiver but I'm glad that our paperwork and evidence was sufficient!

Wow, that's so great to see some April filers already approved. I'm sure that ours will be one of the longest since we have a divorce waiver... but we had excellent evidence, so we'll see what happens! Congrats and I'm sure it won't be too much longer for those of us still waiting

Hey guys! Join the April 2015 filers thread for sure. We sent our package on the 15th, they received it on the 18th and our check was cleared today. It came up yesterday on my ex's bank account as processing and then today it cleared. So it was 10 full days for us before we saw anything in our bank.
We sent our package to USCIS Vermont on Saturday, April 18th 2015
They received the package on Monday, April 20th 2015
As of today, they have not even withdraw the check and no Receipts
I am worried also

Took a break from packing the moving truck ... good thing ... Dave checked his bank account and his check will be electronically processed tomorrow!

Hi there! Good luck to you! Here are a few thoughts I had. Some of these may be a stretch, but it can't hurt, right?
- I don't think the affidavit from the friend with a criminal record will matter, especially if it's something more "Minor." But instead of her, what about affidavit from the grandfather saying that you lived on his land and didn't have a formal lease?
- Did your wife travel with you back to the UK at all? Do you have any travel itineraries showing that you were on the same flight at the same time and traveled together?
- With your photographs of you two together, try to include some that have you two + other people so it shows that your friends & family know you guys are together and public with it, if that makes sense.
- Definitely agree on the tax transcripts vs. the tax returns. You can print them out right now: http://www.irs.gov/Individuals/Get-Transcript
- Are you on the same medical insurance now?
- Do either of you have a 401k that you could add the other as a beneficiary on?
- What about your cell phone? Are you on the same family plan?
- Screen shot of your Facebook page showing married to each other?
- You should be able to open a joint account at most banks for free if you already have individual accounts. There might just be a $300 minimum
- Any copies of emails or cards to you both inviting you to things or any documentation where someone else has addressed you as a couple?
Howdy, VJ! Long time no talk.
Today we received an RFE on the removal of conditions on our CR1 visa. Here's a super quick history for those interested:
Got a fiancee visa in 2010, came to the USA, got married.
Got cancer in 2011, literally weeks after our marriage - moved back to the UK to get it treated. Fiancee visa was anulled and we had to start over.
Applied for a marriage visa in 2011.
Approved in 2012, moved back to USA (for good this time!)
Had our Removal of Conditions come up last September - applied on time, had the biometrics done late last year.
Moved from TX to GA late last year - updated the USCIS of our move, etc.
Heard nothing from the USCIS for over 6 months, started calling, etc, then today we received a RFE stating we haven't supplied enough evidence.
Here's what we supplied so far:
- 2013 joint tax return
- Joint TX liability car insurance
- Photographs of us together
I get why that isn't enough, but we're a weird case - in TX we lived on my wife's grandfather's land, so we didn't pay rent. Our bank accounts are seperate, we haven't had insurance or anything - we're pretty poor, y'know?
Here's what we're planning on submitting this time:
- 2014 joint tax return
- joint bank account proof, but we need to talk to our bank to see if this is affordable
- our joint gym membership, as both of our fees come out of my bank
- New GA joint car insurance
- Affadavits from my mother (talking about how, when I got cancer, my wife moved to the UK for 6 months to be with me for as long as the law allowed), and a bunch of her family we lived near in TX (like her grandfather).
- Affadavit from her best friend whom we see often, unfortunately she has a criminal record - would this look bad for us? her record is nothing to do with immigration fraud, nor is it a big thing, but it does exist.
- Letter from the sperm bank I froze specimens in before I underwent my cancer treatment, which lists my wife as permitted to use it.
We're not sure what else to use - we don't pay joint utilities or rent, we don't own any property, have no kids, no loans, no wills/trusts/etc.
So my questions are:
1) Any evidence we've overlooked?
2) Any problems with the list of evidence we're going to submit?

Looks like a lot of people who filed after the first week of April haven't seen much yet. We sent ours on the 15th, and it was received a few days later, but haven't heard anything. Check hasn't been cashed yet and no NOA1. Maybe there's a delay because they've diverted resources because of tax day on the 15th? Or, everyone is out on spring break?
I guess we are all on the slow boat. We sent ours on April 9th, received on the 10th.

We used USPS as well. For the K1 and AOS, we used FedEx. Since we were sending to a P.O.Box, we figured USPS would be easier in this instance. And somewhat "happy" to see other people haven't received their NOAs or checks cashed yet. I was worried and we sent everything off on 4/15! Sounds like we have a bit more of a wait. Maybe we should have done this in March before the big rush from tax season.
I sent mine through USPS, I came across recommendations from other applicants to send my application through them because it is a government facility, and it is highly trusted by USCIS since that's what they use to send notices and envelopes too.
As long as they're able to deliver it to its destination that's all that matters. -
Congrats! We're filing with a waiver as well - my ex-husband is the green card holder and I'm the U.S. citizen. We are actually in the process of reconciling and i'm hoping this all goes smoothly

I am also filing for ROC. Everything you have looks good. I slimmed down my bank statements and have gone from 45+ photos to 27

Looks like good evidence. Thirty pictures is a lot, especially printed out on photo paper. Consider trimming down the number of bank statements. Every month isn't necessary. If you had the same account in Jan, Jun, and Dec, isn't it fairly logical that the same account existed during the in between months?
He doesn't have to wait. He could have filed last October when the divorce was final.

I'll save some paper print the bank statements on a quarterly basis. I can also reduce the number of photos. I also thought of one more thing I could add - our travel itineraries. I was looking through old emails and realized we did travel together a lot, so would be good to show us sitting next to each other on the same flight. That'll also match up with the bank statements and photos.

Hey all! Getting ready to file the I-751 and a lot has happened since I've really been active on this forum. Unfortunately, my husband (green card holder) and I (U.S. citizen) have divorced. We truly did enter into our marriage in good faith, but issues with money, stress, etc. got the best of us. Thankfully, everything has been amicable and we are actually working on reconciling
Ultimately, I want to help him through this process and do whatever I can to ensure it goes smoothly. But, as always, things get complicated when paperwork, governments, etc. are involved. I want to make sure we aren't missing anything with the below list. Some basic facts: We married in Aug. 2012, separated in April 2014, divorce was final Oct. 2014, and his green card expires end of June 2015. And he's in the process of moving back in with me now so he's updating USCIS with my address and I-751 will show my address. We're hoping to submit the below packet in the next week or so. Anything else we should add?
- Check for $590 payable to U.S. Department of Homeland Security
- Form I-751, with waiver based on marriage entered in good faith and terminated because of divorce (signed only by him, not me)
- Additional information for Question 22 with his other address and date moving in/out
- Copy of his permanent resident card
- Copy of divorce decree
Evidence of marriage entered into in good faith:
- Tax return transcripts for 2012 and 2013 (married filing jointly)
- Lease for our apartment for 2012 and 2013 showing both our names
- Copies of bank statements for all months from September 2012 through March 2014 and then a copy of the letter once our account was closed
- Copy of of my insurance card showing him as beneficary
- Copy of medical records showing him making claims on my policy
- Copy of my life insurance/401k showing him as beneficiary
- Signed copy of buyer's order and loan agreement for a car purchased in both our names
- Copy of insurance policy in both our names
- Detailed phone bill showing both our phones on the same plan through date of divorce
- 30 pictures of us together in various places and also with friends/family that we'll put in a ziploc bag and then tape the bag to a piece of paper
- Signed affidavit from me that I'll have notarized
- Signed affidavit from friend

Obamacare does not count as a "government benefit." It is insurance purchased from a private company.
He will be eligible for COBRA coverage from your employer. Depending on his age, that may be a better option for him. (If he's older is is more favorable, as COBRA prices are not age-dependent while polices sold through the exchanges are.) My guess is that if he's over 50, COBRA would be the better option. But it can be a complicated question.

So... I never thought I would have to post this considering everything my husband and I have gone through to be together, but we have decided to divorce
Unfortunately, things just haven't worked out between us. But, the good thing is that we are committed to being as amicable as possible and remaining friends. I apologized if this has been asked before, but I can't seem to find prior threads. Feel free to point me in the right direction. He arrived on a K1 and is now a green card holder. He is on my insurance now, but will obviously need to get his own after we divorce. Is he eligible for Obamacare or does this count as a government benefit?

Hi Folks! I would assume many of us are still waiting for our Green Card to be approved. Has anyone who filed in early October been approved yet? My case has stayed at NBC and my filing date is October 19, 2012.

Ah, I just looked and they're only in Illinois, Michigan, Indiana, Ohio and Kentucky. Eastern half of the midwest only, my apologies for not being more accurate in my description.

On July 6, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.
As far as i know stayed at NBC all the time. (local office is Dallas) No interview, no service requests, no RFE's .... just a long wait

Just a update USCIS NBC had a interview with the AILA - note questions 2 and 8 which are relevant to us
We just received my guy's green card in the mail as well (congratulations djricky4!) and question 8 is very interesting - we received our green card almost exactly 8 months after sending in the AOS packet.
Anyone who is an NBCer and who has been waiting longer than 8 months should file a service request!

Hi,
I've been here in Boston for 6 months now. I have a good job i am established and earning decent money.
I am trying to lease a car, i negotiated a fantastic deal. I was told i needed a cosigner, this would be my wife, this was rejected due to her having a car lease under 1 year. In steps her father, he is willing to be a cosigner, this again rejected. They explained that i am not allowed to open a car lease in my name until i have my green card. I have a EAD and AP with expiry date of Feb 2014, by then i assume my green card would have come through. They explained only way i could get car is if my wife opens up the lease, no point as the whole point of this lease is for me to establish credit in this country.
Any advice, similar stories, seems frustrating as i have a job income, doing everything by the book, yet i cant even get a car lease until i have a green card!!!

Hi Mark - we had somewhat of a similar situation when me and my guy bought a car in both of our names in January. The good news is that I'm sure you'll be able to find something since I don't think the green card requirement is a widespread policy across all banks/lenders.
Here's our story: I'm the US citizen. I have a car just in my name that I leased in November 2012. We did it this way because we only had one car, my old car died out of nowhere and
just needed to get something ASAP. Anyway, in January, I started a new job and our financial situation greatly improved. So, we decided this time to buy a car and then put it in both me and my guy's name so he could build credit. We made a pretty decent downpayment and then took out a loan for the rest of it. At the time, he had a SS#, bank account, EAD but no job and no green card yet. His green card was actually just approved a few days ago.
But, when we went to buy the car, two banks rejected us when it came to the financing portion. The reason they gave us wasn't because he didn't have a green card or because he didn't have a job, it was because he didn't have "sufficient credit history." The fact that I had a lease within the past year didn't matter at all. It actually increased my credit rating. The finance director assured us that he could find something and said that each financial institution will have their own policy. We ultimately ended up getting the loan through a credit union in the next state over. For them to approve us though, they wanted the dealership to fax them a copy of my guy's social security card and provide a copy of the letter we received from the social security administration when we originally applied.
So, a few thoughts... I'm not sure about lease terms, but it might have to go through the particular car company's finance division so you might be out of luck there. I think our car loan is set up with me as primary and my guy also on the lease. Everything would affect both of our credit, so is there a way that your wife could approach the dealership and then say that she wants you on the lease as well? Maybe buying a car would be a better option since you would be able to go through different finance companies? If you find something with something like 0.9% financing and no money down, you might be able to get a 60 month loan for not much more than a lease.
