My brother in law is working as an overseas worker in Saudia Arabia. His contract is up in December and he'd like to visit my wife and our family.
Would he process the visa in Saudia Arabia but at the Philippines consulate there? Or should he wait to go home to the Philippines and then attempt to process from there?
 
I will be going to look up requirements next. This is just in case there are some shortcuts since he's not current in the PI.

Wow!! how can you assume this merely because it didn't happen to you. Our petition was submitted in March, complete with G-1145 form. We didn't receive an NOA1, and the check wasn't cashed till May. By then, we were frantic. It has taken some unravelling but it appears that our petition was split up and sent to several places. It HAPPENS !!!!!!!
OP, do not assume that your USC partner is at fault. Get them to follow up and ask to speak to a Tier 2 person at USCIS. There are several other people that have posted recently that didn't get an NOA1, the system is in a mess.
Best of luck... don't automatically doubt your fiance. Also, the Case Status is unreliable. In many cases the status never leaves INITIAL REVIEW. Updating of this is not a priority and many people have been approved and beyond and their status has never changed from Initial review. By all means check with USCIS with a Tier 2 person before accepting what you have been told on this thread. Believe me, its not unusual for this to happen... best with your process..

I've seen a number of people complain about the 125% of poverty requirement. 125% of Poverty level is really NOT a lot of money.
The next part might seem harsh, but if 125% of poverty level IS a lot of money to the USC, then maybe they should reconsider whether they have the means to bring a foreign national to the US for marriage, and to start a family.
No I'm not hating... and I don't' want to start a flame war, I just want to make sure people are prepared for their situations. Part of that is planning for the unexpected, having money put away for a rainy day, etc. is part of that being prepared.
So I'm asking the VJ community for their opinions on this. Seriously no flaming. An intelligent discussion on being prepared for major life events.
I'd liken this to couples who actually plan a pregnancy for when they are emotionally and financially ready, and those couples (like most of us) who get pregnant and deal with the repercussions as they are able.

Your mother can't stay. She came on a visitors visa, for visiting. Even if you tried to AOS in country they will get the current petition and see that you are trying to aviod being fiancially responsible for your mother. She will be deportable if she overstays her visa and that will only make it harder on her ever getting a visa. Does your family have any assets that could be converted to cash ? It is a requirement that you show you can care for her before she will be granted a visa here or there. Forget trying to fudge the system and concentrate on overcoming the issue of support. If you can't overcome the issue then you may have to move on to finding the best way to care for her in your country.

This is the internet and nothing more than a discussion forum. People here are random strangers sitting at desks hundreds and thousands of miles from wherever you are.
You've never met any of us and likely never will. People in forums are not your family and they're not your personal friends. Nothing anyone says on any internet forum should be taken personally. If a stranger of a forum says you sleep with ferrets, it doesn't affect you, your life or what you'll have for breakfast.

One thing that I have learned on VJ is that in many cases the best, and most helpful answers are also the harsh, straightforward and blunt answers. Sugarcoating doesn't help anyone.
Remember this: It's not us you're trying to convince, it's the IO who has complete authority to approve or deny your case, and thus decide your fate. If a VJ member plays devil's advocate, it's to prepare you for a worst case scenario.

Again well said. collecting 100's of pages on either end is a complete waste. If you have a real relationship and meet the guidelines, they are barely going to glance and the proof of relationship. If it makes you feel better to print 100's of chat transcripts, send 30 or 40 pictures, journal etc, then go for it, but it's a complete waste other than making you feel better.

I totally agree. I know my wife loves me but she also said she wantred a better life for her children and her and I'm ok with it.

Lots of answers sound great when you first hear them, people in positions of power hire professional writers to do just that, write amazing sounding responses, to enable them to move on to the next question. We get used to these kind of quick answers because we see them on the news all the time. So we want quick answers to OUR problems. The issue is, there are no easy answers to most of our problems. None of us want to hear that, but it's basically true.

and this is exactly the reason it makes it so hard for the rest of us abiding by the rules. just irritates me that people take advantage of the system then wait until they get in the country to screw around with the rules of the visa...i will shut up before i get myself in trouble

Finally! My Medical was done in 2days.. and I almost missed my Flight! Good thing I was able to talk to one of the personnel on the releasing area and told him that I have 1 1/1hr left till my flight. He looked for my medical worksheet and gave it to the counter and was able to finish in time
Anyhow, here's my experience when I had my medical.. I'd like to share it since this is also in return to those who posted here before regarding their medical walk through which really helped me a lot and was able to gain ideas from them before I went for my medical
*I arrived at St.Luke's 11am (since my flight was 630am so arrived 9am at the hotel, decided to eat breakfast first to have plenty of energy). It's really GOOD to go late noon time/in the afternoon everything moves fast in the first day and finished everything in less than 3hours. so the whole 1st day medical It was 1130-1230 (1230-2pm BREAK at the Mall) and 2-3:00 pm Done until Immunization Interview and scheduled for vaccine the next day.
MEDICAL EXAM FIRST DAY
1st step: VERIFICATION at the Main Entrance
Before Entering, I approached the Security Guards and they Verified my Documents (they asked for my NVC letter w/the MNL case no. and Schedule of my Interview date at the Embassy)
2nd Step: Fill out Patient Data Sheet and proceed to the Counter at the Reception Area
Although I have already Registered online for my Medical, It took up less of my time to fill out my registration and the person from the Information area just gave me a Form to fill out my BIO. then directed me to the K-Counter at the Reception Area for data encoding, digital picture taking and fingerprint scanning (Right Index finger, 4x) She then told me to pay at the Cashier on the 5th floor.
Req's: Passport, Passport Photocopy, NVC letter (2copies), Appointment Letter/Schedule of Interview at the US Embassy, 1pc. 2x2 Visa Photo with your name written on the back and together with my Online Registration Printed Copy (If you did online Registration)
3rd Step: U.S.A Counter w/vital sign taking
Although the lady told me to go to the cashier, the guard from the 5th floor directed me to the U.S counter and told me to go to the vital signs counter and they took my BP (Blood Pressure) and was asked to take a seat after and wait for my name to be called.
4th Step: Eye test (using Snellen Chart), Height and Weight determination
When my name was called, I was told to go inside the Room to have my eye test done and determine my height and weight. (although I don't have glasses nor wore contact lens, i had a hard time with some small letters.. I guess I really need to get my eyes fixed )
5th Step: Radiology
From the 5th floor they told me to go to the 3rd floor for my Chest X-ray. Changed into my gown and went inside the X-ray room. Then after I was told to go to the 4th floor for my Blood test and Urine.
6th Step: Laboratory (for Blood/Urine)
(This is really unforgettable and such a mess i made ) From the 2nd floor, I went to the counter and told them I'm here for my Blood test.. they we're all looking to me in their confused faces.. and told me "there's no blood test here".. and told them "they told me to go here in the 4th floor to have my blood test.." and boing! told me "sorry this is the 2nd floor, not the 4th" I was really embarrassed since I decided to take the stairs from the 3rd floor.. so instead of going up, I went down.. thinking I was still in the 5th floor. lol. So from there, They took my Blood test and after that, (another mess) after I had my urine sample, it accidentally slipped on the floor.. (such an embarrassment..) and Nurse told me that she'll give me another specimen cup and told me to be back after drinking lots of water.. (but although I don't wanna waste time) told her that i'll be doing it now since I still gotta go, but when I urinated, just a few drops of urine i was able to provide.. But it's still ok though they just need a very few amount. and after my embarrassing mess, they told me to sit down and wait for my name to be called..after less than 5 minutes...
7th Step: Check out Counter
they told me to proceed to the 5th floor.. so when I went there, they told me to be back at 2pm for my Physical Exam
8th Step: Physical Exam conducted by the Doctor
so 10 minutes to 2pm, I arrived at the 5th floor and proceeded at the U.S Counter and told me to wait for my name to be called. After like, 10minutes, they told me to sit down outside the Doctor's room and wait for my turn. So when I entered the Doctor's room, she asked me some questions then asked me to disrobe my clothes, told me to wear a gown, and asked me as well to lower down my gown for Physical check-up. Everything turned fine, and then after changing my clothes, she asked me another set of questions and told me to go down at the 2nd floor for my Immunization Interview.
9th Step Immunization Interview
I went to the counter on the 2nd floor and told them I'm here for my Immunization Interview. So they directly told me to go inside the room for the Doctor is already there and will ask me some Immunization Questions.
Just a tip: Just be Honest w/everything they ask, it's still for your own benefit
then after my Immunization Interview, I was asked to go back to the counter, and after that the Lady on the Counter scheduled me to be back at 2pm the next day.
Everything done at 330 pm:) was able to go shopping and had a plentiful dinner w/my Mom and sister(who was already staying in Manila)
MEDICAL EXAM SECOND DAY (The start of the long WAIT)
1st Step: Guard Counter checks my name on their record/master list
The Guard asked me for my receipt (from the Clinic) and Searched for my data on their record.. He then told me to proceed to the Second Floor under Immunizations
2nd Step: Immunization
When I proceeded to the Immunization Section Counter, I was told to sit down and wait for my name to be called. (After 20mins).. I was asked to go to the Immunization Room and before Injecting (3vaccines) the Nurse Interviewed me w/some questions like when's my last period, allergies, hospitalizations..etc.. until we led to the topic on what's my profession and told her I'm a nurse, and she was surprised that she was also talking to her colleague all along Anyhow, She gave me my vaccine (3 shots) and then was told to go to the ground floor for the releasing of my Worksheet (Immunization Copy and Xray CD).. this is the last part of the whole thing, but was the LONGEST WAIT during the whole process.. I went down around 230 am and waiting for my name to be called (I was really worried since I have a flight at 630pm back to my Province) so 430pm they called my name and had me sign for me agreeing w/whatever the terms were stated there.. then told me to SIT DOWN again and wait for my name to be called Clock's ticking and every minute I look at the time since Manila is really traffic and very congested.. So 2hrs before I must check-in and 5pm, my name still isn't called.. so i decided to approach one personnel on the Releasing Section and asked if he could do me a favor if he could check on my papers since I still have a 630pm flight.. (thank God to this good Samaritan) he looked for my Data and asked favor for the Counter for Fiance Visa section that I'd be the next one to be released.. so they we're really generous enough and the Nurse from the Counter gave me Final Instructions and what to bring to the Embassy and what to photocopy and in less than 5minutes was able to finish everything and I really looked for the guy who helped me and thanked him and ran outside the clinic, saw my mom really worried that we'll miss our flight.. and THANK GOD the driver from the taxi we rode, had a lot of shortcuts and drove as fast as he could get us to the airport(avoided all traffics) and when we we're about to check in, it's already the Final Call! and FINALLY, went safe back home!

Just a tip: 1. Don't waste your sleep going to the Clinic very early in the Morning (trust me) if you're not patient enough in waiting. Going during noon time/in the afternoon is a very smooth sail to get things done without any hassles and no hurrying and less worrying!
2. It's GOOD if you were able to register online at SLEC. it saves time here's their site for online registration: http://www.slec.ph/us-visa-applicants.shtml#required-docs (hover on the ONLINE REGISTRATION link and click)...and voila! fill out all that is required.. open your email, and print the Confirmation Letter

We used the sample letters here exactly as presented, added our names and the correct date of course. Have her sign a couple of them just in case.
In addition to filling out a G-325 bring a few extra, signed, blank forms for her to sign. I actually had Alla sign the forms and we later added the information over the phone when I got back. We had better things to do when we were together.

If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray
On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.
Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.
You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:
battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
food items (refreshments are available for purchase in the waiting area)
sealed envelopes or packages
cigarettes, cigars, match boxes, lighters
sharp objects such as scissors, pen knives or nail files
weapons or explosive materials of any kind
If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.
They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.
Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).
That's it for the USEM interview. You can now breathe a little easier.
Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.
It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

Consent to marriage of a person under age. (for those who are 18-20 years old)
Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.
It's all on the Consular's discretion whether they require consent from a parent or guardian.

You will need to pay a NAIA International Departure Fee: PHP 550 mandatory at NAIA.
Also when you book your flight. Check to see if all airport taxes are include in the price of the ticket. If not, your fiancee will need to pay the " Filipino Travel Tax " of P1,620.

Wow, sounds like a southern baptist. They LOVE to judge, and are way more focused on Hell in my experiences than other denominations. [No flames I was raised methodist / baptist and have attended a southern baptist church for 2 years. (in the past)] I am surprised he didn't realize the thing about religions springing from the God of Abraham. But good for you for recognizing that Jews, Christians and Muslims all pray to the same God. That shocks a LOT of people. I often think God is really pissed at a lot of his followers (of all faiths )
We are no where close to a perfect society, but I think we are the best country overall. I'm a true believer on that. I just try to not be blind to our faults.
