    Takes about a month to get a UK PR type Visa, you can do it quicker if you are in a rush.

    "Invite" him? I'm not sure what you mean. He has to apply for a visitor visa on his own. There is no invitation or you keeping the pregnancy secret. This is a visa he needs to apply for on his own in Nigeria.
    And once it asks where/who he will be staying with and he says "my USC wife", it will be denied. Not trying to be mean or blunt, but there is no chance for visitor visa in this case. And if he misleads about the pregnancy, he could get in trouble.
    You keep saying you don't want to apply for CR1 right now, why not? It would allow him to travel back and forth (with limitations, of course), but that visa is your ONLY option. It is not confusing at all...that is the only avenue you have for him to come here.
    And you ask why he would be denied or suspected of staying illegally? You answer your own question...you already admit the CR1 visa "takes longer". So, this for all the world, would look like you're trying to circumvent the CR1 visa process, have him come on tourist visa, then try to readjust status. I'm sure you would tell me how could I dare accuse you of such a thing, and I'm not. I'm just telling you how USCIS and/or State Department would look at it. And that's why he would be denied.

    Did that statement say that a letter from a congressman FORCES a VO to change their decision? (no)...did the statement say that if an applicant presents such a letter that they are automatically issued a visa? (no)....so my view stands...letters from congressmen cannot 'work magic' on a VO's decision....the process is (and is supposed to be) free from outside influence...at the consulate in which I worked some years ago, any applicant presenting such a letter was refused 98% of the time...why? because the presumption was that their case must be bad or else whyu all the baloney from some congressman who does not even know the applicant? All the VOs are required to do upon receipt of a congressional inquiry is answer the inquiry within three days....that's all.

    Getting marriage for Immigration Purposes is not fraud and not against the TOS.
    I think you forgot the word solely, which I certainly would never suggest.

    I think, in the divorce decree, the husband was awarded a portion of the wife's retirement pension, to be paid out :
    1. when the man reaches retirement age and
    2. he maintains his 'not married ' status.
    You've got the terms right, but IMO there is not any alimony - just a financial settlement in the divorce decree covering the disbursement and percentage of the retirement pension, to be paid AFTER the man reaches retirement age.
    I could, of course, be wrong.

    If it is a benefit of his ex's social security he is referring to, which I doubt since that can't be awarded in a divorce action, he loses all of it as soon as he remarries, doesn't matter if he remarries at 35, 65, or 85, when he remarries it stops. IF he has been divorced (from new spouse) for more than two years he qualifies to draw on his own SS, or any of his ex's, depending which is biggest. (double check on the ss government website).
    Since you refer to this being part of his divorce action it is probably her pension it is referring to which is separate from SS. This would be dependent on the terms of the Court Order and if it says he loses it if he remarries, etc. So for this he would have to actually read the Order. In my case there is no reference to me losing the benefits if I remarry since they were something I obtained an interest in from being married to my ex.
    To the root of the issue. What he is planning to do to this woman and child is very unfair. To ask them to wait six years or longer (or forever if they have a falling out) to obtain any sort of legal status in the US is wrong. And as stated previously the child will be SOL even if they marry later. This poor woman probably thinks she is going to come here, marry, and live a life of luxury when in fact she will not be able to drive, work, etc., she will have to keep her status secret from any friends she may have, etc. What he is planning to do is selfish and illegal.

    The way I see it, it's easy. Now that you can tell them exactly what would happen, they have two options:
    A) Get married as per the requisite of this visa
    B) Not get married and live with the consequences
    Whatever they decide, it's their choice, and theirs ONLY.
    Do I think what they are doing is stupid? Yes, ABSOLUTELY. But this isn't my life

    and this is exactly the reason it makes it so hard for the rest of us abiding by the rules. just irritates me that people take advantage of the system then wait until they get in the country to screw around with the rules of the visa...i will shut up before i get myself in trouble

    Any decent immigration attorney would know you should include proof of a bona fide marriage with the petition.you really don't need a lawyer for this process..if you follow the guidelines here on VJ you can do it all yourself. Lawyers are a waste of money unless you have a complicated case

    this post is hard to understand...there is no punctuation...slow down and explain it so we can understand...when was the k3 filed..when was it denied? when was the i 130/cr1 flied..when was it denied? and what were the reasons?

    If his gross income $24,000 the net shouldn't matter cos they are asking for your gross amt. The CO can't over rule the poverty guide lines. I would send an email to the SCOP-ICE and report this abuse. If you got the name of the interviewer.

    Thank you Mr. Chou. I have studied US laws and earned a PHD. My wife has 17 years experience as a qualified teacher. But comments made to her by the Mumbai Consulate staff on May 17, 2012 (hope the Mumbai Consulate read this site) are patently uncalled for and are abusive. No one has the right to abuse a person in a vulnerable position by saying things like this and I quote "Why did you marry this disabled cripple?" and "your husband's Veteran Pension of $24,000+ is inadequate for your needs?". Further, paying or demanding dowry is against the law in India even though it is widely practised, therefore, the Consular Officer also known as Vice Consul had no right to tell my wife this: "Why are you against paying dowry and you could have married earlier than your 43 years of age?" Come to a United States Federal Court Miss Vice Consul and explain to a United States Federal Judge why you as a employee of the United States State Department working under Mrs. Clinton who is the secretary of the Department of State - you would advocate breaking the laws of a sovereign nation? I assure you Miss Vice Consul you would find yourself unemployed very soon. But at that moment on May 17th, 2012, you were full of your power and you exercised it in the worst possible manner thus making us wonder why are you in this role? This Vice consul also stated to my wife "you know you cannot have children now since you married late? I hope people reading this site are outraged and will write to Mrs. Clinton so she can stop this abuse.

    I got my all of my wisdom teeth pulled while I was in the military. It was under local anesthetics, and it wasn't bad. I was prescribed Tylenol 3 for the pain, but didn't need any of it.
    The funny part was I left my car lights on (it was an old car), and the car battery was dead by the time my procedure was complete. I couldn't talk and ended up writing on a piece of paper saying I just had my wisdom teeth pulled and my car battery is dead. It was just on of those funny moments in life.

    I went to an Oral surgeon here in Arlington and he was excellent. I did the whole general anaesthetic too, there is no way I was not! I was given a scrip for Hydrocodone but hardly used half of them. Either he was really good or I got lucky, but I had no bad pain at all.

    did you have to write a letter? did you contact the USCIS about your petition? NO...listen to me. They matched up the letter...all you need to do is put the case number on the letter. Why be argumentative? she came here asking for advice, i gave it to her...it worked for me. I don;t care if you disagree. I did it, and it it worked. Why are you even speculating that it may not be matched up? You are making her worry needlessly, putting far fetched notions in her head...I am stating facts, you are merely speculating
