  1. Hi all,

I got the e-mail today form USCIS that we are in post decision activity because the I-129F has been approved!

Now I am waiting to get the hard copy with instructions about what to do next.

I have read some not so great things about the Moroccan process so any words of encouragement would be great!

    WHEW .... first hurdle passed!!!!!!!!!!

    xx

    Liza

Congratulations on the approval. Have alot of evidence - even if they dont ask for it, its better to have it than regret later. Confidence is everything. Almost there be confident and be ready.

  2. Hello VJ family...

I just got home and checked the USCIS website and saw that our case was approved. I rubbed my eyes and closed Chrome and opened a new tab and went to USCIS web site again. :) yeap it's approved after waiting almost 5 months... We got our NOA1 on October 6th. We got no RFE...

    SOOO HAPPY NOW!!

Congrats!!! and good luck on the rest of the journey. Almost there.

  3. Congratulations!!! If you don't mind, would you please just list useful tips for this process for those of us dealing with the Kenya embassy? I see you guys went from I-129F all the way to the visa interview in 5 months, please pass on the luck :-) Just at the beginning of my process, hoping to be done with by July so we can make it to get married August/September. Anyway, I will appreciate any useful tips you can provide. Do you happen to know if the embassy allows for a co-sponsor? My fiance will move back to the US before my interview and hopefully get a job but just helpful to also know if a co-sponsor is an option since his father is willing to help.

All the best to you, you did it!

thank you. i feel luck - i did my naturalization in june and then started the process for my fiance so its been a few hectic months ----- soooo worth it.

i think i just added a note to the nairobi embassy topic. the embassy did not ask for the financial info from my fiance. when i interviewed with them they never asked for a sponsor - maybe its my luck. He said that so many fiances and married couples came through and were not asked for anything. am sure this is not always the case so have a co-sponsor just in case.

good luck to you. all i can say is once your case leaves nvc its up to you to follow up. My case left nvc and immediately i started checking my email. once they sent me the email he went to pay the mrv fee and booked the same day (give it a few hours - at least 4hrs).they have so many openings so you should get an appointment within a few days.

hopefully all will be well. any questions just message me - being from kenya and my fiance doing this process i feel like i have a pretty good idea about what to expect.

  4. aaaaaah finally approved!! I feel blessed.

Thank you to everybody on this site. Just reading what everybody is going through has made the journey easier. Also the embassy reviews and ideas on how to handle different things has been priceless

We are finally approved and i think the journey will be easier now - since we will be handling it together.

Thanks you and good luck to all of you. (L):D

  5. From reading the last sentence in the last paragraph it appears that it was sent for further review for some reason. It could be something simple. I suggest you call USCIS and ask for a tier 2 rep so they can hopefully go over the cause and remedy for this.

i actually just called them. the officer i talked to said this must be a mistake. For k1 usually this does not happen uless the embassy has an issue with it and my case never got past NVC. he said i would have to wait until the end of the review. Am devastated.

  6. This is sooooo confusing. Hope somebody can help me. :(

I got my NOA2 on Jan 4,2012. So I thought the case was going to NVC. Today I got this message ... what does it mean???

The last processing action taken on your case

    Application Type: I129F , PETITION FOR FIANCE(E)

Your Case Status: Post Decision Activity

On January 19, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

  7. Wrong.

Which does not mean some people have not been lucky.

Is the Italy move temporary or permanent, if temporary how long does he expect to be gone.

I am actually speaking from experience and from so many other people.

    Technically, you can leave for up to a year without asking for permission in advance, but anything six months or more is very likely to be questioned and closely examined upon return, and an officer can determine on the spot that permanent residence has been abandoned with less than a year's absence. You just have to prove that you maintained US residence for me i used my parents and family was still here. Other things might be;

    1. Joint property in the US.

    2. Joint bank accounts in the US with activity on them.

    3. Letter from university or workplace explaining that trip abroad was of a temporary nature.

    4. File taxes always always always and always always always file as resident of the US.

    5. Joint credit cards from US.

Another thing to consider is when the green card holder wants to apply for US citizenship. If they want to do it as soon as possible, they cannot leave the country for six months or more at a time. An absence of six months or more resets the "clock" on the three years.

  8. Hi

Assuming he has the greencard he can be able to leave any time he wants. USCIS allows you to leave but you have to enter the united states at least one day a year. There is a form you have to sign but usually they are not very strict on it. I used the same criteria to live in Kenya and only came back to the US to keep my green card active for 3years. Just check with your local USCIS office they will give you more info. But there shouldn't be a problem.

  9. Actually its possible to expedite. This are some of the reasons - try it the worst they can say is no. some people have gotten it on far less "emergent" situations.

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

•Severe financial loss to company or individual

    •Extreme emergent situation

    •Humanitarian situation

•Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

•Department of Defense (including military [sic])of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

    •USCIS error

    •Compelling interest of USCIS
