  1. Hi again!!

    So when replying to an RFE for my AOS/EAD requesting pay stubs etc should we send a whole new Affidavit and include my current income (as the immigrant alien) as this would put us way over the poverty guideline and i think make it easier????

    I am getting quite confused as to what we should and shouldnt do at this stage, obviously now i have a good job i am happy to include my income but i didnt know whether it would make a difference at the AOS interview if they thought i was working without EAD??? I currently have EAD from POE but i doubt i will get my EAD card before this expires, my employer is not concerned by this but i am growing increasingly bothered about the whole thing effecting the final decision. I am also not willing to give up my job now i have a good one!!!

    Should i just get my Father in law to co-sponsor us, i feel this would be easier?????

  2. Hi evryone,

    Need some help again!!!!

    We have just received an RFE for the affidavit of support, basically it is asking for six months pay slips as my wife's (USC) last years tax return does not reflect her current income. Although she is over the poverty guidline amount for this year there may still be a few issues??

    1 - she was in the UK with me for the first 4 months of this year so obviously didnt earn anything, not sure whether this would be an issue

    2- i have a job now so should we just send a new I-864 with my income included on it, also if i did this what kind of evidence would i need from my employer to state that i would continue with this job throughout this whole process???

    3 - my father in law would be happy to sponsor us as a co-sponsor, would this be the best and safest way of meeting their requirements??? i think it would just incase they have issues with me working if i dont get my EAD by the end of next month (when my temp one runs out) my employer is not concerned with this as they want me to work there!!!

    I know this post may be a little confusing as i am rambling a bit but any help would be greatly appreciated

  3. The online system is screwed.

    I say this because my case status hasn't been updated online since July 7th, but I got my interview notice in the mail today, so clearly they have been working on my case since then.

    I agree, its screwed!!!!

    I had biometrics today in Norfolk, i can now see my I-485 online (obviously with a RFE which i have not received yet?!!) but i dont see my EAD on there at all

    Just adds to the confusion of the whole unessesary process for me!!!

  4. You can only e-file for EAD if you did not file for EAD with your AOS... so you would have to wait until you had filed and received the NOA1 for your AOS before you could do e-filing...

    You would be better to file everything together.....

    Also if i do get this job is there any way i can extend my current EAD so that i wouldnt have to stop working and wait for my I-765 to be approved?????

  5. Hi all

    Has anyone E-filed their I-765 EAD application??

    Is there any benefits/advantage to doing this or should i just file it with the rest of my AOS package??

    The reason i ask is because i have an employment opportunity and although i have an EAD that i received at POE it expires sept 20th and i want my full EAD to come through quickly so that it wont cause any problems with my new job.

    Any comments gratefully received.

  6. We were in the same situation, my wife was a student last year so did not meet the income requirements but does now. There is no yes or no answer to this question (i looked long and hard for one) it is at the discretion of the interviewing officer.

    My advice would be that if you can get the co-sponsor to fill it in then do that. If they decide that you dont need a co-sponsor then they will simply not use it. This way you are just covering your bases.

    The immigration officers decision may also be dependant on how long your wife has been at her job, what the job is and how much she earnts.

    Sorry there isnt a more concrete answer to this

  8. Your fiancee and now wife will always be considered as your primary sponsor regardless of her financial situation. Her step father would be your co-sponsor.

    If your wife meets the poverty guidelines then she can fill out the I-864 and there is no need for the step father to. If she doesnt then your wife should fill it in as your sponsor and her step father as a co-sponsor.

    Also while i'm here!! - my wife does meet the poverty guidlines for this year but didnt last year so her tax return will not show good figures, will this make a difference??

    I'm a little confused... you mention "my wife" and "person who sponsored me for the whole K-1"...

    who do you consider as having sponsored you for the whole K-1 so far?? Can you clarify the two people your talking about...

    i had my then fiancee and her step father both fill out the I-134 for my K-1 interview.

    Feeling a bit confused about the whole I-864 thing.

    can my wife (us citizen) fill this out or will it have to be the person who sponsored me for the whole K-1 process?? or both??

    Also what would she have to make a year with no dependants and just to sponsor me??

    Any help would be greatly appreciated, this is the only thing left to do before sending off all the AOS paperwork.

    My packet 3 is out of date and i need a medical asap as i have just sent off checklist for my interview

    It's now the Knightsbridge Dr's in London they have two surgeries but both are in London tel 0207 589 8965. Do you still have the questionnaire if not i can send you a copy.?

  13. Your packet should contain a list of doctors that are apt to do this medical exam, so you just have to call one you choose with your case number and schedule an appointment.

    Yeah, the problem is the doctors appointed to doing the exam when my package 3 was sent (aug 05) no longer do the exam and i have no info on who to contact.

    Need someone who has recently (this year) received package 3 from London embassy to post details of who to contact now that nuffield hospitals no longer offer this service

    Can anyone tell me the procedure for booking a medical exam as written in packet 3 from the embassy in London.

    My packet 3 was received in Aug 05 and things have changed since then, sending my checklist back today to get my interview and was a bit worried that i need to get my medical asap

    Can anyone answer a question for me PLEASE!!!

    I recieved my packet 3 Aug 05 and since then the details for booking a medical have changed.

    What are the new instructions for booking a medical??

    I have read somewhere that the embassy now make these arrangements when scheduling the interview??

    Have i been mis informed? Can you book it like before by ringing the appointed doctors??

    Any help would be greatly appreciated.
