I think I got this.
I'm taking the negligence route.
The whole reason they had the freight was because they misloaded it.
I think the fact that we sign a limited liability agreement should be negated by their negligence.
Their clause suggests clients hold insurance for cases such as these, but their negligence gave us no opportunity to do so since the freight should have been moving under our carrier's insurance policy.
