    Yeh me n her had mad convos. We filed same time etc. My husband had his interview today and was approved.: ) .ppl I've talked to say this is not possible whatever happened here. Not knocking her at all, But if all worked out then I'm happy for her.

    She posted to brag. That is the only reason. Had she posted "my husband is coming over on a dual-intent visa instead of a spousal one" then posting would make sense. She made some vague comment to get people wondering.
    Posting comments that have people who are waiting to be with their loved ones wondering how, and if they can use it, it just plain mean.
    Why WOULD people be happy for someone they worry is breaking the law? Jumping the queue? Some people have been waiting a long long time... they want to know, they want help, and instead she throws some cryptic comment that basically says "screw the rest of you, we found a loophole and I'm not going to tell you how we did it". It was mean and that's why people jumped on her.

    The best advice given here I feel is
    1) Focus on you. If you decide that you need more time to know for sure on this man, withdraw the petition and give no reason and let time give you more answers if you need it. If you have reasons to give to Kingston Embassy, report him as fraud and protect those who will come next.
    2) 7 tourist visas- I beg to know HOW this man paid for the fees each time? Asking my (Jamaican) husband his first statement was ''well the man must have 3 or 4 or more woman here already supporting him to get here... but won't try to marry him for whatever reason (only applied tourist visa and never K-1 I'm assuming)'' Either that, or he's a rich man? Jamaica (and many other countries) have a very amount of fraud, particularily men making a living off foreign women and eventually making it to their country, maybe four five six women later but they do reach.
    3) For your baby, there's nothing wrong with not putting the father's name on the birth certificate. I can speak from personal experience. There's nothing wrong with changing your number and forgetting it all, for the sake of you AND your unborn. The two of you (baby and you) can start fresh with a new life.
    I speak from first hand experience and experience that I've seen others go through. Feel free to message me. I hope you find calm in the midst of all the storm.

    Yeh no doubt i usually post how long it takes so it gives other ppl an idea just like it took 234 days to get NOA2 lol... looooong wait! Im ready for my case number lol

    well im with CSC and just got my NOA2 after 236 days. it all depends in the case whether u get noa2 or not. but i think VSC is a bit backed up. be patient it pays off! good luck

    Things that make you go hmmmmmmmmmm. Every once in a while you get some straggler come onto a board and post NOA2 la di da and when you look at their timeline its like 3 weeks or 2 months from their NOA1. Then you ask them over and over how did you get approved so fast blah blah blah and they never answer you. Here is my philosophy, people know we are going thru hell waiting and wishing for happiness and they come up on these boards and post false info just to add to our frustration because it amuses them. You don't think so? Trust me there are many people sitting around the house in their pajamas all day doing this kind of silliness. Just chill out dudes!!!! Listen to Thrilla, "1 day at a time". Back in the day (pre Obama era) I-130 filing to Visa in hand took average 1 year !!! Then they sped up the process last few years of BUSH era the whole process took average 7 months. This is because they are trying to phase out the K-3 visas. Now since the past year budget fiasco this process is taking average of 10 months. I studied this by looking at other boards and seeing what kind of timelines people are creating. People who filed same as us over a several month period before we did. They are waiting like 10 months average to get the complete process done (USCIS, NVC, Embassy interview). I wouldn't start worrying or calling USCIS unless about 5 months passed and you hear nothing. Check your case status on their website using your WAC# .

    Why should you be frustrated? You are only 2 months and 11 days from you NOA1. You have a long way to go, so sit down and be patient like the rest of us. Your average processing times for an I-130 from the VSC is 5 months. I filed a I-129F and it is in CSC with an average time of 5 months. I filed mine and received my NOA1 on December 8, 2011 and am still waiting for the NOA2. It looks like mine could be as early as the end of April or early May which is around 5 months. SO getting frustrated is not going to help you and will not get your petition to move faster. USCIS will get to it when they get to it. We are all at their mercy.

    A couple in the DR was denied because of this same rfeason, when the relationship started the wife was an under-age individual. I am more concern because you started a relationship over the internet with an under-age child. This is a BIG REd Flag.

    Well, my family and friends don't know anything about the process so they were not the ones I wanted to share my happiness with when getting NOA2. I can only imagine the conversation: "I got my NOA2!!!" "your what?" "petition approved" "oh does that mean he/she's coming now?" "No, there's a few more months" "Huh, ok. Good for you I guess?".
    So I totally understand the OP wanted to share here with people going through the same process.
    Anyway, congrats, it's about time! :dance:

    Darnell is right. The mediator is wrong. The I-864 HAS been used for support but it also has been ruled invalid. In the event the I-864 IS ruled.. her income will offset the amount you pay, as does the children's income.
    She isn't eligible for Section 8 because it's a means-tested benefit. If she does by change use it then you will have to pay back the government (THAT is the true purpose of the I-864).
    You don't need to pay for her apartment. You don't need to pay for anything. I advise you to leave her in the apartment and stay with friend in the meantime until the divorce is final and settled. If the lease ends in the meantime she finds her own place to rent. If she wants to stay in the US this is her job, to earn money and support her children. She needs to learn to look after herself.

    The Mediator is wrong.
    The I-864 is a contract between YOU and the USGovernment,
    not anyone else.
    Once she starts using Public Assistance, the bill accumulates back to YOU from the FEDS.
    You pay it, ever so often, back to the FEDS.
    I'm thinking the mediator was biased ..
    Also, IMO, the fodder you've collected for ICE should be great stuff to use at the divorce hearing, in an effort to minimalize, if not set to ZERO, any concept of alimony.

    I'm speechless and sorry to say baffled at your stupidity (which you call nice).
    You need to listen to yourself and look at your actions. How can you file a report with ICE when YOU agreed to marry your wife ONLY for her & her kids to get GCs? Sir you were an accomplice, I'm surprised that you didn't get in trouble.
    Anyway, as I said, you and only you got yourself in this hellhole so you better get professional legal advice to see how you can mitigate your financial obligations to your wife and step kids.

    Don't take this the wrong way as it's a sincere suggestion, but could your uncle help you go through this since he has direct experience. We on VJ can answer questions occasionally, but accomplishing this process self-help will require some self-research and some experience in the documentation and assembling of many government forms. The basic questions you have asked lead me to believe that you might benefit from having some direct assistance from either a Dich Vu or from a relative/friend that has been through the process.
    Again, please don't take my advice the wrong way as my intention is for you to succeed. Any mistakes in the submitted package could cause the process to drag on even further than you planned, and I would rather just be blunt and give you the above tough love response. If you do proceed on your own, at LEAST have your uncle or a Dich Vu review it before submitting.
