I took my seminar at SMEF ,actually they didnt ask for anything except for the passport and visa photocopies, they are not very strict at all. It was me who offered my divorce decree when it was my term to get the counseling.the interviewer asked me to stay for a bit because she wanted me to share my experience about my disastrous marriage. After that,its all done and i got my sticker. I advised everyone to go their with their visa already,for according to them its very rare for them to deny anyone with visa and travel plans already,except of course,under complicated circumstances. I heard PRISM are strict though.

so even i dont file for petition the CFO will still let me have the sticker for clearance?
but since i am on my way of processing my petition i guess i will still do it in case the embassy will look for finality of the court

Yes.. for your peace of mind,file it,so you can report your marriage in the future, your choice though. most of the ladies here who had experienced the same,did not file recognition so they are only married in the US. I thank those who had helped me and gave me advice and told me about their experiences, for I was like you before we filed, we had all the worries we don't even need. They asked for my divorce decree.i had it photocopied, but they also took the authenticated one, with the seal from the state. and oddly, parent's advice eventhough I am already 25 years old. there were other ladies who had the same situation as well and never actually filed a court case.

Hello. I have the same situation as you. married to a USC, and got divorced (he is still alive lol). I filed for judicial recognition and the court granted it, however, I have been having problem with the LCR for they want me to show them the certificate/court decision from the court where the divorce was initiated. and I have not received anything, for I only got a piece of paper , the lieu of judgment. and they don't want to honor it. I have tried to come up with a authenticated divorce decree, and still my case is still at pending.
So my interview came, and I only had my divorce decree as a proof of my terminated marriage, and I brought my finality and court decision from the court, just in case. I am relieved that they honor my divorce decree, for I have no idea on when will my case be finally granted. I am set to leave in 2 weeks.

Although, the recognition process is not really needed during the interview, it was a wise move for me to have filed the case, for I would want to report my marriage at the consulate in the future. I just hope they will finally grant it. someday maybe.
When you file the case, present the death certificate as well, for it will be use as evidence too. they are right, it will not be a wise idea to say you are his widow because he already married someone else, in his country, his government, and he filed the divorce before that. although, til now, you are still his widow in our country, you cannot take the easy way. (by just showing the death cert and such) . They might even question you on why you didn't file for recognition right away,after the divorce was granted. ( I was divorced 2007,I filed 2009,yet they still questioned it. )
I don't have any helpful advice regarding the passport and using his last name , for I have never used my ex's last name. but I think you should start researching about changing to your maiden name. When you go for the interview, they will ask you for your CEMAR and NBI with aka's. and you together with the divorce decree.

use your UID number when you track your visa,sisters
I called up 2go and they told me its not there yet, but i tried my UID and it shows "in transit"
if your UID starts with 0, take it out, for it will appear invalid. -
True! I don't think I can make it on our anniversary now,(May 10)so I'm hoping I'll be there before his birthday (May 20)...sigh..

I remember waiting for my now wife to get her visa delivered. It wasn't such a long time waiting really, but if felt like forever at the time. Almost like some one showing you a chocolate bar when you're starving, then taking it away and saying you can eat it when they give it to you later.

Wow!! Really.. it must have been 4 to 6 months.. But Im glad you already got your visa approved. You can now be with your fiance and live happily ever after.. I hope our petition will not take that long.. We both missed each other so much already. Its so tough!!! But I am very happy for you!! Its time to celebrate! Cheers!!!

Yes, a wonderful feeling indeed! I called my fiance right away when i got to the hotel, and the first thing he asked after saying "yay" was.. So how long til' we get the visa? can we book a flight soon?" LOLs

Im just so happy, because before the interview, I had all the worries in the World lol. I was so stressed, i had problem with my birth certificate 4 days before my interview lol.Im glad i got it fixed! God is good! -
I know the feeling.. our petition is K1 though, but got approved after 8 months and 5 days. (VSC) i hope you get yours approved soon!

Congratulations! I read your timeline. I have one question...do you think the number of times the petitioner visited the beneficiary is a factor for approval?
there are some who got approved eventhough they SO only visited once, as long as its within 2 years, ..

Hi, you will need to go get a court order to be able to correct it. consult a lawyer.
Correction of errors in entries of citizenship, date of birth, surname, status or gender of the petitioner are not among those errors that can be corrected with the LCRO under RA 9048.

hello every body
i just want an advice to everybody in what to do about my Fiancee BC... she just recently get her BC in NSO and she found out that the Gender they put in BC is MALE it is supposed to be FEMALE... we dont know where to start on this gender change. is ther anybody out there who is been in my situation right now? i really need an advice on what to do and if you know some attorney who can do it for cheap...

an UPDATE: I went to NSO main and they were able to give me the correct copy of my birth certificate.

I just go to nso then asked the guard where i can file suplemental report about my b.c. Then pay again then they tell you when to go back to get it tho they wont put your name correctly to where it supposed to be they just gonna add information of your suplemental report on the side of your bc .. Haha i'm laughing when i realise that i dont really have my name on my bc.. Good luck hope you fixed it soon

only 2 weeks? what did you do? mine's details are the same except for my first name . instead of "Name" it became "Names". everything else is the same. but i know it will still be a problem.

cancel the interview maybe? coz sure to fix you bc takes more than one week. I got issue with my bc too but i'm aware of it since i was high school tho i thought it's only my name misspelled but when i get my bc nso copy last year they said that i dont have my given name on it and just my surname but on my original bc i have my given name on it, so i make them fixed it, they only put note on the side of bc about my name and give me two pages of my orginal bc showing my name in handwriten. It takes more than two weeks for me to finished the process

According to the lawyer, mine falls under RA 9048, which didn't need a judicial processing. Im just not sure how long it will take, and I can't do anything in 6 days.

Will I be denied on the spot at the interview if I go with this wrong birth certificate with an affidavit of discrepancy attached to it?and a letter saying that getting it corrected's under process?
I was told by this NSO person that if I am willing to pay the right amount she will release my birth certificate.I just don't know what to do and I didn't dare to ask yet on how much the "right amount" was. on Monday I will try to go to the main office in Manila and see if my record is still there.keeping my fingers crossed.
May be better to reschedule the interview even if it is a inconvenience. You will have tto get your birth certificatecorrected to reflect the name that was filed on your I-129F petition and used on any immigrations documents. If names don't match the Consular Officer will not issue the VISA and ask you to come back with corrected documentations. If you used different names, such as nicknames in any of your documents to prove your relationship then expect to have several CENOMARS to cover the different names and an NBI Police Clearance which has your proper birth name and the other names listed as A.K.A. NBI can do it so don't let them tell you that they can't. Simply tell them that it is required for the U.S. Embassy interview and that the U.S. Consular Officer requested it or they may tell you it is not necessary and not do it. They are not the American Consular fficer at the Embassy. I have been to my ex wife/then fiancee's interview in May 2010 and she had the wrong name on her birth certificate that I paid to have corrected and it took several months in Zamboanga City. I had her get two CENOMARS for the incorrect name on the birth certificate and the corrected name that they just type on the same birth certificate and authenticate it. I also had her get the NBI wth the A.K.A. on it which she also tried to fight me on. When we sat down with the COnsular Officer he appreciated getting them, said it made he job easier because he did not have to do additional paperwork to have her come back later with them and thanked me personally. Needless to say she was approved. You can try to go to he interview and see if you can get your VISA without it, but tthey could aslo tell you to do what I just did and return. Also on the NSO blocking your paperwork, talk to a supervisor, not the customer service representative. If they give you a hard time, then ask to speak to their supervisr and keep going up the chain of command. My ex didn't want to stand her ground until I forced her and she was able to get all of the paperwork that she was told was not necessary. Of course you are paying for it so ou should be entitled to it. Good Luck.

the timeline for adjustment of status varies, it takes so long for some people and some did not even have to wait for so long. I suggest you file the employment authorization and advance parole together with your I-485 , it takes at least 60 days for it to get approved and 1 year validity, so if you want to work while waiting for your Greencard, or want to travel outside the US, you can. you can also use it as an ID.
You will get a conditional greencard which has 2 years validity and you must file Removal of condition (to get the 10 year GC), 90 days before your conditional Greencard expires.
