  1. Congrats Kaukas. Looks like you and I will be filing for ROC around the same time...let's hope the wait for that won't be as long as AOS

Thank you! Hihi :) I'll be tailing closely behind you when the time comes to remove condition :) Although I feel AOS was not that nerve wrecking compared to the K-1/CR-1, it's such a relief I won't have to look at the website almost daily for the next 1.5 years

Enjoy your spouse's company on the Valentine's day!

  2. Hi Vanessa,

I just wanted to write to say thank you for the effort you put into starting this thread (and following up on it to this date).

I followed your material list to the tee (plus the cover sheet for each section), and we got approved without any RFE or an interview.

This thread was immensely helpful as with all your comments on this site.

Thank you so very much :)

  3. I filed in July. I've never had an interview, or a RFE, or notice that it's been transferred anywhere else. Got the Notice that it had been received dated 23rd July. Does anyone think there is any use in contacting them?

I'm in the same boat as you. Received both the AP and the EAD, but the I-485 was still stuck at the initial review stage online. I called the number listed at the bottom of I-797, and I didn't even have to talk to the tier 2 officer.

The first lady I talked to told me that our case was transferred to the local office, and the they are currently processing the I-485 from 10 July 2013. This is immediately after the recorded message read that our case was still stuck at the initial review at the Missouri office.

I know that our field office is not the same as yours, but I guess it's coming tho rather slowly. You might also find out where your case is. That might make you feel better as it did with us :)

    Good luck.

  4. I don't have first hand experience, but Brother Hesekiel was apparently quite active in yahoo forum or something rather on the subject. Link is below, but I don't know if it's still active.

I seem to recall him writing that it usually takes approx. 6 months to get the Beibehaltungsgenehmigung approved, but the topic below had the process approved much quicker if I recall correctly.

  5. The interview at the consulate was apparently as easy as pie :) Total time it took was approximately 2.5 hours, but would have been quicker if he had some change (coins).

Just in case you need to take photocopies or to drink/eat little stuff out of the vending machines, bring either coins or at least a 10€ bill. Apparently, changing the bill is not really easy.

Overall procedure was as described in other people's consulate reviews. He was redirected from a non-immigrant line as there was no sign or a real line for immigration visa applicants. He was called to the window, and was told to organize the papers according to the consulate guideline. He submitted his packet at the second window, and was given back most of the I-134 related documents except for the letter of employment. They gave back all his originals. He waited some more and was called to the third window for an "interview.". This is the bottleneck; there is only one window for that (at least when he was there today). There was a second officer standing behind the first to consult for the decision.

They asked 1) what's his (beneficiary's) occupation, 2) what he intended to do in the US, 3) how we met, 4) what's my (petitioner's) occupation, 5) what's my discipline, 6) whether he has been to the US and how many times, and 7) whether he had troubles at the POE (he traveled many times to visit me, and was sent to the secondary twice. One time he was allowed in but with a serious warning not to come back for 6 months and for a shorter stay). They chitchatted a bit about how he likes Atlanta, and whether he is okay to stay here as his line of work is harder to find around this neck of the world.

He was told that he was approved, and the visa will be sent back to him in 7-10 days.

The tentative date of arrival is 28th of June. Provided that our state does allow a K-1 holder without an SSN to get married, we'll be tying a knot on the following day! AOS packet is almost ready to roll; just waiting for the marriage certificate and other medical documents along with a few boxes in the forms to be filled out.

Thank you all so much for your help and support!! It would have been so much more difficult and expensive if it wasn't for this community!

  6. My fiance just got the instruction letter, and to our surprise, it has changed as of 23rd of April. So, I figured I should ask to see if someone already started getting the packet 3 ready according to the new guideline to confirm what we are trying to do is actually correct. I will list the items and methods for submission, so please let me know if you did something differently *after* April 23rd.

    • DS230 I & II, DS-156, DS-156K, and DS-157 (for ALL applicants over 16; including females and males over 46) - originals + copies
    • Certificates (birth/divorce/police) and military records - originals + copies
    • I-134 and the supporting evidence (tax transcripts, pay stubs, letter from the employer, etc.) - originals
    • Evidence of relationship - originals (Could we get away with the copies?? He has my old passport...)
    • Passport biographic page - a copy
    • Prepaid DHL label
    • Prepaid visa fee - copy of the receipt?
    • Two US passport sized color photos
    • Signed check list

I think that just covers all the pertinent documents for us, but does this look right? I told him to send everything all at the same time.

We were gearing up according to the old instruction, and now the new one threw us off. I just wanted to see if someone else is going through the same thing for the peace of mind.

I hope this can also serve as heads up for people who already prepared everything according to the old instruction just like us....

FYI, checklist from http://germany.usemb.../visa/iv/step5/ is still the old version, but the checklist from http://germany.usemb.../visa/iv/step4/ is new. This is only true for the English pages; German pages are both updated already. I'm attaching the new checklist in case someone is interested....

    Thanks in advance.

  7. I really thought and was worried that the VSC was trying to tie up the loose ends before moving onto another petition type.

I guess I wasn't alone to think that. Kermitpiggy's and my NOA2 sounds pretty promising for K1 approvals :-)

Congratulations, Kermitpiggy, and Godspeed, everyone! Thank you all again!

  8. Hi. I’m the petitioner, but I thought I might be of some help.

I guess you already are aware of it, but the page below is the Frankfurt consulate page on VJ. I followed this page to get the info that I compiled below.

    http://www.visajourney.com/consulates/index.php?ctry=Germany&cty=Frankfurt

This is the list of things that I had my fiancé prepare/find out before the NOA2

    - Get vaccinated; at least with my fiancé’s insurance, getting vaccinated was cheaper than getting the titer checked. It’s especially important for us because I (petitioner) work with human samples and I don’t want to risk transmitting funky stuff especially HBV to him, but may not be applicable to you. He keeps a little booklet with all the labels and dates on it, and will be taking a photocopy of all the pages. And for HBV, he started immediately after I submitted the I129F packet (it takes 6+ months to complete).

    - I sent him all the documents (DS-156, 156K, 157, and 230) printed, filled out, scanned into PDF via Email.

    - I took the entire exact duplicate package that I prepared when I visited him after submission, and all the originals of the documents submitted (except my passport).

    - I also had him inquire about the medical (same day walk in at the office near the FRA consulate) and the police certificate (if you appear in person and pay 2 or so at the Führungszeugnis, you can get it faxed to you within 3 days or so apparently; but otherwise, on average, a 2-week process).

    - Find out where he has lived (longer than 6 months; the names of the cities) since he was 16.

    - List Employment history for the last 10 years.

Now that I got the NOA2, I am planning on sending him the following:

    - (Photos that we took together during my most recent trip to Germany)

    - (Pages from my passport with new set of immigration stamps)

    - (Boarding passes and a copy of the itinerary)

    - A Letter of intent to marry with renewed date (dated close to his interview date)

    - I-134 signed and dated (I-864 as well, though it’s really not necessary; just in case)

    - An employment verification letter from my employer

    - Tax return transcripts for the years 2010, 2011, and 2012

    - Copies of my tax returns + W-2 forms for the past 3 years (not necessary if you provide IRS transcripts; just in case)

    - Pay stubs (electronic copies; 3 months –worth before the interview)

Apparently, my fiancé visits a forum called Amerika Forum. You might also find it useful.

Sorry about the awfully long reply.

    Best of luck to you.

  9. I also went through Atlanta, changing my name last October. Unfortunately mine probably won't help your case because I got my interview letter after the interview (waited about 30 min). The oath was exactly 2 weeks after the interview date, and there were about 300 participants.

I know another guy who had almost identical timeline as mine without the name change. He also got the letter on the same day, but the oath was 4 days after the interview.

My friend, who went through the N-400 process 3 years ago in Atlanta without the name change but was taking modified oath, waited for the interview letter for 6 weeks. I think he said that the oath was 3 weeks after the issuance date of the invitation letter.

    Hope you get one soon.
