What Airline are you flying? Korean Air let me change the name for like $35. I had to send old and new passports (Copys) but they will do it no problem. Problem solved

Apply for a U.S. Passport. We strongly recommend that you apply for a U.S. passport soon after your oath. You will not be able to travel abroad until you have your U.S. passport. Please allow sufficient time between your ceremony and any planned travel to receive your passport

Not the address itself, but not being domiciled in the US definitely could delay things.

    Yes
    Probably not
Such as? I suppose you could file I 130 now and interview in your home country in a couple of years.

Begs the question what the plan was when you entered on your non immigrant visa.

Probably the most common scenario seen here for a couple to be separated is where one spouse is deployed.

The other ones I see are where they are studying in different parts of the Country, where one has to work away from home. In such cases you need to keep records of how they continue to communicate, spend time with each other etc etc.

Now the impression you have given is that none of this apply, admittedly you have been vague about the actual situation.

I think I understand what you mean. I think people can be in a good faith marriage when not living together. Basically the paperwork does not need to be done ASAP. The marriage was entered in good faith but does not become "not in good faith" the minute you separate but stay married. There are multiple reasons for people to not file the paperwork immediately, laziness, mental burden, potential asset/custody fight, unwillingness of one party, etc...Applying to something as "married" after a separation but still married would be "not in good faith". I think that is what you are implying I would be doing here. I don't know if you are right, it's all just semantic really. If we were to apply for mortgage today and say that we are married while we are in fact separated and living in different addresses I would agree that some kind of "fraud" is happening. But applying for a joint I-751 while separated but still married is the only thing I can do. Now would they still see it as "fraud" because when I filed the I-751 we were separated? Maybe. Seems harsh though. If that is the case then I guess the route would be to get divorced before applying (to avoid needing to amend).

You are looking to remove conditions based on a good faith marriage but you are separated.

That does not really add up, confuses me and will no doubt confuse them.

I've never heard of a signature being required, they're just left in the mailbox. But do get Informed Delivery if you don't already have it, then you'll know when it's arriving and can flag it to him to make sure he puts it somewhere safe.

We, also, had to provide more documents after wife's interview.  Just provide what they ask for.

They want original divorce decrees.  That is always the case.
They want to verify your CURRENT income.
They want to verify her history inside the US.  She could have other inadmissibility.
"Irrelevant" is something only the Consulate Officer can determine.
I hope the rest of your journey is smooth.

Original divorce decrees are always required for the interview regardless of the fact that you have sent them to USCIS at the beginning of the process.

Regarding police certificate, this is also written out on Department of State’s website for each country and should be checked when trying to obtain documents to satisfy the requirements. For Argentina it says specifically they want the one with the special exception:

    Procedure for Obtaining:
Applicants in Argentina: The certificate can be obtained by scheduling an appointment online at https://www.argentina.gob.ar/justicia/reincidencia and paying the fee at a bank.  When applying online, applicants must request a police record “con excepción al artículo 51 del Código Penal.” https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Argentina.html

Lastly, it’s also standard to bring updated income requirements to the interview.

Im sorry to hear you had a frustrating experience but three out of four things could have been avoided had you done prior research especially here on VJ. To answer your question about what to do - get everything they have asked for. I don’t see any other alternatives.

What's your plan if your fiancé turned wife gets pregnant, but AP doesn't come until she's in her third trimester and can no longer fly?

Too many moving parts here.  Coming on a K-1 to marry and adjust indicates the beneficiary wants to be an LPR in the US, not run home.

What if, when your wife is home, she decides caring for a baby without her family is a no go and wants to stay in Madigascar?  Are you prepared to move there?

Not sure what other would suggest, I'd adjust NOW, before any travel to avoid misrepresentation issue. Now you guys have the intent of her adjusting, so leaving and re-entering on F-1, especially if already married, can lead to undesirable consequences.
She may be questioned by CBP and denied entry any time. What happens then?

Entering the US via an F-1 visa with the intent to stay and adjust status is the problem.  That can be seen as illegal misrepresentation.

I would never suggest lying to a federal officer, especially a federal law enforcement officer.

Then let us hope for her sake the officer asks her if she intends to adjust or at least asks her how long she plans to stay, and she answers truthfully.

She has certainly declared immigration intent by seeking an I-693. Seems like a pretty clear cut case to deny her I-485 if she got the medical before she left the U.S.

Or CBP goes through her phone and finds evidence of the I-693 in progress. F-1 visa gone. Lifetime ban for misrepresentation.

    Anything but fine, probably.

Now if you just stay a LPR I doubt it will come up. That would seem the simplest solution.
