    Got notified on Friday that my interview was scheduled, strangely no text, and the document portal seems to still be giving me error 500 so I have no idea when it is. Hopefully the letter will turn up quickly

    Just got biometrics notification this morning. No letter in the portal yet like others. As soon as I see that letter I'll add the date in. Hoping for an early walk in as my father is in town.

    Well, I've been here for nearly six years and I still occasionally get my brain thinking the 'old' way. I snap out of it in a second and it's never been when I'm behind the wheel but it does still happen from time to time. 
     
    Getting used to driving in the US was a short lived, terrifying few hours. I had dropped my then fiancee (now ex wife) off at work and drove back to the hotel. I was shaking. The two miles of driving between her office and the hotel felt more like 200. My brain was on fire, my eyes darting everywhere and I gripped the steering wheel so tight I think I left a permanent impression. 
     
    I pulled in to the parking lot and sobbed. 
     
    I was, in a word, exhausted. BUT, I did sit there and make a decision; either go in to the hotel, or force myself to drive somewhere further away because I was going to have to do it at some point. 
     
    So, like the big blubbering manchild I was, I plotted a route to a bestbuy that was a positively biblical 6.4 miles away. 
     
    "Saddle up" I thought. 
     
    As I nervously pulled out of the parking lot, the giant Buick roared as I pressed down on the pedal. This being a Buick meant that the roaring was in fact normal and I was actually only doing 10 mph while the poor car struggled to move...
     
    Through twists, turns, and a highway or two I eventually made it to the Best Buy parking lot, sitting the same way I did after I had driven back from my ex's place of employment, nervous, afraid, but slightly more comfortable as I had found the heated seat setting. 
     
    I went inside and bought a $5 pair of headphones for no reason whatsoever. 
     
    And when I came out... something clicked and I jumped in the car and drove off as though I had been born driving in the USA. My brain had reprogrammed and I proceeded to drive like anyone in Dallas drives: Like a drunk Steve McQueen with only a fraction of the accuracy

    This doesn't fill me with confidence, but today the USCIS page updated VSC processing times.
    I-129F's show as 8.9 months, and the detailed page now shows.... *gulp* 14 June 2011 as the current processing date....
    LOTS of other petitions now show as MUCH longer wait times.... what the heck happened!

    Nope. That is wrong wrong wrong. Sorry you have to go through this...
    You will need the I-94 for AOS. ESTA anything will not get you anywhere with SSA either.
    ESTA is a pre-approval for the Visa Waiver Program. You have a previous approval to travel visa-free to the US on that program. However, this time, you travelled with a visa, the K-1 visa. You need to be processed as a k-1 entrant and be given all the K-1 things, like I-94. ESTA has nothing to do with this entrance, and they are making silly excuses. They messed up.
    It is their mistake not to give you the I-94. You need to go in person, get a supervisor, and get a I-94.

    Notice Of Intent To Deny, or NOID. It's bad news.
    The consulate officer didn't believe your relationship was real. They believed it was an attempt to circumvent immigration law. The consular officer sent the petition back to the USCIS with the recommendation that the approval of the petition be revoked. In the consular officer's mind, it should never have been approved.
    The reason this letter is bad news is because USCIS apparently agrees with the consular officer, and now they're intending to revoke the approval of your petition. What's worse is that it was the California Service Center. They usually don't readjudicate returned petitions. They just let them expire and let the petitioner file another one. The fact that they're sending a NOID without you having first tried to submit another petition means the consular officer's evidence must have been very convincing.
    Here's the rough part...
    By returning the petition, the consular officer has made an accusation against your fiancee. The accusation is that she made a material misrepresentation by applying for a visa based on an invalid relationship. That resulted in your petition being flagged. Marc Ellis, an attorney who sometimes posts on this board, calls this a "P6C marker", where "P6C" refers to section 212(a), paragraph 6C, of the Immigration and Nationality Act. That particular paragraph deals with immigration fraud.
    In a nutshell, the consular officer has accused your fiancee of fraud. If USCIS concurs by revoking the approval of the petition then that accusation becomes a finding of fact. In the eyes of the US government your fiancee will be guilty of immigration fraud. No future visa application will ever be approved for her unless she can get an I-601 waiver for the fraud charge. Those waivers are difficult to get, and usually require an experienced (and expensive) attorney.
    What I suggest you do is contact a good immigration attorney now. When you get the NOID letter you will have a limited amount of time to respond to it, usually about 30 days. If you don't respond forcefully and with tons of evidence then they'll revoke the approval of the petition, your fiancee will be guilty of fraud, and it will be much more difficult to get a visa in the future. Your main objective now is to stop USCIS from revoking the approval of that petition.

    So you have been apart half as long and seen each other 3 times as much, have that drink and then slap yourself and realize that you are a lot luckier than most.
    It is what we do to be with the ones we love, if you don't love him enough to do this maybe you should re-evaluate.

    Hold off on the personal attacks against me and the OP,lifejourney. Take it to pm if you need to.
    I repeat, all I've asked for is information that is verifiable. If you're going to bring up DNA tests etc that the father might pursue, then back it up with information that he can do so through Jamaican-U.S. courts... That would be useful. How would proving the child is his be useful to his immigrating? He can't use it to get to the U.S. anyways, the child would have to petition IF the child wanted to- after age 21 years. The father can't force the mother to bring it to him in Jamaica via courts.
    I truly am curious as to what legal rights he would have from another country, no sarcasm at all here, I think it's an interesting point that wasn't substantiated.

    This is going to be a hugely tough decision to make. No matter what the evidence is in front of you, you petitioned for him because you love or loved him. Everyone here has jumped (with good reason) onto the fraud train, and personally yes I agree that this person seems to be fraudulent. However, this is a very big decision, a tough one and one only you can make. Be certain that it is what you want to do because there isn't a way of turning back.
    For the record, yes I agree with the suspicion that this person is fraudulent and I personally think you should withdraw the petition. If he is unwilling to support you in a move to Jamaica, then to me it's fairly clear what his intentions are or were. However I, as well as everyone else here, know full well that this is a very difficult process to go through, there is a lot of stress and heartache. I honestly think when it comes to this. you need to sit and talk with people who are close to you for a while and be certain of the decision you are going to make and once you do, commit to it. You've had good reason to be suspicious already and there is clearly doubt in your mind about this persons intentions. You've done very well to get this far and you're certainly stronger than I am. The final ties are hard to cut, but sometimes it takes someone close to your heart to remind you that you're doing the right thing.

    OP, from the details in your opening post, his behavior is indeed of concern. However, an even bigger alarm is this: who would apply for so many tourist visas -- and keep applying and applying and applying -- without having very serious immigrant intent? Most people would give up after a couple of denials, three at most -- but he persisted.
    I'd bet real money that if he came to the U.S. on the K-1, he'd either bail on you immediately or after he got his green card.
    Only you know all the details, but from what you said, there's better than a 50% chance that you're merely his vehicle into the U.S. (in my opinion).
    Your intuition caused you to express your concerns here. In addition, your sister is alarmed.
    For withdrawal, follow the procedures in the 2009 thread. Keep us apprised, and keep the faith, si man.

    Check the "Refusal of Entry" conditions with the carrier you are traveling with. Normally if you are denied entry the Airline will charge the traveler the cost of travel and any fines the airline receives.
    The government does not pay.
    Here is an example:
    G. REFUSAL OF ENTRY - If a passenger is denied entry into any country, the passenger shall be responsible to pay any fine or charge assessed against the Carrier by the government concerned and for the cost of transporting the passenger from that country. The fare collected for carriage to the point of refusal of entry shall not be refunded.

    On a K-1 visa it would only happen if something changed in a drastic way. However, in the unlikely event someone gets turned back on a K-1, the person is responsible to get a ticket back home.
    If the person has a no-minimum-stay required ticket, then the return portion can be used for that, otherwise, only the airline can tell you what to do, for it depends on the ticket the person has purchased and the rules associated with the fare.

    What? Again, no-one is saying don't declare something. You give the information they request because that is what they want. If you are particularly concerned and feel something should be declared that they have not asked for, then go ahead.
    No-one here is ever going to advocate lying. We are not advocating wilfully distorting the truth.
    If the doctor asks for the answers to A, B, C and D then you provide the answers to A, B, C and D only and you answer them truthfully and factually.
    This isn't a doctors consultation! This is a medical examination where they are looking for specific information so that they can tick a box on a DS-2053 form. There isn't an option to tick 'maybe' or 'patient thinks that...'. The questions are 'Yes' and 'No'.
    If you feel something is significant enough that it should be declared when they have not asked about it, then of course you should do it. Never, ever lie.
    Volunteering unnecessary information is a waste of everyones time. The fact remains that the question is not "do you think you had issues with depression?", the question is "Have you ever been diagnosed with depression?" so you provide a factual answer only. Nich-Nick was given anti depressants, but not diagnosed in the same way I've been given ear-drops but never diagnosed with otitis externa, or that I've been prescribed asthma inhalers but don't have asthma. I had a chest infection and I was given an asthma inhaler to alleviate the symptoms. Therefore, I ticked 'no' on the box to having asthma.

Especially with extensions of the petition. Some places will do this automatically, and some will require you to request it. Mik2012 is not correct. Payment of the visa fee does not extend your petition status. It is the consular who will extend the petition validity if required.
