    The interview is easy. They only ask a few questions like: What does your fiance do ? Where does he live ? Have you been to the US? What did you do ? When ? Where ? What do you want to do in the future ? Have you met his parents ? Has he met your parents ? Has he been in BG ? When ? How many times ? When do you plan on getting married ? Where ?
    As far as entering the US in depends on where your POE is. I know that if you fly to Newark you get pulled in a room and get questioned. I flew to Chicago and I was asked questions when the IO checked my passport. They ask similar questions .

    You state only your own income for the three years asked for. Yes, include all YOUR income. The question about current income is completely separate. It is not a projection for 2011. It's what you'll make in the next 12 months at your current rate of pay.

    I think SSA-SurvivorBenefits are actually more like child support, which is named in line 23 on i-864. You are correct though: It is absolutely used for the benefit of the kids. I have to sign documents to that effect at the conclusion of every year. The SS office was actually SURPRISED when I told them I no longer qualified for my benefits due to marriage. Marrying overseas, they would never have known.
    Thanks for the help though. It helps to talk this through with others and hash through both sides of the argument

    OK--do you not have a card?? Then you have to go thru all the procedures, but once you have one, you can get additional ones without SS# for other party. Usually you can request the additional card at the same time you apply for yours.

    I still get a laugh when I think about my wife's first few months here. She has been here one year next month. some of the things she found weird:
    1. No real visible security at the mall or banks.
    2. 24 hour major stores
    3. No deposit or withdrawal slips
    4. You can get your money back when you return something.
    5. Internet shopping (yes she now has it mastered).
    6. Military discounts
    7. Limitless refills on drinks at restaurants
    8. People don't care about your middle name on documents.
    9. American teenagers and their freedom
    10. Even poor people have a car
    11. Black Friday shopping adventure
    12. What kids wear to school, (we have two high school daughters)
    13. Shooting sports (she now has two rifles and is getting quite good)
    14. Lack of public transportation, (we have no busses or taxi's where we live)
    Last but not least, never ending ED commercials. She asked me who Ed was. When I told her, it was the first time I had seen a filipina blush.

    Tax transcripts come directly from the IRS. They are free, and you get them by phone, online or at your local office. When using transcripts from the IRS, no need to send in copies of every form, schedule, W-2s, 1099s, etc. The tax transcripts cover all of that.

    Congrats!! I think your case was pretty strong if he didn't look at those. I know how you may feel, we put so much effort in making these things and they don't bother! lol... But you will soon be with your love, that's all that matters!! :thumbs:

    When I called to the MVD Office (listed in the Moscow Embassy website) , they told me that I could sign a limited power of attorney document and someone else coudl get this certtifate from the MVD. If you spent 7 years in Russia, you must know how to expedite the "waiting time"... Good luck

    I expect the USCIS should be the lesser of your worries.
    I'd imagine it's possible to get yet another K-1 visa petition approved with a waiver - the adjudicators are people too and have guidelines but also use their own discretion; this could be either really beneficial or hurtful to your situation. Hopefully someone with experience in multiple peitions in such a short amount of time comes along to help.

    Ummm no. SHE cannot deport him and SHE cannot cancel HIS application. She can pull HER Affidavit of Support which will cancel the application because without support, he cannot adjust.
    OP - you should report him to ICE and if you have the emails as proof, provide them. He may still attempt to adjust status by claiming abuse so you need to make sure you report him so it's harder to do so.

    I am so sorry to hear that. I think (not sure) you can write a letter stating that you are cancelling the AOS to the USCIS.

    Did you file for the AP and EAD separate from the Adjustment of Status application? If so, did you include a copy of your Adjustment of Status NOA with the AP and EAD application to show you are pending Adjustment of Status? There is a fee if the applications are not shown to be interim benefits associated with Adjustment of Status.

    The petitioner is the one who is supposed to prove that the beneficiary will not become a public charge in the USA. The beneficiary is moving out of his/her country so his/her current income is not of much importance - the petitioner is the one responsible of support especially in the beginning when the beneficiary cannot work.
    The i-134 proves the petitioner covers the poverty guidelines for the current year - by stating employment, assets, etc. and backing it up with additional relevant info - employment letter, pay stubs, tax returns. For the i-134, you need to cover 100% of the minimal poverty guidelines, but keep in mind most consulates expect you to prove you can cover 125%, which will be what you will need for the Adjustment of Status once the beneficiary arrives in the US and you get married.
    If the petitioner does not have enough income he/she can use another sponsor - best if it's a close relative who knows the beneficiary,otherwise it could be suspicious on the interview! Also,some Consulates are picky about using another sponsor, too..
    Even if using a co-sponsor, the petitioner still needs to fill out the i-134, to the best of my knowledge.

    Most Canadians have found it easy to travel back and forth to the US after the I-130 is filed, so long as they have plenty of evidence that they ahve strong ties in Canada--I'm sure many will chime in with their experiences.
    And don't just send in the form--there are a bunch of things to include in the package--read through the guides at the top of this page before you do anything, and then come back with questions--it will be a lot more productive.

    It's a two part answer--means tested as stated above, and there is a length associated with the answer--to only look at one side or the other could substantially mislead your sponsor, and besides, we try very hard to educate other readers who may want the complete answer--not just to focus on your narrower requirement--be generous--it's so much easier

    It actually can be forever. The support requirement lapses if the beneficiary dies, works for 40 quarters, becomes a citizen, or leaves the country permanently and returns the green card. So if she/he were to never work for 40 quarters and never became a citizen, the responsibility could be for life.
    By the way, divorce does NOT remove the requirement.
