After almost a year since my husband had his first appointment we have finally been approved.. We had to apply for the i601 waiver of Inadmissibility!
Visa appointment - september 1st 2011
Waiver appointment - November 14th 2011
Referral date - march 15th 2012
Approval date - June 19th 2012

If she stated that her husband was Illegal. It most obvious that he entered the states Illegally.
When i filed my petition, it took about 4 months. But i have friends that have been waiting for several months. On the other forums that i'm on, i believe its taking longer because august-december waivers have been shipped to numerous locations outside of Juarez. Including to the California office. I think it is causing a backup of approving petitions as well. I hope this helps. If you'd like to message me you as more then welcome.

Hi, I Am Currently Residing In Mexico, And Needless To Say, I Cannot Go To California And Request A Police Report Myself. My Feonce Was Advised That She Cannot Get One On My Behalf Even With A Notarized Letter From Me, Allowing The Request. How Am I Supposed To Get One? I Need It For My Interview =\ Can Someone Please Help Us? Thank You In Advance.
A police report because you committed a crime in the United States? or a police certificate?
I'm not sure what you can do if you are looking for a police report and they won't give it to your fiance. I was able to get police reports for my husband and I made sure that they were certified as well. If you are looking for a police certificate they don't give those in the United States. You may be able to type in on google.com california public police records. And hopefully they will have a copy of what you were convicted of on some sort of website.

If the CR1 visa process is for your spouse that is in the US illegally then this is what I believe is right.
If you start the process now, either this month or next you will most likley have an appointment by the end of this year begining of next year.
If the appointment is next year, you will have to have made enough money in 2012 to support yourself, your husband and your dependants(if you have any). If you will make enough money by September then it'll work out. If you don't make enough money to support yourself and your husband you could get a joint or co sponsor(i dont remember which one its called, sorry). And you'll have to have made enough money to support yourself, husband, dependants that last 3 tax years.
The sponsor can be a US citizen or a Resident, but for them to qualify they have to have made enough money to support them their dependants and your husband.

Well today i went to work (been working there for 12 years) and i was told i will be out work effective September 1, 2012.
My question is: I am about to get married and our plans are to start the CR-1 Visa for him right away. Since i am currently working and earning enough to meet the poverty line requirement, will i need to have a sponsor since i will be out of work in September?
Also, does the sponsor have to be a U.S. Citizen?
Thought i had everything in order and can't believe this is happening.
Any thoughts or advise would be greatly appreciated.

Its seems to be taking at most 2 weeks to get to the DHL location in a different state in Mexico.
There was a couple that recieved there Package within 3 days.
The medical exams are good for only 6 months.
My husband had his waiver interview on 10/24/11, on Thursday 1/12/12 I got a call from our attorney that they recieved the APPROVAL of our I601 (talk about a weight being lifted off of my shoulders.) I got the same notice on Saturday. The notice is dated for 12/28/11 and wasn't mailed until 1/10/12 (I will give USCIS the benefit of the doubt and say it was delayed due to the holiday.)
My questions are:
(a) About how long until we get his passport with the visa?
(b) how long are the medical exams good for? Our atty said that he may have to return to Juarez -READ: we need to spend another $500+ - to get another if the first (from 8/29/11) has expired.

Im not sure about the fiance approval but you have a good chance at getting approved if you get married.
I do understand it will come up during the interview and he is going to tell them the exact story about coming to the states. I'm not worried because if this visa doesn't work out we are going to marry in Mexico and try to have him come over and if that in the end doesn't work out then we are just going to keep living in Mexico like we've been doing for the past 3 years. It would be nice to go back to the states however it is not a necessity and won't effect our relationship

There would be no reason to include your husbands arrest record in your waiver. Disclosure of any information pertaining to his arrest would have been done on the I-130 or the DS-260. The sole purpose of the waiver is to show what EXTREME HARDSHIPS you as the USC would endure if (a) your husband is made to stay in Mex for an indefinite amt of time and/or (b) you were forced to move there if he is denied entry into the US. It is up to you whether or not you include household bills in your packet (my husband and I did so as we were advised by our atty) While claiming financial hardship is not enough for USCIS to approve the waiver it certainly can be a part of it. Financial struggles are a very real issue and the stress that comes along with it can lead to many other issues. Please seek the advice or aide of an attorney BEFORE you send the waiver. It is very difficult to get a skillfully written waiver approved you want to do it right.
Also, a word of advice... I have browsed this site for at least a year before my husband and I even got married and for much of our process I have remained a silent member only recently offering advice to those in need. While an overwhelming number of ppl are extremely helpful in quelling fears and providing knowledge there are also a number that are know-it-all's (making comments with useless information), rude and just not helpful. Please ignore these people, do not banter with them or even give them the satisfaction that what they said mattered in the least. You will get much futher dealing only with those ppl that are genuinely trying to help versus those that just want to up their member status.

In my waiver package I did include my household bills, daycare bills, Medical records, family/friends/doctors letters. When you write your hardship letter make sure you try to have evidence for almost everything that you claim. (If you have cancer, have medical records stating that)

I don't know what you mean by 'hit' but they will not tell you anything that shows up on your results at the biometrics appointment. they will send all the information to the consulate. AOS as in affidavit of support? they requested alot of information from my husband please be more specific on what your asking.
Does anyone know what happens if there is a hit in the biometrics results. Do they let you know at the appointment for AOS or do they request any type of information before the appointment.

I do know that already. But they are mine and my husbands Kids, the medical information of my kids as well as my own was put into the waiver. I AM HIS QUALIFYING RELATIVE. thats why i SAID THAT IM A UNITED STATES CITIZEN, im his wife!!!
You do realize that inadmissibility under 212a9b for unlawful presence children are not qualifying relatives, right? Any hardship to your kids must be turned around and shown to be hardship to you. Children are generally only qualifying relatives for waivers for criminal inadmissibilities.

Maybe you should double check your research. many of friends have been approved WITHOUT AN ATTORNEY.. I also have an attorney and It a hell of alot easier getting a waiver approved in Ciudad Juarez then most countries..
You are in for a huge awakening if you believe getting an I-601 approved is just a formality. Your attorney will have to show untoward hardship for you, if your husband cannot join you in the U.S. At the same time he or she will also proof that you cannot move to Mexico. There's a reason why some immigration attorneys are specialized in I-212 and I-601 waivers only. It's like you are having chest pain and go to your regular physician. If you need cardiac surgery, you'll need the services of a cardiac surgeon. There is no way that you can pull an I-601 in Ciudad Juarez off on your own.

I needed to file a waiver because my husband entered the united states illegally, and he was here for more then 1 year. Entering the United States without inspection (illegally) is an automatic BAN, meaning he cannot return to the U.S., but since he is married to me, a United States Citizen, they will waive the BAN, which makes him eligible to file a waiver of inadmissability. If i may ask, why did your husband need a waiver for?
I have also hired a lawyer and will soon be starting the CR-1 for my soon to be husband after we get married in January and he will need a waiver as well. His tourist visa was cancelled due to they found reason to believe he was working in the U.S. I just wanted to know what your waiver was needed for as i am a little nervous about these waivers etc....

YES kids have to do their medical about 4 days in advance to get the results. i know because my husbands uncle had to take his 5 kids, they did not ask for a dna test.

it could be different per country. i submitted certified copies, then the consulate just asked my husband to bring orignals to the interview.

I sent all certified copies. it would be a terrible situation if you sent the originals and then they lost them. just bring the originals to the interview.

when i had my husbands birth certificate translated, the translator needed to make the translation look similar. if theres a circle certifications on the top then the translator made a cirle. all the lines where almost exact as the original. if theres a unreadable signature then they would write illegible signature. my lawyer told me to have EVERYTHING notarized. i took everything that had to be translated to a perfessional and they notarized it there. i hope that helps

my husband just had his waiver appointment november 14th. the officer told him that he will take 4-8 weeks to get his passport through the DHL in chilpancingo. my husband is also in guerrero. but my lawyer told us it just depends how fast the officers are working. if the consulate asks for more information then it will take several months because youll have to submitt more information which will cause the process to take longer. my friends husband was in mexico from may 2010 to october 2011, they asked for more information TWICE. then he finally recieved his visa.
You should call the number that is given on the mexico.usvisa-info website because they will beable to let you know if you can make the wavier appointment.

this sounds like my husbands case. he was in the United states ILLEGALLY too. at the first interview everyone is denied if they have been in the united states longer then 365 days. then the immigration officer will grant you a 'perdon' or forgivness for being in the United states, they will then give you a piece of paper that shows the forgiveness. then you will beable to make another interview at the consulate to hand in your waiver packet the waiver will contain medical records, school records, birth certificates etc showing that you have a real relationship with your wife. the officers will review your waiver and decide if she will grant the visa. then you and your wife may have to wait up to 18 months before you recieve a denial letter or the visa. PEOPLE SHOULDNT WRITE IF THEY HAVE NO KNOWLEDGE OF THIS PROCESS!! DO NOT LISTEN TO THAT WOMEN THAT REPLIED TO YOU FIRST. my husband and i just went through this process, he just had his waiver appointment november 14th. i reccommend seeing a lawyer and talking to them. learn as much as you can about the process so you understand whats going on.

Finally after my husband being in Mexico for one year. And not seeing him for 9 months we are finally approved!!
