The package we got was super obvious: there was a soft, plastic covering from the courrier service which we opened and inside was his passport (loose), some white pieces of paper with various instructions on them, and a large brown envelope that said all over it "DO NOT OPEN!"

front to back and sideways. This is THE guide to IR1/CR1 in Canada. Everything you need to know is in there and if you have any questions about it you can ask me or Saylin.

If your husband's last tax return was over the required amount you will be okay. That's how they judge self-employed people.

alizon got a reaction from Adelaid3 in another I-130 question
I agree that the question is pretty ambiguous. If you aren't going to be in the US when the papers are sent in, I'd go with leaving the line blank. I think the question is intended for people who are attempting to stay in the US throughout the process. If your husband is still wary, just date the documents for the date that they will be sent in, at which point you won't be in the US anymore.

Because technically that is illegal ... Entering the USA on a tourist visa with the intent to stay and adjust status can result in a lifetime ban. What your friend did is use a loophole in the law that allows for USC to spontaneously change their minds and stay and adjust...

First, let me be clear that I am not a professional mental health professional. Someone in your situation--feeling trapped and with no one to turn to--needs to consult a licensed, professional counselor to work through your issues with a neutral party. While this board is very supportive and (often ) quite informative, it is no substitute for working through your troubles with another human being in real life. You will never regret going to counselor and you deserve the help.

That said, my impression is that you cannot blame yourself for your husband's outbursts. Regardless of what you are or are not doing, the fact that he cannot communicate without violent outbursts is on him, not you. You are not making him have outbursts; his own immaturity and other issues are manifesting themselves through outbursts. You are collateral damage, not the target.

Abuse is not just physical. It sounds very much like you are in an abusive relationship. You need to come to terms with that and stop blaming yourself for his failings. The best way to do that is through counseling. After you are strong enough to see the situation objectively, you can then make a clear-headed decision as to whether you should try to work through counseling with him as well. It sounds like he needs counseling just as much as you do, and your relationship certainly does. If he cannot agree to counseling, you have to protect yourself and move on.

Now, depending on how bad things are, leaving him right away and seeking counseling (hopefully with the support or some family or friends) may be an even better option. Separating and seeking counseling will not make you lose your child. He is misleading you on divorce laws and using such threats to further abuse and cow you. It is far, far more common for the woman to win the child in American courts, regardless of whether the father is the income earner. Given his clear record of creating an abusive environment for you and the daughter, he is likely in a precarious position in regards to custody. Definitely consult local divorce attorneys. Meet with two or three to get a feel for how they would evaluate your case--you'll likely be shocked to see how different divorce proceedings are than what your husband makes them out to be.

    So, in summary:
    (1) find counseling immediately.
    (2) consult divorce attorneys.
    (3) make a clear headed decision about what is best for you and your daughter.

And stay strong. You are not alone in suffering through this type of situation. Things can and will get better.

The FDA and the doctors at the Mayo Clinic (one of the most respected medical research and practice organizations in the US) 100% disagree with you. You might need to rethink that.
And they weren't using the xray to discover if she was pregnant or not...they were xraying her chest for TB, like all other immigrants, male and female.

Go with evidence from doctors (above I gave you the FDA's and Mayo Clinic's opinions), not with the anecdotes of people in an immigration forum.

Just another little detail that isn't in a lot of the Montreal consulate reviews but happened to us: though the guard downstairs told the whole crowd to go to 14b, the secretary stopped each and every person getting off the elevator, asked them what kind of visa they were getting, and then told them where to go. Some people tried to sneak around her after hearing her tell us to go to 14b, but she stopped them and made them wait in line to speak to her first. So basically, getting in the back left of the elevator is really important, but you can't be slow getting off the elevator either. Make sure you're the first to step up to the secretary and get her clearance before rushing off to 14b. (At least, that's how it went for us.)

ALL CR1/IR1s are done in Montreal. K1s (fiance) are done in either Montreal of Vancouver. If you are a K1 and leave in eastern Canada you go to Montreal, western you go to Vancouver. Sorry, you'll have to fly out to Montreal to make your interview.

SD: I stumbled upon your dilemma, and I was so intrigued yet simultaneously incredulous that I read through all your threads. I really have to say that I think your manipulation is rather shameful. You seem very well educated, but you make statements that are either blatantly false (Canada is too cold for my children, but NYC is fine) or deceitful (I have no idea where my wife is, can't figure out if I'm divorced or not, yet out of all the billions of photos online I have found smutty photos of her on the internet and seen her around on the train). You refuse to discuss your own citizenship, yet you reference your mother being in the states and having an Order of Protection against your (ex?) wife. What?? She jumped ship from Canada too?
I worked for a DV program and translated for our staff attorney as the only bilingual staff member who does pro bono work for VAWA, U, and T visas. I saw victims of abuse who wanted to use these options for immigration relief to get out of a dangerous situation and away from their controlling abuser. You got out! You've been fine for nearly a decade
Furthermore, these people I translated for do not have the many privileges you have. I read your delight in paraphrased comments like "I'm a white Canadian passport holder. I won't get racially profiled and pulled over for driving w/o a license. I went to the DMV and tried to trick them into saying Canadians don't have an I-94. I wooed the woman at the counter with chocolates so she'd fraudulently renew my drivers license". The clients for which my former employer advocated don't have these LUXURIES and PRIVILEGES. They are undocumented, unable to speak the language, and truly living in the shadows...yet...they have documents. Lots of them. Every pay stub, lease, phone bill, encounter with the police. You conveniently have ACS reports, which you quote word for word, from this time period....but NO evidence of commingling of resources from 9 years ago. Are you not aware of the possibility of calling creditors, utilities, housing, anything with which you interacted to get old records? Perhaps the real story is there ARE no evidences.
Same with the marriage certificate. You need an official, certified copy. Period. Not a photocopy. Not a story about a ripped up copy. These are the rules that everyone plays by. Why are you exempt? I just read so much arrogance in your posts, and I think its really sad. I pray justice will prevail in your case.
Finally, on a side note, I'm a Court Appointed Special Advocate in cases of child abuse and neglect. I work nearly exclusively with Latino families, and I can attest to many cases where an undocumented parent is deported, their rights terminated, and the children are put in foster care or adopted. I remember you went on and on about this...saying "how many of the deported 46,000 parents of USC children were single parents? Good parents? Lived in NYC?" It was inane. MANY are single parents and good parents. If you utilize your intelligence and do a simple Google search, you can find evidence of this. Some cases recently have even been in national news.

There is no better place than CHI-TOWN...ran the marathon in 06,07 and 2010...loved it and they know how to do it right! Unlike Toronto where cars and drivers just yell at you to get off the road.
