    Just for the information of people who have to go through this in Mexico, I ended up going to a couple of "form filling" services (very popular in CDJ) and got the following info for filling out the DS-260. I was told by most of them (went to 3, and mostly got a consensus) that this is supposed to be a fairly new thing (filling DS-260 online. One told me that this was an a form for an immigrant visa and I didn't need to file it, but he was obviously outdated). I ended up spending about 60 USD going to these people after going through the archives here, so maybe this will help someone else. It's a couple of common sense tidbits, but none of them seemed too obvious when I was trying to get through this.
    -If you have a Border Crossing B1/B2 Visa (Laser visa) the number is on the back preceded by a "V" (This is for the new RFID chip visas). It's eight numbers and you should drop the "V".
    -When filling out the petitioner part the consensus I got was that you fill it out as "spouse" and then add your fiance(e)'s info, even if applying for a K1 since you can't (obviously) be your own petitioner for K1 and none of the other options apply. One of the people I spoke to, said that he has seen people try to file as "self" because they are the primary applicant.
    -This is probably common knowledge but to access the DS-260 you will need the NVC case number and the NVC invoice ID. The beneficiary ID will be needed once you start filling the form.

    If my husband had changed after I immigrated to US, I'd leave him and go back to my home country. The purpose of the petition is to be re-united with family. I just find it hard to believe that immigrants are willing to stay over here at all cost after being subjected to abuse shortly after arriving in US claiming the marriage wasn't entered for immigration purposes.

    Assuming that there was no overt irregularity (such as a married person trying to enter on a K-1), or that CBP found something that the consulate had overlooked, I very highly recommend that the OP follow Darnell's advice in post #93 just above.
    Getting a lawyer is a good idea, but Darnell's recommendation is the speediest path toward learning what happened and divining a possible solution.
    Before Mrs. T-B.-to-be was to enter, I asked a (very sharp) immigration attorney about the possibility and frequency of K-1 holders' being denied entry at POE. He said, "It doesn't happen very often, because CBP figures that the person has recently been grilled by the consulate. However, any K-1 entrant can be refused entry for any reason that the consulate would have found to refuse issuance of the visa."

    If 'they' = CBP staff, well they are not to offer advice to you. However, you can get a boss there, and find out what happened with HIS STAFF MEMBER, suggesting that his STAFF member needs to be tested for drug usage.
    This 'thing' , this occurrence, what happened to your fiance, is not normal. For it to happen, one of several things must have occurred:
    1. CBP got some electronic notice from the IV unit that something wasn't right, and did their process to find fraud at the POE, via questioning process.
    2. CBP officer that interviewed her was on drugs that day.
    3. CBP officer was poorly trained, not knowing squat about K-1 visa intake
    4. It was time for a secondary interview - there's some percentage of incoming immigrants that ARE taken to secondary and grilled in this fashion, for no other reason than this is part of the job.
    Now, I'm not a lawyer, nor do I play one on TV - but (IMO) somethinng is terribly wrong at CBP POE, nothing was wrong with your fiance. So, have a think, and start to formulate your next steps. At a minimum (again IMO) , you should file a complaint on that CBP POE officer, and you should talk to the boss, and you should ask that the CBP POE officer be immediately tested for drug usage, and the call DoS Hotline and inquire for casefile status on your fiance's case.
    In the end, if you can prove up 'procedural error' and quickly, she might be allowed to cross into the USA again. But you've some work to day, on Thursday.

    They are certainly accurate and help many people every day. However you should always read the instructions on the USCIS forms.

    She has no options. She is working ILLEGALLY because she isn't married so couldn't have filed AOS (and thus work permission). She needs to STOP working illegally 'cause she's just getting herself into more trouble.
    She can't stay. K1 is to marry the K1 petitioner only and apply for AOS based on that marriage. Again, she has no options and she needs to return to her country.

    The doctor just happened to find a loophole and at $30 a pop I don't think his intent was to make a mint. I think the real change that needs to happen is to eliminate the USCIS Civil Surgeon designation and allow any licensed doctor to do the physical by following the guidelines which are not that hard to follow. Maybe then the select group of civil surgeons will stop preying on immigrants. I was glad to see that the gardasil requirement went the way of the Edsel. Now is time for common sense to prevail and do away with civil surgeons altogether.

    before you rush off to find all these forms to fill out you really need to talk to someone with knowledge of your specific embassy as they are all different in what forms they require and the way they do things. for a K-1 it might be some if not all of DS-156, DS-156K, DS-157, DS-230 part 1 & 2... there might also be others that Moldova requires.

    If a case has red flags, a GOOD family-based-immigration attorney can be very well worth the investment. To flatly say "You do not need an attorney" is something that NOBODY here can state with any assurance, without knowing every intricacy of another couple's situation.

    Your post doesn't make much sense but I'm going to assume I understand.
    The K1 visa expires the minute you land on US soil. The I-94 then controls the status. The k1 requires that you marry in 90 days in order to be able to AOS based on K1 status (and avoid having to file an I-130).
    You seem to think that by overstaying the I-94 they are breaking the rules, they aren't. There is no rule that the K1 needs to AOS in the 90 days, just as soon after marriage as they are able. Some people are unable to file in the 90 days because their state takes several weeks to send them the marriage certificate. Some can't get married till the last couple of days (planning, people flying in etc) so they of course can't file until later. Filing during a holiday season the mail is slower so might not arrive before the I-94 expires. Sometimes there's something wrong with the packet and it's rejected so that takes them past the date. Sometimes they're going to move during the process (like me) and it's dangerous to change your address in the middle of the process. Some people have some drama occur and they can't afford it in time. You saying that you MUST and implying they will get into trouble are lies and it causes undue panic and stress.
    I have followed the "letter" of USCIS. I filed when I was able. I filed correctly. I was approved without RFE and without interview even though I filed 4 months after my I-94 expired. Those 4 months are now irrelevant and had no bearing on successfully AOSing.
    It doesn't really matter what your opinion is. It matters what the truth is and my post was correct. While it protects your status to file before the I-94 expires (which for many is irrelevant as the spouse of a USC cannot be deported until they are given the chance to AOS, and overstay is forgiven when AOSing based on marriage to a USC), there is NO RULE that you have to. This is the truth and they can do what they need to do based on their personal situation.

    The best way to stop getting conflicting advice is to stop calling people that have no clue.
    Approved petitions are forwarded to NVC the same day or next day (latest) No exceptions. NVC has it. The person you talk to there has no way to know they have it, so stop calling.
    When the NVC is finished with it they will send the petitioner a letter with a consulate case number and a notice that it has been sent to the consulate.
    Calling them just increases frustration. So stop.

Attorneys other than being too busy to pay much attention to your individual case, will just file the most standard package. You get to verify your own information, check everything as much as you can, decide if you are going to frontload for the embassy, and you are probably going to go right ahead and mail your package as soon as possible. I keep reading threads were the attorneys hold on to your forms for months, delaying the already long process. Don't be afraid of the forms, you are just filling out your information, after all, and you have a great checklist to help you out. Just my two cents. Good luck.
