  1. I need some help please. I filed my wife's I-751 6 days late. We however did receive the one year extension on her 2 year green card which will expire the end of October, 2015. But last week we just received an RFE for more evidence of being a legitimately married couple. And also they asked for a reason showing "good cause" for filing 6 days late. The post mark was 2 days late but I guess they don't go by the post mark. Does anyone have a sample letter I can go by? I am not a good writer and I don't really have a great excuse for the tardiness. There was no emergency or anything but I was working overtime and my 80 year old mother is becoming more and more dependent on me. My in laws moved in with us and they rely totally on me and my wife. Most of the responsibility falls on me being the only fluent English speaker in the house. And my sister has been in the mental hospital 3 times in the last 8 months. I am filing for Power of Attorney over her. Are these good enough reasons?

    A sample letter showing good cause to excuse my late filing would be much appreciated.

  2. The A#, Alien Registration Number, is found above the beneficiary's name on the NOA2 approval notice from your I-129F petition. You will need that number and the one from the I-94 when filing for AOS. They are not the same number though.

    She does not need the SSN to apply for AOS, but if she does not get her SSN within 2 weeks before her I-94 expires, she will have to wait until she receives her EAD or green card to get one. The SSN is needed for getting a state ID too, if she doesn't drive, and adding her to your accounts and insurances, etc.

  3. Its up to you; However, her GC will have her maiden name. What reason would you have for changing her SS to your name? The same reason you believe is necessary for changing the social is the same reaon her GC should have her proper name- she is your wife. She is no longer your fiancé with the old name but your wife with the new name. Use her new name to avoid confusion. She is adjusting as Mrs X the wife and not Miss Y the fiancé.

    The petitioner does not need to fill out another G325A. You, as the k1 visa holder, fill out another one because your information has changed, and you probably have a social security number by now and and A -number as well.

    You need all 4 pages of the G325A

    you need all necessary financial information you can provide. Bank balance/statement, pay stubs, tax returns for 3 years. This supports your petitioner's affidavit.

    Hi. What is an A number? And where can I find it? We have I-94 nunumber which is called an "A"dmission number. Is this also the A number?

    Also we don't have her Social security number yet. Is thata problem. My fiance doesn't drive or work or have her own bank account yet. So, we saw no need for a social security number just yet.

  5. Hi all. Do wee need to fill out a new G-325A when filing for the the AOS? Or can we use the one I made copies of when we filed the I-129F?

    And when filling out the new forms such as I-485, I-765, etc.. do I still use her maiden name. Although we married within the 90 day time frame we have never filed for my wife's Social Security card before or after marriage yet. So, we have not officially changed her last name to mine, so I have been using her maiden name when filling out the AOS forms. is that ok?

    Right, you don't pay. The person making that comment was confused. CBP made an error. She never got a I-94. Go and get a free one. You are right, you didn't lose anything - she never got it. It's not her fault, but she does need that paper.

    Thanks very, very much. We are going to Charlotte Int. Airport next week to get the I-94. Spoke to the customs agent on the phone and he was very nice and said it was there fault there would be no charge.

  7. K-1 is non-immigrant. The directions for I-485 ask for a I-94. If no K-1 got one of these, do you think the instructions would ask for it? Think for a sec...

    Go to a deferred inspection site and get a I-94 for free, because it was their screw up. I am not sure why you are arguing about this.

    Thanks for your answer.... I am not arguing, just trying to sort through disinformation the USCIS lady gave me. What and where is a deferred inspection station? I saw one link that list a $300 fee for replacing a "lost" I-94. But we didn't lose ours. She was never given one.

  8. Sorry but an I-94 is required for the AOS - you must include a photocopy front and back with the AOS papers it is proof of your entry. She needs to go to the nearest POE and obtain one.

    You will get an RFE for the birth certificate, the birth certificate is a required item.

    You do not have to file AOS in 90 days only have to be married in 90 days.

    I contacted the USCIS today and the lasy told me the reason my fiance (at the time, now my wife) did not receive a I-94 from POE at customs when she entered the US at the Ft Lauderdale airport is because she entered on a K-1 Visa. The I-94 is a document showing arrival into US and Departure from US. Being a K-1 Visa we were to marry. There would be no departure.

    I don't feel any better because she had to continually put me on hold and go ask her boss for the answers. And her response would begin with,, "It is our understanding" that she doesn't need an I-94 on a K-1 Visa entry.

    She entered the US at the Ft. Lauderdale airport, but can we go to any international airport that has a customs in it to receive a copy of the I-94? Would an International airport be concidered a POE? Greenville/Spartanburg (GSP) is a 20 minute drive and Atlanta airport is 2 hours? Will either of these be sufficient?

  10. HELP! My Fiance and I are now married as of 3/10/2012. She is here on a Fiance Visa. She arrived in the US on Dec. 18, 2011. We got married within the 90 days allowed. 82 days to be exact. Now we are back from the honeymoon and are preparaing to fill out all the required forms for the Adjustment of Status (I-485) package checklist. QUESTION: Do we have to file for the I-485 within 90 days? Or just be married within 90 days?

    Also. My fiance did not receive a form I-94 from customs at the airport when she entered the US on Dec. 18, 2011. If she enters the US on a K-1 Visa is she supposed to receive a document I-94? She swears the rude customs agent never gave her one.

    And the worst of all. She forgot to bring her Birth Certificate with her. She left it in Lima. Is it crucial to have the Birth certificate? Or will we receive an RFE if we don't submit one?

  11. Doing the medical after the interview happens sometimes, it delays issuance of the visa.

    They will not issue the visa until they have the medical. Depending how long it takes for you to get the medical done and for them to get it and go over your case again is how long it would take them to issue the visa.

    I just finished talking with my fiance tonight. She had her interview today. The consular told her after he receives the medical from the doctor that the decision would be made in two weeks.

  12. Can you reschedule or is it too late... or is that a bad idea cuz depend on how fast you can reschedule

    I'm afraid if we miss this appointment we will go to the back of the line. I would rather her just go to the interview without me and even without having done the medical yet and then be told we have to do these one or two things then come back on a certain day scheduled by the consular.

    It is what it is. Every thing was going smoothly until this big road block we just hit. Please pray for Katherine and Rodney in your prayers. She is really nervous over the interview and has been stressed out because she had to prepare in just two days notice'

    I don't know if we can reschedule. I let the lady that answered the phone at the embassy know that I was planning on being at the embassy with Katherine for the interview but do not have time to make travel plans in just two days. Katherine has her Passport, police record, DS-156 and DS-156K, a copy of everything I have sent to the USCIS....and all letters I have received so far from the USCIS and State Department.

    The lady said her interview was NOV. 2, and said for her to come at 9:00 A.M. I hope she can get in the building with all papers she has. It's a crying shame that some countries Embassies or post offices can't get a package to a persons house in their own country. People have told me that this happens alot in Lima. That is the reason I called.

  14. A big Yes Rodney, nothing to worry about. K-1 visa is paid inside the Embassy this is the fee they charge to "process" your paperwork, is ridiculously expensive though :blink:

    We just found out today that it is in two days. Wednesday Nov. 2. She never received the packet from the embassy with her appointment date. I called today to the embassy and found out.

    Is not the way we planned it, but it is what it is.

  15. As written above, the cost of the petition is $340. Once that is approved...then the cost of the actual visa is an additional $350...plus medical. Yes, unfortunately, this is legit. Then....when you adjust status here in the USA, it will be an additional $1070.00.

    Ouch! I was unaware of the huge fees. I assumed there would be fees, but not that big. But I am willing to pay the price to be with my Katherine.

    She never received the packet from the embassy. After waiting 34 days after the dated letter from the State Departments National Visa center stating that within one week they would forward the petition to Lima Embassy. VJ guide says that it is appoximately 4-7 weeks after Lima receives the petition that we should expect the packet with the medical info and interview date. Well after 34 days I called Lima today and they said her interview is scheduled for Wdnesday November 2. So, there is now wy I can go to the interview now with just 2 days notice. We thought we would have 3 to 4 weeks notice from the time the packedt arrived at her residence until the actual interview.

    So, I will just use the money I was going to spend on another plane ticket and hotel for the Visa interview and adjustment of status.

    Do you think me not being at the interview will hurt? I hate it that she never received the packet. But I have read recently that that happens sometimes in Lima.

  16. Does anyone have the number to the Vermont Service Center? I have the #1-800-375-5283 but I need to speak to a live person. I always get a message recording when calling that number. It has been 124 days since they received my packet and I see on other couples timelimes that there NOA2 has already been approved and some of them have dates later than mine.

    Does anyone have any experience with this? And does anyone know how to actually speak to a live person at VSC?
