    Of course you can assuming you meet all other N400 requirements (3 years of marriage, 3 years - 90 days of permanent residency).

    Hi guys, so my hubby petitioned my son he is under cr2. The case got completed the 7th of june, I was wondering on how many more weeks/days do we need to wait for us to get the email from NVC with the interview date?

    For other governmental type forms like for college and the VA, we had to show the amount of FICA and and Medicare income we were earning on our W2's. Then how much we have in our 401K. For forms like this want your income and assets to be as low as possible, but won't let you get away with it.
    Since I had my own business, and single, was using a good share of my gross assets to put back into my business. So had to submit a financial statement to the USCIS for that I-864. In this case, you want to show how rich you are.
    Ha, at our AOS interview, was a situation where a lot less of my income would go back into my business, and a lot more for my new dependents. Wife also submitted the I-864A with her assets. USCIS wants to make sure you are not bringing any poor here. And that you have the cash to maintain them at 125% of the poverty level for the next ten years.
    Putting money away for a 401K plan is part of your income.

    It doesn't surprise me that the CO decided you might become a public charge in the U.S. It appears that you are missing two very important pieces of evidence. You are missing a letter from his employer, and also you are missing current paycheck stubs which accurately reflect his income. Without this evidence, I don't think you can overcome the public charge issue.
    One solution is to get a letter from his employer which accurately states his wages, and to have his employer start paying your fiancé's entire earnings by check. After a couple of months, submit these to the Embassy in order to show them that his current sustained income is above 125% of the poverty line. That way, he can qualify on his own and won't need a cosponsor.
    Your fiancé's employer fears an investigation. That's because they are hiding something, and that means it's time for your fiancée to play hardball. Have your fiancé demand that his employer end the cash payments. From now on, his entire earnings must be paid by check. Also demand an employer's letter. Let the employer know that if they don't do it, then he will report their payroll irregularities to the authorities.

    "Oh, your baby is so cute" that was the first word that came out from the CO's mouth. The CO was so kind that he had fun with my little buddy the whole time, he was laughing so hard with my baby then after a couple of minutes he gave me a sad face telling me about something and makes me so worry. He told me that my fiance's income is not enough for 6 people cause they have to add my kids from my first husband even if they will not accompany me right now, adding that if my case was handled with other CO he don't think they would give my case a consideration. He also told me that even if i can provide them a co-sponsor they would not allow it cause its a K1 visa. After a moment of looking at my fiance's W2 he then told me okay you have 90 days to marry your fiance , I didn't get what he means cause i was praying so hard that may our good Lord touch his heart at that time so I asked "Sir, am i approved?" then he smiled and replied me " Yes and wELCOME" . I got teary eyed after i said "thank you sir".. it was an early xmas gift for me.

    Hello, try to find a lawyer here in the Philippines who specialized Annulment Cases, they know what kind of case they will file , there are lots of grounds to file an Annulment Case . I was separated for 6 years and my lawyer filed an annulment with the grounds of "Psychological Incapacity with NARCISSISTIC Anti-Social Behavior" . So before going to the next step like filing of K1 visa try to cleared out the first step. You need a long patience in this case cause I waited mine for 3 years and my case is "No Contest" meaning my ex didn't file for a counter affidavit so if your fiancee's husband (not ex yet cause she's still married to him up to this point)would file a counter affidavit then maybe much longer. The whole process needs a long patience and a strong faith to God. But before filing an Annulment make sure you find the right attorney who would not want only money, but an attorney who wants money (of-course that's what they after for, lol) and who wants to win the case.

    As I read your first post again, your case needs a good advice from an immigration lawyer. Looks like there's something going on her mind. Whatever it is she is the only one who knows it. They separated 2 months after they got married and even then she already started talking to you. I don't think she totally lost her communication with her husband since you stated her husband filed her marriage her in the Philippines 2 months ago and even filed a marriage visa. and that's 22 months (if i'm not mistaken) after they got married and at the same time you filed K1 visa for her. Don't you think someone would file a marriage visa for her wife more than 20 months after they got married if they don't have any means of communications? Does it means she was talking to you and talking to her husband at the same time? I'm sorry but its looks like "whoever visa comes first" basis here. I'm sorry its just my point of view but thinking about that, maybe that's why she got denied, she put single on her application while the truth is she was married. Does she tell you the cause of her denial?.... Seems like she lied from the very start.... Your fiance maybe can hide something from you but not with USCIS.....

    well, try to apologize, there are many reasons why she done that things, first maybe she thinks she's worthless and that's why you treat her that way in front of her friend. Secondly, maybe its the outcome of her medication. I must say i am also a little freak when i get mad but just for one to two days only , but if that happens everyday after the incident, then its not normal. Try to understand her situation and try to talk to her before going to sleep, that time u are both calm. God Bless both of you.
