    You have no understanding of restraining orders.
     
    Beyond a reasonable doubt is for final criminal trials, not for preliminary temporary restraining order at begining of process.  Beyond a reasonalbe dbout requires a trial.

    So she moved out and wanted to keep in contact which is a good thing. You know what she probably thought is by her doing this it would spur you in to doing something with your life to earn her love and affection. But my best guess is that you sat at home and sulked, instead of going out and buying flowers or taking her to a romantic dinner.

    A restraining order is a HUGE deal. Under no circumstance should you avoid going and let it be placed on you. It will impact you for the rest of your life. You wont be able to purchase a gun, you wont be able to pass background checks for certain jobs. It will be on your record forever.

    Yes and yes.
     
    Bring an immigrant wife to US and expect her to go to work or start a business to support you while you no work is lack common sense.  People warned you and you ignored them.

    Please, she is not going to sue your mom. Most immigrants come here for a better life and the goal is a green card. She just wants a green card and to move on w her life and find a man w a job that works and can support her. I also doubt she has the money for a lawyer to sue. Also most immigrants, contrary to America, do not want to ask for gov assistance. 
    Divorce and move on. She just wants a greencare to be free from you. I would suggest perhaps getting therapy and help to move on and also to find your way in life.

    The people of VJ called it. That's why I enjoy this community. Though opinions may be tough at times, they are 99% accurate.  OP , you asked what the point of a divorce is? Well what or how exactly do you benefit from not divorcing? Do you think that entitles you to some kind of control over her or the situation at hand?

    Well at least Trump has great heart for DACA beneficiaries. I'm sure that will comfort them greatly as they traverse foreign streets perhaps not speaking the local language.

    Personally never had issues with using USPS for all my wife's immigration paperwork, and we've always used express mail. Maybe bad luck.
     
    Same goes for overseas USPS, and the issue for us was the custom for the other country.

    It will probably take nearly as long to apply for the waiver, which has no guarantee of success, compared to waiting out the bar, which does. 
     
    You have zero chance of being issued the visa without one of those two things happening. It isn't a matter of discretion; the CO has no latitude whatsoever to vary the law just for you.

    If the original I-485 is withdrawn, then the EAD/AP card is no longer valid, regardless of what the card says, as the validity of that card is ENTIRELY based on the PENDING I-485 until a decision has been made (in this case, withdrawal).
     
    If he makes an attempt to come back, POE officers will see this in the system.  
     
    I dunno...so far it sounds like the AOS was abandoned and you'll have to re-sponsor him as an IR-1/CR-1 to bring him back legally.

    It was your fathers responsibility to update his address each time he moved.  He failed to do so .  USCIS is not to blame for your father not caring enough to keep his correct address on file.

    How did you react when she refused? Did you get angry and she fled or what happened? I feel that there's way more to this story and maybe she felt that you were forcing her to have sex. Maybe she didn't want to be on the pill (lots of women don't want to put hormones in their bodies) and many women today want to actually have a job and a career before they have kids. 
     
    Not saying that maybe her intent was a green card. I am just saying it feels like there might be waaaay more to this story.

    Then my guess is that you both need a lawyer! Honestly, I can't see how someone refusing to have unprotected sex would be an explanation to claim fraud. Now, I suppose it depends on which of the two of you decided you needed to get a divorce because of that. But if it was the petitioner's decision that would only be seen as pressure on the immigrant to do something they're uncomfortable with. This is just my 'common sense' based opinion, naturally.

    I see no obvious fraud.  Divorce, withdraw the I-864 and don't listen to empty threats.  Many k1s don't get an interview so I'd do this quickly.

    It looks like to me that your employer using you for work in a unnamed central asian country but they do not want to pay for a work visa there for you. So that is why the 28 days there and the 28 days out of that country.

    Cut down your travel to 3 visits and see if your girlfriend can visit you in Australia once, maybe she can go during the December holidays.
