    I had some time to kill yesterday and today... So I went onto the USCIS Case Tracker and listed all K-1s submitted in March... It'll be easy for me to update each week.. Just something to pass the time whilst waiting 😆😅

    Officially an LPR! Crossed yesterday at Port Huron and it was seamlessly easy. Went in and took all of 10 minutes before my passport was stamped and I was on our way. Border officers were so considerate and let my husband stay in the car with our baby while I went inside.

    Last night I had the biggest laugh, at myself I might add, than I have had in many a long day. Absolutely howling. I live in pretty much the middle of nowhere. It is dark here at night, there is just the one streetlight over the road, about 600 yards away from the house. I got a notification from my security camera there was motion outside. There were lights reflecting off the side of my car. Yellow and red, not flashing just visible. And many of them. I went down and looked out the door, all is dark. Hmmm.. The motion detector went off again within 2 minutes, what on earth? I went all the way outside the second time, and in the field next to my house, where they were baling hay all afternoon, I saw these lights. Yellow and red, and two very bright white ones. Sort of in an arc, in the middle of this empty field, in the total darkness. Not a sound out there, just these lights. Alas, no little men, green or otherwise. While I was standing out there trying to understand what I was looking at, the engines on these three tractors came to life. They were getting the hay in, it had started raining. It helps to know that last evening's entertainment was Close Encounters

    I'm unaware of a hard time limit, but USCIS works at USCIS timelines. If they assign a date for the Oath, you need to provide a valid reason to delay it. Miss the ceremony and they may deny the N-400. Really it's supposed to be missing 2 ceremonies, though (https://www.uscis.gov/policy-manual/volume-12-part-j-chapter-4). Delaying it for several months to 2 years is likely impractical. Just because you passed the interview doesn't mean you couldn't later become ineligible (i.e. via a criminal offense or violation of GMC). If you are unable or unwilling to naturalize on their schedule, honestly the best thing is to not start the process until you are ready.

    We just came back from the interview and I’m approved aaaaaaa!! I’m gonna write down my experience before I forget. So, our interview was at 11:30, Reno office, we went in at 11:15 and waited to be called until 11:40. The interview officer was super nice, he asked us the typical COVID-19 questions, then we took the oath and the interview started. For what I could see the forms were reorganized in this order: I-485, I-944, I-864, I-765 and I-130. He went through my I-485 and asked what’s my name, date of birth, address, previous address, if I’m currently employed, my parents names, how many times I’ve been married and date of marriage. Then he asked my husband his name, if he’s currently employed and how many times he’s been married. Also he had to add to my form that I was part of an organization because I didn’t write it in the original submission. Then he went through the yes/no questions, probably asked me 10 of those. I said yes to two of them (i had already disclosed it and explained it in the application I sent). Finally he went through the rest of the forms and asked us if we had any type of paperwork/receipts/statements with both of our names or the address we share in it. We gave him our life insurances, health insurance, tax transcripts (we didn’t filed jointly but the transcripts had the same address), my military spouse card, joint bank account statements, his paystubs, my medical/pharmacy bills and that’s it. He said “that should be enough, we are going to finish the background check and in an hour I should be able to approve you guys”. We left the building at 12:05. An hour later my online status for i-485 changed to “new card is being produced”. For I-765 my online status is fingerprints have been taken and I-130 case was received, I don’t think it matters anymore though. Hope this helps you, the interview was very painless in the sense that nothing was asked that surprised us. Thank you so muuuuuuch for the support and help.     His businesses have lost billions. He is as entitled to claim those losses as anyone else. If the IRS finds that some of the other errata (ie. consulting fees paid to his daughter) was illegal, then it will end up in court at some point in the future, but not while he is president. Whether you love him or hate him (or somewhere in between), at this point, I don't think any specific findings would change anyone's opinion of him. People will rationalize it one way or the other.

    I say good on that driver. I would 100% run people over if they were illegally blocking the road I was on while *gasp* actually trying to do something productive with my time, if I was promised I wouldn't end up in legal trouble for it.

    A visa application is not a FB profile. "In a Relationship" is not an option. If you're not married, you are either divorced or single. To the OP's issue, I'll add my observation that I've seen this issue many times in the last 15 years, and never had anybody come back and report it was resolved successfully.     @MaleAlpha....thank you again for your great insight and helpfulness. The false misrepresentation on my husband's part was definitely not willful, and we do intend to hire an experienced lawyer in this matter. Regardless of the various feedback posts received in response to our situation, my focus is that there is a glimmer of hope in this entire ordeal, and I appreciate the helpful resource information shared. Although no marriage is perfect, I trust my husband. If in all the years I've known him, I would never have married him if I believed he was someone who would willfully lie to me. The immigration process on top of all life's other demands is challenge enough, and marriage encounters obstacles but a husband/wife determined to build a strong foundation can overcome, and that is exactly what my husband and I intend to do, overcome. I will provide the outcome of our issue as we progress. Thank you again for your helpfulness.

    Well, there are cases where people have been able to successfully address immigration issues bordering on misrepresentation. I remember posting a while back about an acquaintance I knew who had misrepresented himself to a CBP official and was now trying to figure out how to immigrate and needed some advise for this guy. I got hit with a TON of responses about how this site is not to help people commit immigration fraud etc. Well, fast forward to a number of years later and he was ABLE to immigrate. His case was a little different but more severe than this (he had entered the US with another person's passport). The solution involved getting banned/denied after they applied for an AOS, his wife applying for waivers with strong evidence to show difficulty if they were not together etc., attorney fees etc, him leaving the US and interviewing at a consulate to be readmitted again etc. but he was able to get it done and is back in the US and has successfully adjusted his status. I think sometimes we are collectively a bit too severe and judgmental on this platform. Yes, it's OK to point out an illegality but to paint the person as a horrible person and how this site is not meant to help people commit fraud etc. when all they seek is advise on how to legally correct a problem they caused in the first place, makes a lot of people not come back to update us of what happened (whether the dispotion was successful or not). No wonder, we don't have updates of people who had this similar issue. My advise to the OP is - Material misrepresentation is very serious as everyone has already said however using the case study of the acquaintance I knew, it CAN be possible (yes, I know it's different circumstances. He was already here and they had a kid who is a USC even though he had entered with someone else's passport and misrepresented himself at the port of entry). As severe as his case was, if he was able to get it fixed, I'm sure this could be fixed too. You definitely need to let USCIS aware of the misrepresentation which will likely trigger a similar ban/inadmissibility and potentially use a waiver to overcome it. Just giving you some hope and hopefully there is a successful outcome. Wishing you and your husband all the best!

    You can get married online, meet up in person, then file the I-130 packet. You would need to show all the normal requirements plus having met up in person plus that you reasonable were able to consummate the marriage. OR You can just meet up and marry in person like >99% of couples, avoid the extra requirements above, and avoid any additional questions or scrutiny that may come with it. I'd highly suggest taking the path much more traveled. Don't add unnecessary complexity to a process that tends to cause anxiety already. I know of at least one case where this did work, but they were immigrating to a country that did not have the physical presence requirement. Had they tried to immigrate in the other direction (to the US), then they would have hit the issue noted above.

    Except for spouse of US Citizen, it is 3X. You failed to read ALL the instructions. 😉 To the OP, meeting the minimum is NOT an guarantee the judgment call will go in your favor. You would not be self sponsoring. You would be using liquid assets of the intending immigrant stated and documented on the petitioner's I-864. My recommendation is that if you have less than $100,000 n liquid assets between you, get a qualified joint sponsor.

    People trying to obtain B visas in high-fraud countries lie in this field ALL THE TIME. A married person is more likely to be approved for a B visa. Consulates know this. We have seen this very scenario repeatedly here on VJ. People come up with all sorts of reasons for why they lied about marital status on a B visa application. It often complicates or halts their future immigrant visa plans. "There was no option for gf" is weak and will not work, IMHO.

    Pretty much. As mentioned before, family immigration extends beyond just marriage but is still a clearly defined, limited path. There are millions of people all over the world that “want to move to the USA”. So the line has to be drawn somewhere as to who can and who can’t. We also need to ensure that there are jobs available for people already here before we bring in people from other countries. Otherwise the very things people want to move here for (better opportunities, higher standard of living, good schools, good health services, etc) disappear and collapse under the weight of the number of people they are trying to support. There is no visa for which the only requirement is “want to live in America” except the diversity visa but if he was born on the mainland of the U.K. he does not qualify for this. Unless he is a vet or a high-level professional within management or marketing - a position that the shelter may struggle to fill locally - then there’s no chance of a work visa. To be honest, if he’s an entry-level type worker then he’s better off in the UK. The social safety net there is much bigger and stronger than it is here.

    Waiting for the green card

    It was dq’d the end of August. So I kind of jumped the gun and reached out to the embassy and told them I would like to schedule an interview because our case was ready. They gave me a site to register at and then we paid the fee and picked a date. Then, we reached out to NVC and told them it was scheduled and forwarded the email showing it. They then set our case to the embassy. I know you are suppose to wait for the NVC but I read/heard they are very slow and there is often miscommunication between the embassy and the NVC. Someone posted on here that they were told by the NVC that the embassy is not having interview but that is obviously not true. It’s up to you to wait for the email from NVC but I don’t know how long it will take.

    I just got a new interview date. Notice date was on 9/16/2020. No email notification which is unusual, luckily I randomly check the website. The interview will be the last week of October. I applied early December 2019 and the interview was supposed to be late March, but got canceled.

    All the information is available on the USCIS case Tracker app - you just need to spend some time compiling it. I spent about 6 hours in total going through over the last 2 days. Good luck!

    I’m not surprised from what you have said that they found the circumstances /what you disclosed on your DS160 suspicious, and want you to reapply for a visa so that a CO can properly assess the application. Thanks btw for confirming that CBP does have access to information on visa applications. Some people here have claimed that they don’t.

    It’s a very expensive long shot as a route to US immigration, especially if you understand how UK student financing works for UK universities. Would make much more sense to get a UK degree then look for a proper work visa. And sorry to be blunt but I somehow don’t think someone whose job prospects are working at an animal shelter is about to get full funding from an ivy, and most colleges are need aware for international students and do not meet full need for them. If just looking for a spouse is the route, the internet is much cheaper than a US college degree

    When can she apply for citizenship?

    Three years less 90 days from the “resident since” date on her green card, assuming she has been married to the same USC for that entire time. There are also physical presence requirements - needs up have spent the majority of her qualifying time in the US. And when she applies she has to have been living in that USCIS jurisdiction for at least 3 months.

    I almost lost hope myself when i applied K1 and was denied (after meeting him and family and spending a month when all USCIS site says is "need to meet in person" and then married repsonding to a 4 page RFE with a 25 pound package of prove, and denied a CR1 after going 3 more times spending 1, 2 and 3 months there that was the pits appealed and won / court said bona fide marriage and to reapply so, don't loose hope / just get a good lawyer who knows his/ her stuff

    Work visas are only available for positions which cannot be filled by US citizens. They are usually in specific specialised fields abs the visa is paid for by the sponsoring employer. Very expensive. The job you mention would not qualify. There is no way you can sponsor him for a work visa

    Will need to get mini-Dave's passport next year if it seems remotely plausible we'd be comfortable visiting PRG's family by next summer (hopefully; last summer PRG didn't have AP or her green card yet, fall and winter was winter in Russia and PRG was pregnant. Have decided not to bother acquiring Russian citizenship for him, so he'll need to go through the foreigners line in Moscow with daddy 🤣. Also hard to believe he's already five months old. Time flies.

    You need to focus on figuring out what is the medical issue first before any sort of expedite comes into play. They’ll need documentation anyway, and the timeline for an expedite may result in negative effects in the meantime to their condition. Do whatever you need to do to figure out what the issue is ASAP.     Certainly not the first time this has come up on VJ...there tends to be a few to handful of cases annually. I have not seen a successful resolution. That could be due to people just not coming back to update their thread, or it could be because no solution to immigrate to the US was found (in many cases, they either eventually break up or immigrate in the other direction). The issue isn't only the lie, but that the lie is assumed to be true. You are saying you lied in the past, but how do they know that's true? You could be lying now instead. They will want to see evidence of what the truth is. Namely, they want to see that a marriage was dissolved. Failing that, showing that a marriage was never entered into is possible, although that's trying to prove a negative, which is very difficult. A lack of a record of a marriage record in a given jurisdiction only means that there is no official record of a marriage there by that issuing organization.

    Mrs. T-B. might have found a place to move, just a couple of miles man. Of course, she ran the Mrs.-T-B.-mobile out of all except Many (2+2) ounces of gas, sigh man. Mini-B. had a doctor caucus, so we gassed the Mrs.-T-B.-mobile, not much longer for this man. We also got her tyres checked, only word with acceptable British spelling man. Many (2+1) of her tyres were way low, sigh and man. And SOMEONE (she denies it) reset the oil gauge in the Mrs.-T-B.-mobile, man. THIS is why we religiously log all maintenance in our side-pocket car books, manual is wonderful man. We might fund her one more oil-change and then let her sink or swim, lead balloon she-to-be man.

Previous owners designated kitchen as a no-smoking area, possible man. Many. Multipack of detectors was on sale when they went to purchase them, we'd buy them man. Many. Fire Department gave them out free, whereupon we'd return our purchased package of them man.

    Crazy isn't it. The man who yanked the meter down said as soon as the electrician had been, to call the office and they would come back and hook me up again. They actually turned up on their own, and hour early, and hung around. Two power trucks and three guys. Must be a slow day here today. I understand that, this dog is 11, and I am trying to keep her ticking over as long as I can and she is able. She's really all I have.

    Well, after 177 days, I finally have my green card in hand. Even better - it has the correct IR status! Our 2 year anniversary was 03/31 and we crossed by land on 04/01. I thought for sure I'd have to file an adjustment, but I don't

    Approved today at our Interview! I'll write a detailed post at a later point, but so glad our journey has ended (well, mostly)!
